SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE REDUCTION AND CONTROL OF MALODORS IN COMMUNITIES

Article 1 (Purpose) The purpose of this Ordinance is to ensure that citizens can live in a healthy and pleasant environment by preventing and reducing the malodors produced in communities, as prescribed in Article 16-3 of the Malodor Prevention Act.

Article 2 (Definition of Malodor in Communities) The term "malodor" means any odor that arouses displeasure and disgust from people by stimulating their olfactory sense with hydrogen sulfide, mercaptane, amine, or other pungent substances, and the term "malodor in communities" means any malodor produced by any facilities, etc. other than malodor-emitting facilities.

Article 3 (Mayor's Responsibility) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall proactively establish and promote policies for efficient prevention and reduction of malodors in communities.

Article 4 (Drawing up of Malodor Maps) (1) If necessary to control malodors in communities, the Mayor may draw up malodor maps indicating the current state, etc. of production of malodors in limited areas.
(2) When a malodor map is drawn up, it shall be disclosed to citizens through the Internet website, etc.

Article 5 (Projects Eligible for Subsidies) (1) The Mayor may subsidize the following project costs to prevent the malodors produced by facilities, etc. deemed as sources emitting malodors in communities:
1. Inspection of malodors and technical diagnosis;
2. Installation and improvement of malodor-preventing facilities;
3. Installation of a malodor reduction facility at the drainage tank of each septic tank, such as an air supply system;
4. Other projects that the Mayor deems necessary to reduce the production of malodors.
(2) Details of eligibility for subsidy under paragraph (1), standards for subsidization, execution method thereof, etc. shall be separately determined by the Mayor.

Article 6 (Establishment and Composition of Committee) (1) In order to deliberate on the eligibility, etc. for subsidization of project cost for installation or improvement of malodor prevention (reduction) facilities and to seek advice on policies to solve problems of malodors in communities, the Mayor shall establish the Seoul Metropolitan Government Committee for Control of Malodors in Communities (hereinafter referred to as the "Committee").
(2) The Committee shall be comprised of not more than 15 members including one chairperson and one vice-chairperson, and the chairperson shall be elected from among and by commissioned members, while the vice-chairperson shall be elected from among and by members who are public officials and commissioned members.
(3) Members shall be appointed or commissioned by the Mayor from among the following persons, and the number of members appointed from among public officials shall not exceed one quarter of the total number of members:
1. Ex officio members: Public officials of Grade IV or higher belonging to the headquarters of Seoul Metropolitan Government, who are related to the malodors in communities and subsidies;
2. Commissioned members: Civilian experts, professors in universities and colleges, etc., who have professional knowledge of malodors in communities and social reputation.
(4) The term of office of a commissioned member shall be two years, and consecutive appointment shall be limited to one occasion; and the term of office of a supplementary member shall be the remainder of his/her predecessor's term of office, while the term of an ex officio member shall be his/her tenure of office in the relevant post.
(5) The Committee shall have one executive secretary to deal with the affairs of the Committee, who shall be the head of the team in charge of malodor in communities.

Article 7 (Guidance and Supervision) Where deemed necessary to assess the status of promoting projects subsidized under this Ordinance, the Mayor may cause public officials under his/her control to check and inspect them.

Article 8 (Application Mutatis Mutandis) Provisions of the Seoul Metropolitan Government Ordinance on the Management of Local Subsidies shall apply mutatis mutandis to the procedures, etc. for the provision of subsidies.

ADDENDUM
This Ordinance shall enter into force on the date of its promulgation.
