SEOUL METROPOLITAN GOVERNMENT ORDINANCE TO PROMOTE EMPLOYMENT OF HIGH SCHOOL GRADUATES

SEOUL METROPOLITAN GOVERNMENT ORDINANCE TO PROMOTE EMPLOYMENT OF HIGH SCHOOL GRADUATES

Article 1 (Purpose) The purpose of this Ordinance is to promote job creation for high school graduates in Seoul Metropolitan Government under the Special Act to Promote Employment of the Youth, thereby contributing to continued economic growth and social stability.

Article 2 (Definition) The term "high school graduate" in this Ordinance means a non-entrant of a college or school referred to in Article 2 of the Higher Education Act, among graduates of high schools or high technical schools (including pending graduates; hereinafter the same shall apply) under subparagraph 3 of Article 2 of the Elementary and Secondary Education Act and persons recognized as having the same educational background as high school graduates under Article 98 of the Enforcement Decree of the same Act.

Article 3 (Duties) (1) The Seoul Metropolitan Government Mayor (hereinafter referred to as the "Mayor") shall create a social and economic environment where employment of high school graduates is promoted.
(2) Institutions, etc. invested, funded or financed by Seoul Metropolitan Government (hereinafter referred to as the "City"), consignment institutions under the Special Metropolitan Government Ordinance on Outsourcing Administrative Affairs to the Private Sector, and corporations, organizations, and institutions which receive budget from the City under the Special Metropolitan Government Ordinance on Management of Subsidies (hereinafter referred to as "public enterprises, etc.") shall proactively cooperate in the City's countermeasures to promote employment of high school graduates.

Article 4 (Establishment of Countermeasures to Promote Employment of High School Graduates) (1) To facilitate employment of high school graduates, each year, the Mayor shall formulate and implement countermeasures containing the following matters:
1. Local industrial trends and trends in supply of and demand for high school graduates;
2. Goals and implementation plans to promote employment of high school graduates;
3. Projects to promote employment of high school graduates, including job fairs for the pertinent year;
4. Matters on funding to promote employment of high school graduates;
5. Matters on vocational guidance, job placement, development and training of occupational aptitude, etc.;
6. Matters concerning cooperation between educational institutions under the Higher Education Act and enterprises, etc.
7. Other matters necessary to promote employment of high school graduates.
(2) The Mayor shall evaluate performance of the countermeasures to promote employment of high school graduates each year, and reflect evaluation results in the following year's countermeasures to promote employment of high school graduates.

Article 5 (Surveys, etc. on High School Graduates) (1) The Mayor may conduct a survey, if necessary for formulating countermeasures to promote employment of high school graduates under Article 4.
(2) Where the Mayor conducts a survey under paragraph (1), he/she may outsource it to an institution, corporation, etc. related to job creation for youths.

Article 6 (Increasing Employment of High School Graduates) A public enterprise, etc. with a regular staff of at least 20, among enterprises, etc. referred to in Article 3 (2), shall endeavor to priorize hiring high school graduates for at least 10/100 of newly-employed persons each year.

Article 7 (Prohibition of Disadvantages to High School Graduates) (1) Where a public enterprise, etc. hires a high school graduate pursuant to Article 6, the head of a relevant organization shall ensure that the relevant employee is not disadvantaged regarding personnel affairs and his/her status or is not discriminated against in working conditions, without any justifiable grounds.
(2) The head of each organization shall not classify employed high school graduates into a separate occupational group to manage them separately.
(3) The head of each organization shall ensure that high school graduates are not recruited mainly for a specific occupational group.

Article 8 (Cooperation, etc. with Relevant Institutions and Organizations) (1) To provide services for supporting promotion of employment of high school graduates, the Mayor shall proactively cooperate with central administrative agencies (including institutions belonging to or affiliated with such agencies; hereafter the same shall apply in this Article) and job-related institutions, organizations, etc.
(2) If necessary, the Mayor may enter into agreement, etc. on job creation for high school graduates with central administrative agencies, institutions, organizations, etc. related to job creation.

Article 9 (Administrative and Financial Support) (1) To promote employment of high school graduates, the Mayor may provide administrative and financial support to public enterprises, etc. and enterprises under Article 3 (2) which have accomplished employment goals prescribed in Article 6.
(2) With regard to the method, procedure for subsidizing expenses under paragraph (1) and other necessary matters, the Special Metropolitan Government Ordinance on Management of Subsidies shall apply.

Article 10 (Enforcement Rules) Matters necessary for the enforcement of this Ordinance shall be prescribed by the Rules.
