SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON PROVISION OF SUPPORT TO SUPPORT CENTERS FOR LIFE SERVICES AND MOBILITY OF PERSONS WITH DISABILITY

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON PROVISION OF SUPPORT TO SUPPORT CENTERS FOR LIFE SERVICES AND MOBILITY OF PERSONS WITH DISABILITY

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for provision of support to support centers for life services and mobility of persons with disabilities which provide life services and transportation convenience to persons with disabilities who have restriction on their daily lives and mobility, in accordance with the Act on Welfare of Persons with disabilities.

Article 2 (Responsibility) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall be responsible to strive to promote welfare of persons with disabilities and their participation in social activities by providing them with life services and transportation convenience.

Article 3 (Formulation of Support Plans) (1) In order to provide support for stable operation of welfare facilities for persons with disabilities which provide life services and transportation convenience to persons with disabilities and for the improvement of their service quality, the Mayor shall formulate an annual support plan.
(2) The support plan under paragraph (1) shall include the matters prescribed in Article 6 (2) 1 and 2 of the Act on Promotion of the Transportation Convenience of Mobility Disadvantaged Persons.

Article 4 (Eligibility for Support) Support centers for life services and mobility of persons with disabilities under subparagraph 2 (h) of attached Table 4 referred to in Article 41 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities, shall be eligible for the support, among the welfare facilities located in the Seoul Metropolitan Government for persons with disabilities reported under Articles 58 and 59 (2) of the same Act.

Article 5 (Subsidization, etc.) (1) The Mayor may subsidize part of the following expenses required by the centers eligible for support under Article 4 within the budget:
1. Project cost required to provide life services and transportation convenience to persons with disabilities;
2. Other costs that the Mayor deems necessary.
(2) In granting a subsidy, charges for the use of services eligible for support prescribed in Article 4 shall be as follows:
1. Where a transportation service is used, Article 16 (1) and (2) of the Seoul Metropolitan Government Ordinance on the Promotion of Transportation Convenience of Mobility Disadvantaged Persons shall apply mutatis mutandis;
2. Where a life support service is used additionally, a charge for the use thereof under the Seoul Metropolitan Government Operation Rule for Seoul Support Centers for Daily Lives and Mobility of Visually Impaired Persons shall be added.
(3) Matters not prescribed in this Ordinance concerning the payment, management, etc. of subsidies shall be governed by the Seoul Metropolitan Government Ordinance on the Management of Subsidies.

Article 6 (Fact-Finding Surveys) (1) Where deemed necessary to grant subsidies under Article 4 and to increase satisfaction of the users of life services and mobility support services, the Mayor may conduct a fact-finding survey.
(2) The Mayor may entrust a fact-finding survey referred to in paragraph (1) to a specialized institution or organization, and, in such cases, he/she may subsidize expenses required therefor within the budget.

Article 7 (Guidance, Supervision, etc.) (1) In order to ensure transparent execution and efficient use and management of subsidies, the Mayor may request the head of a welfare facility which receives a subsidy to report on its services or have a public official under his/her control check and examine the facility.
(2) Where deemed necessary as a result of the check and examination conducted under paragraph (1), the Mayor may issue an order to the head of the welfare facility which receives a subsidy under this Ordinance to make improvement or take other necessary supervisory measures.

Article 8 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance shall be prescribed by Rule of the Seoul Metropolitan Government.

ADDENDA
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Transitional Measures)
Subsidies which have been paid for by the Seoul Metropolitan Government for the operation of Seoul Support Centers for Daily Lives and Mobility of Visually Impaired Persons as at the time this Ordinance enters into force shall be deemed paid for under this Ordinance.
