SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON ESTABLISHMENT AND OPERATION OF FAMILY-NATURE EXPERIENCE FACILITIES

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON ESTABLISHMENT AND OPERATION OF FAMILY-NATURE EXPERIENCE FACILITIES

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for establishing and operating family-nature experience facilities of the Seoul Metropolitan Government.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "family-nature experience facility" (hereinafter referred to as "nature experience facility") means a camping site or experience facility installed to provide relaxation for, and cultivate positive emotions of, Seoul citizens by utilizing closed schools outside the boundaries of Seoul Metropolitan City;
2. The term "fees" means fees for using a camping site or facility, rents for using equipment, public utility charges, etc. collected from persons who use nature experience facilities.

Article 2-2 (Mayor’s Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”) shall formulate policies on the creation, management, and use of nature experience facilities and action plans therefor.
(2) The Mayor shall conduct regular safety inspections of nature experience facilities and disclose the findings on a regular basis to ensure safety at such facilities.

Article 3 (Collection of Fees) Fees collected from users of nature experience facilities shall be prescribed by rule of the Seoul Government within the scope specified in attached Table 1, taking into account such matters as costs and inflation rates.

Article 4 (Reduction of or Exemption from Fees) The Mayor may grant a reduction of or an exemption from fees specified in attached Table 1 to any of the following persons, between 30/100 and 50/100 of the fees, as prescribed by rule of the Seoul Government:
1. A recipient and his or her children under the National Basic Living Security Act;
2. A single-parent family member under the Single-Parent Family Support Act;
3. A person with any disability registered under the Act on Welfare of Persons with Disabilities and a person who accompanies such person;
4. A person of distinguished service to the State and his or her bereaved family or family under the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;
5. A person of distinguished service to independence and his or her bereaved family or family under the Act on the Honorable Treatment of Persons of Distinguished Service to Independence;
6. A family with at least three children, among persons who hold Dadoongee Cards.

Article 4-2 (Reduction or Exemption for Simplified Payment System for Micro-Enterprises) A fee reduction or exemption of up to 10/100 may be offered as prescribed by the Mayor to a person who pays fees specified in Attached Table 1 using a simplified payment system for micro-enterprises (referring to the payment system operated by an institution designated by the Minister of SMEs and Startups to reduce the burden of the relevant commission on small enterprises): Provided, That this shall not apply to reduction of or exemption from fees under Article 4.

Article 5 (Fee Refunds) (1) Where it is impossible to use nature experience facilities due to a natural disaster, force majeure, etc. or where the use of such facilities is cancelled or discontinued due to extraordinary circumstances regarding the facilities, the Mayor shall fully refund the fees paid.
(2) Where the use of the facilities has been cancelled due to circumstances attributable to the user, the Mayor shall refund the fees paid according to the following classifications: Provided, That this shall not apply where the use of the facilities is cancelled on the day of use:
1. Where it is cancelled at least 14 days prior to the day of use: The full amount of the fees;
2. Where it is cancelled at least seven days prior to the day of use: 75/100 of the fees;
3. Where it is cancelled at least one day prior to the day of use: 50/100 of the fees.

Article 6 (Restrictions on Use) Permission for use need not be granted, or measures, such as the revocation of permission for use and the suspension of use, may be taken, to any of the following persons:
1. A person likely to disturb public order and good morals;
2. A minor not accompanied by his or her custodian;
3. A person who holds dangerous materials or ill-smelling or obnoxious goods;
4. A person with an infectious disease;
5. Other persons for whom the Mayer deems it necessary to restrict the use of the facilities in order to protect the facilities or maintain order.

Article 7 (Obligations of Users) (1) Where a user destroys or loses a facility or equipment, he or she shall compensate for damage or reinstate it. <Amended by Ordinance No. 6993, Jan. 3, 2019>
(2) Users shall not destroy nature experience facilities at their discretion except under extraordinary circumstances such as urgencies, and shall use such facilities in a safe and clean manner at all times. <Newly Inserted by Ordinance No. 6993, Jan. 3, 2019>

Article 8 (Entrustment of Operations) (1) If deemed necessary for more professional and efficient operations of nature experience facilities, the Mayor may entrust operations of such facilities to an institution invested or funded by the Seoul Metropolitan Government, a corporation, or an organization.
(2) The Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector shall apply mutatis mutandis to matters concerning necessary procedures, methods, etc. if operations of natural experience facilities are entrusted pursuant to paragraph (1).

Article 9 (Enforcement Rule) Matters necessary for enforcing this Ordinance shall be prescribed by rule of the Seoul Government.

This Ordinance shall enter into force on the date of its promulgation.

Article 2 (Effective Period of Fee Reduction or Exemption for Payment Using Simplified Payment System for Micro-Enterprises)
The amended provisions of Article 4-2 shall remain effective until December 31, 2019.
