SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF WORKERS' WELFARE FACILITIES

Article 1 (Purpose) The purpose of this Ordinance is to contribute to stabilizing workers' lives and promoting workers' welfare by prescribing matters concerning the establishment and operation of workers' welfare facilities of the Seoul Metropolitan Government pursuant to Article 28 of the Framework Act on Labor Welfare and Article 144 of the Local Autonomy Act. <Amended by Ordinance No. 5274, Mar. 15, 2012; Corrected on Sep. 2, 2013; Amended by Ordinance No. 6386, Jan. 5, 2017>

Article 2 (Scope of Application) Except as otherwise provided by any other statute or municipal ordinance, the provisions of this Ordinance shall apply to the establishment and operation of workers' welfare facilities of the Seoul Metropolitan Government (hereinafter referred to as "welfare facilities"). <Amended by Ordinance No. 5274, Mar. 15, 2012>

Article 3 (Establishment and Operation) The names and functions of the welfare facilities established and operated under this Ordinance are as specified in the attached Table. <Amended by Ordinance No. 5677, Mar. 20, 2014>

Article 4 (Eligibility for Use) Persons eligible to use welfare facilities shall be limited to those who reside in the Seoul Metropolitan City and render his/her labor for wages.

Article 5 (Use of Welfare Facilities) In order to prevent damage to a welfare facility, the Mayor of the Seoul Metropolitan City (hereinafter referred to as the "Mayor") may issue an order against any of the following users to leave a facility or may take any necessary measure to restrict their use of a facility:
1. A person who alters and damages a facility or structure without authorization;
2. A person who sells or lends his/her access card to another person;
3. A person who creates a disturbance, drinks alcoholic beverage, or gambles in a facility;
4. A person who steals another person's belongings or inflicts a loss on another person by fraud in a facility;
5. A person who brings in sleeping gear, inflammables, explosives, or any other commodity subject to restriction on bringing into a facility;
6. A person who violates any regulation relevant to the operation of a welfare facility.

Article 6 (Entrustment of Management and Operation) (1) In order to efficiently operate welfare facilities, the Mayor may entrust the management and operation of the welfare facilities under Article 3 to a corporation, organization, institution, or individual having good capability. In such cases, among the affairs of the Mayer under this Ordinance, those regarding restriction on the use of welfare facilities under Article 5 shall be deemed to be entrusted to the head of the entrusted institution.
(2) Articles 7 through 19 of the Seoul Metropolitan Government Ordinance on the Entrustment of Administrative Affairs to the Private Sector shall apply to the procedures and methods necessary for the entrustment of management and operation of welfare facilities. <Amended by Ordinance No. 4727, Jul. 30, 2009>

Article 7 (Assistance to Workers' Welfare Facilities of Autonomous Gus) The Mayor may partially subsidize autonomous Gus for necessary expenses incurred in establishing and operating workers' welfare facilities in autonomous Gus, within the budget.
