CHAPTER I GENERAL PROVISIONS
Article 1 (Purpose)
The purpose of this Ordinance is to support and promote the establishment and development of those small and medium enterprises which are located in Seoul Metropolitan City under Article 3 (2) of the Framework Act on Small and Medium Enterprises, Article 63 (1) of the Enforcement Decree of the Balanced Regional Development and Support for Local Small and Medium Enterprises Act, and Article 9 (2) 3 of the Local Autonomy Act as well as to contribute to the vitalization of regional economy of the Seoul Metropolitan Government, by providing for necessary matters for the establishment and operation of the small and medium enterprise support facilities of the Seoul Metropolitan Government. <Amended by Ordinance No. 5623, Jan. 9, 2014; Ordinance No. 6386, Jan. 5, 2017>
Article 2 (Scope of Application)
(1) This Ordinance shall apply to supporting and fostering small and medium enterprises implemented by the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") and institutions under its jurisdiction invested or funded by the Seoul Government.
Article 2-2 (Responsibilities)
(1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall formulate and implement measures for supporting and fostering small and medium enterprises.
CHAPTER II ESTABLISHMENT AND
Article 3 (Establishment of Small and Medium Enterprise Support Facilities of Seoul Metropolitan Government)
(1) The Mayor may establish and operate small and medium enterprise support facilities of the Seoul Metropolitan Government (hereinafter referred to as "support facilities") to stimulate the regional economy.
Article 4 (Principles of Management and Operation)
In managing and operating the Support Facilities, the Mayor and any person entrusted with such management and operation under Article 5 (1) shall do so in a manner consistent with the purpose of establishing those Facilities. <Amended by Ordinance No. 6386, Jan. 5, 2017>
Article 5 (Entrustment, etc. of Management and Operation)
(1) The Mayor may entrust any other administrative agency, juristic person, organization or individual belonging thereto capable of managing and operating the Support Facilities with such management and operation to efficiently operate them by ensuring qualified management and operation.
Article 6 (Operating Committee)
(1) Any person who is entrusted with the management and operation of the Support Facilities may organize and operate the Operating Committees for each Support Facility to deliberate on the following matters relating to such management and operation: <Amended by Ordinance No. 6386, Jan. 5, 2017>
CHAPTER III FOSTERING SMALL AND
Article 7 (Formulating Measures for Small and Medium Enterprises and Fostering Plan therefor)
(1) The Mayor shall establish measures for small and medium enterprises under Article 3 (2) of the Framework Act on Small and Medium Enterprises; and a plan for fostering small and medium enterprises under Article 40 of the Balanced Regional Development and Support for Local Small and Medium Enterprises Act (hereinafter referred to as "measures and a fostering plan") for the following year, by December 31 each year.
Article 8 (Protecting Local Small and Medium Enterprises)
The Mayor shall proactively endeavor to preferentially purchase goods manufactured by local small and medium enterprises by means of local priority regulations, etc., when producing or purchasing goods priced less than publicly notified by the Minister of the Interior and Safety under Article 5 (1) of the Act on Contracts to Which a Local Government Is a Party, to the extent not to affect the prices, quality, and supply and demand of goods, to protect local small and medium enterprises; and shall include the locations of contractors in publishing the contract status. <Amended by Ordinance No. 6386, Jan. 5, 2017>
Article 9 (Enforcement Rule)
Necessary matters concerning the enforcement of this Ordinance shall be prescribed by rule.
