SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF THE INTERNATIONAL BUSINESS ADVISORY COUNCIL

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF THE INTERNATIONAL BUSINESS ADVISORY COUNCIL

Article 1 (Purpose) The purpose of this Ordinance is to provide for matters regarding the establishment and operation of the Seoul International Business Advisory Council (hereinafter referred to as the “Advisory Council”).

Article 2 (Establishment) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”) shall establish the Seoul International Business Advisory Council (hereinafter referred to as the “Advisory Council”) under his/her control in order to have the Advisory Council provide advice necessary for developing the image of Seoul as a city ideal for information and communications businesses, financial businesses, knowledge services, and research and development industries and for developing Seoul as the central city in East Asia.

Article 3 (Functions) (1) The Advisory Council shall deliberate and research the following matters and shall provide advice on such matters upon receiving a request from the Mayor: <Amended by Ordinance No. 4366, Mar. 16, 2006>
1.The advantages of Seoul as a site location for the strategic industries, knowledge service industries, and research and development industries defined in subparagraph 1 of Article 2 of the Seoul Metropolitan Government Ordinance on the Development of Strategic Industries and the Support of Enterprises and the direction of development of Seoul;
2.The role of Seoul in business activities in the East Asian Region and schemes for the enhancement of the role;
3.Promotional activities for foreign investment in Seoul;
4.Other matters on which the Mayor seeks advice.

Article 4 (Composition, etc.) (1) The Advisory Council shall be comprised of not more than 30 members, including one chairperson, and members shall be commissioned by the Mayor from among persons who meet any of the following criterion:
1.The chief executive officer of a world-famous enterprise or a similarly qualified person;
2.An internationally recognized scholar;
3.Other persons who the Mayor considers necessary.
(2) The Mayor shall organize the Advisory Council with persons who can represent the regional and industrial distribution of countries in the world.
(3) The term of office for each member shall be three years, but this may be renewed consecutively.

Article 5 (Chairperson and Vice Persons) (1) The Advisory Council shall have one chairperson and not more than three vice presidents, and at least three out of one chairperson and three vice chairpersons shall each represent one the following regions, respectively:
1.Americas;
2.Europe, Africa, and the Middle East;
3.Asia-Pacific Region.
(2) The term of office for the chairperson shall be two years, while the term of office for each vice chairperson shall be three years. If the term of office for the chairperson or a vice president under Article 4 (3) expires during his/her term of office, he/she shall be regarded as automatically reappointed, consecutively.
(3) The chairperson shall be elected by and from among vice presidents, while vice presidents shall be elected by and from among council members. <Amended by Ordinance No. 4366, Mar. 16, 2006>
(4) The chairperson shall participate in determining the items of the agenda of each meeting and shall preside over each meeting.
(5) Vice chairpersons shall assist the chairperson and shall act on behalf of the chairperson during his/her absence.
(6) The chairperson may appoint a vice chairperson who shall act on his/her behalf pursuant to paragraph (5). The Mayor shall appoint a vice chairperson to act on behalf of the chairperson, if the chairperson is absent from his/her office without appointing a vice chairperson to act on his/her behalf.

Article 5-2 (Honorary Members) (1) If the Mayor considers it necessary for the efficient operation of the Advisory Council, he/she may commission former chairpersons as honorary members of the Advisory Council.
(2) Honorary members under paragraph (1) (hereinafter referred to as “honorary members”) may attend annual and special meetings under Article 6 (1) to state their opinions as necessary.

Article 6 (Meetings) (1) The Advisory Council shall hold an annual meeting each year and may convene a special meeting, whenever necessary, at the request of the Mayor or the chairperson.
(2) In principle, the place of meeting shall be situated in the Seoul Metropolitan City, but a meeting may be held at any other place in accordance with a prior resolution by the Advisory Council. <Amended by Ordinance No. 4366, Mar. 16, 2006>
(3) Official languages for a meeting shall be Korean and English, and simultaneous interpretation between Korean and English shall be provided, while interpretation into third languages shall also be provided, where necessary.

Article 7 (Advisory Officers) (1) The Mayor may appoint advisory officers who shall assist the Advisory Council in organizing and operating the Advisory Council and preparing for meetings.
(2) Advisory officers shall not be council members, but, shall assist the secretary general under Article 8 (1) in determining and preparing for items of agenda and preparing materials for each meeting. <Amended by Ordinance No. 4366, Mar. 16, 2006>

Article 8 (Secretary General) (1) The Advisory Council shall have one secretary general to carry out administrative works for the Advisory Council.
(2) The secretary general shall be commissioned by the Mayor and shall carry out the following administrative works with assistance from advisory officers:
1.Administrative works for the operation of the Advisory Council;
2.Works for the preparation and production of materials for meetings;
3.Works for the preparation of reports on outcomes of a meeting;
4.Other administrative works necessary for the operation of the Advisory Council.

Article 9 (Hearings, etc.) (1) If the Advisory Council considers it necessary for performing its functions under Article 3, it may request an appropriate employee of the Metropolitan Government or any of its affiliate administrative agencies, an expert, or any other competent person to attend a meeting to hear his/her opinion or demand such person to submit data as necessary.
(2) An appropriate public officer who receives a request from the Advisory Council to attend a meeting or submit data shall comply with the request from the Advisory Council, except in extenuating circumstances.

Article 10 (Bearing of Expenses) (1) The Mayor shall reimburse advisory officers and council members (including honorary members) and one person accompanying each advisory officer or council member for their expenses incurred in lodging, travel, and attending a meeting and shall provide them with benefits for their convenience. <Amended by Ordinance No. 4366, Mar. 16, 2006>
(2) An expert or any other competent person who attends a meeting of the Advisory Council may be reimbursed for actual expenses, such as research expenses, allowances, and travel expenses, within budgetary limits: Provided, That the foregoing shall not apply to a public official who attends in direct connection with his/her duty.

Article 11 (Detailed Operating Rules) Except as provided for in this Ordinance, matters necessary for the operation of the Advisory Council shall be determined by the chairperson subject to prior resolution by the Advisory Council.
