SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR BUSINESS ACTIVITIES OF PERSONS WITH DISABILITIES

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR BUSINESS ACTIVITIES OF PERSONS WITH DISABILITIES

Article 1 (Purpose) The purpose of this Ordinance is to improve the economic and social status of persons with disabilities and to contribute to the growth of local economies, by prescribing matters necessary for promoting and supporting the business activities of persons with disabilities.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "person with a disabiliy" means any person defined in subparagraph 1 of Article 2 of the Act on the Facilitation of Entrepreneurial Activities of Persons with Disabilities (hereinafter referred to as the "Act");
2. The term "enterprise owned or operated by a person with a disability" means any enterprise defined in subparagraph 2 of Article 2 of the Act;
3. The term "entrepreneur with a disability" means anyperson with a disability defined in subparagraph 3 of Article 2 of the Act;
4. The term "enterprise under jurisdiction" means any enterprise of a person with a disability at its head office located in the Seoul Metropolitan City (hereinafter referred to as the "City").

Article 3 (Responsibilities) The Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") shall endeavor to ensure that persons with disabilities are given priority in receiving comprehensive support in such fields as funding, information, technology, human resources, and markets, and in obtaining opportunities to engage in business activities, in order to promote their business start-ups and business activities.

Article 4 (Relationship to Statutes, Regulations, and Others) This Ordinance shall apply to promotion of, and support for, the business activities of persons with disabilities, except otherwise provided for in statutes, regulations, or other ordinances.

Article 5 (Establishment and Implementation of Support Plans) (1) Each year, the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall establish and implement a plan to promote and support the business activities of persons with disabilities (hereinafter referred to as "support plan").
(2) The support plan shall include the following:
1. Basic objectives of, and direction-setting for, promoting and supporting the business activities of persons with disabilities;
2. Support for enterprises owned or operated by persons with disabilities in terms of funding, information, technology, human resources, and markets;
3. Other matters necessary for promoting and supporting the business activities of persons with disabilities.

Article 6 (Eligible Enterprises) An enterprise eligible for support under Article 7 shall be an enterprise of a person with a disability at its head office located within the jurisdiction of the Seoul Government: Provided, That the following enterprises are ineligible for such support:
1. An enterprise that exceeds the scale of small or medium enterprise as defined in Article 2 of the Framework Act on Small and Medium Enterprises and Article 3 of the Enforcement Decree of the aforementioned Act;
2. An enterprise that has caused a social issue, such as an industrial accident or high incidence of occupational diseases;
3. An enterprise that has suspended or closed its business for at least three months due to bankruptcy, or an enterprise regulated as a delinquent customer by a financial institution;
4. An enterprise or organization that has harmed the public interest by engaging in such conduct as misusing a subsidy from the Seoul Metropolitan Government.

Article 7 (Promotion of, and Support for, Business Activities of Persons with Disabilities) (1) The Mayor may provide a subsidy for the following activities, in order to promote the business activities of persons with disabilities:
1. Education and training for entrepreneurs with disabilities;
2. Providing information and data for enterprises owned or operated by persons with disabilities;
3. Supporting enterprises owned or operated by persons with disabilities, in their management and marketing activities;
4. Cooperating with organizations established by the entrepreneurs with disabilities;
5. Holding exhibitions, expositions, or other events for displaying the products manufactured by enterprises owned or operated by persons with disabilities;
6. Identifying overseas markets for entrepreneurs with disabilities;
7. Other matters the Mayor deems necessary to promote the business activities of persons with disabilities.
(2) The Seoul Metropolitan Ordinance on the Management of Local Subsidies shall apply to provision of subsidies under paragraph (1).

Article 8 (Preferential Treatment of Enterprises Owned or Operated by Persons with Disabilities) The Mayor may render preferential treatment in the following circumstances in order to promote the business activities of persons with disabilities:
1. When establishing a purchase plan of products manufactured by small and medium enterprises pursuant to Article 5 (1) of the Act on Facilitation of Purchase of Small and Medium Enterprise-Manufactured Products and Support for Development of Their Markets;
2. When selecting a business eligible for a subsidy from the Fund pursuant to Article 5 of the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Small and Medium Enterprise Support Fund;
3. When selecting a business eligible for the Seoul Government's subsidy program.

Article 9 (Establishment of Committee on Support for Enterprises Owned or Operated by Persons with Disabilities) (1) A Seoul Metropolitan Government Committee on Support for Enterprises owned or operated by Persons with Disabilities shall be established to deliberate on the following matters necessary for promoting the business activities of persons with disabilities:
1. Establishing and implementing support plans pursuant to Article 5;
2. Promoting and supporting the business activities of enterprises run by persons with disabilities pursuant to Article 7;
3. Providing preferential treatment to enterprises owned or operated by persons with disabilities pursuant to Article 8;
4. Other matters tabled at the committee meeting for deliberation by the chairperson in order to promote the business activities of persons with disabilities.
(2) Matters to be deliberated on by the Seoul Metropolitan Government Committee on Support for Enterprises owned or operated by Persons with Disabilities under paragraph (1), shall be deliberated on by the Seoul Metropolitan Government Committee on Hopeful Economies established under the Seoul Metropolitan Government Ordinance on Establishment and Operation of Hopeful Economies. In such cases, the Seoul Metropolitan Government Committee on Hopeful Economies shall be deemed to be the Seoul Metropolitan Government Committee on Support for Enterprises owned or operated by Persons with Disabilities.

Article 10 (Encouragement of Purchase) The Mayor shall encourage the purchase of construction, services, and products provided or manufactured by the enterprises owned or operated by persons with disabilities, except for products that should be preferentially purchased pursuant to other Acts.

Article 11 (Publicity) The Mayor may publicize the following matters on the Official Gazette, the website, etc. of the Seoul Metropolitan Government in order to promote the business activities of persons with disabilities:
1. Quality of products and services manufactured or provided by the enterprises of persons with disabilities;
2. Raising the citizens' awareness of the enterprises owned or operated by persons with disabilities by discovering exemplary enterprises owned or operated by persons with disabilities;
3. Matters relating to encouraging the purchase of products manufactured by the enterprises owned or operated by persons with disabilities.

Article 12 (Rewards) The Mayor may grant a reward to an enterprise, individual, organization, or other entities selected as making a substantial contribution to promoting the business activities of persons with disabilities.
