SEOUL METROPOLITAN GOVERNMENT FRAMEWORK ORDINANCE ON JOB POLICIES

CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to contribute to improving standards of living by formulating and implementing policies on jobs so that the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") can assist citizens to develop occupational skills throughout their lifetime and have more employment opportunities.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "job creation" means the development of various jobs suited to capabilities and aptitude of the unemployed or the assistance to the unemployed in securing a job;
2. The term "vulnerable social group" shall be defined in accordance with subparagraph 2 of Article 2 of the Social Enterprise Promotion Act.

Article 3 (Responsibilities of Mayor) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall set directions for job policies, formulate plans for administrative and financial support necessary for implementing the policies, and endeavor to create an environment for the stability of employment of workers, enterprises' job creation and convenient recruitment of human resources. <Amended by Ordinance No. 7044, Mar. 28, 2019>
(2) The Mayor shall make strategic efforts to create jobs that satisfy workers' wage conditions, working hours, and the stability of employment and to stabilize employment. <Amended by Ordinance No. 7044, Mar. 28, 2019>
(3) The Mayor shall endeavor to assist the unemployed in securing a job and promote the participation of the labor market.

CHAPTER II JOB POLICIES Article 4 (Formulation and Implementation of Framework Plan for Job Policies) (1) The Mayor shall formulate a framework plan for job policies (hereinafter referred to as "framework plan") every five years.
(2) A framework plan shall include the following matters:
1. Goals and direction-setting for policies for job creation, assistance in employment, and stabilization of employment;
2. Programs to create jobs, assist employment, and assist the stabilization of employment;
3. Education and training related to job creation and employment;
4. Assistance and campaigns for job creation, the assistance in employment, and the assistance in the stabilization of employment;
5. Other matters the Mayor deems necessary for job creation, the assistance in employment, and the assistance in the stabilization of employment.

Article 5 (Projects for Creating Jobs) The Mayor may implement or support the following projects for creating jobs:
1. Projects for creating jobs by inviting domestic and foreign enterprises and fostering local industries;
2. Projects for creating jobs by supporting startup businesses and fostering venture businesses;
3. Project for creating jobs for classes disadvantaged in employment, including women, the disabled, and the long-term employed;
4. Projects for creating jobs in the social economy, including social enterprises, community enterprises, cooperatives, and self-support enterprises;
5. Other projects necessary for creating jobs.

Article 6 (Programs for Assistance in Employment) The Mayor may implement or support the following programs for relieving enterprises' shortage of manpower and helping job-seekers:
1. Programs for assistance in employment (programs for providing services for job offers, job search, and job placement);
2. Training programs for developing occupational skills and programs for training human resources;
3. Programs for assistance in employment by providing information about small and medium enterprises, etc.;
4. Programs for assisting vulnerable social groups in securing a job;
5. Other programs necessary for assistance in employment.

Article 7 (Subsidized Programs) The Mayor may grant subsidies necessary for the following programs in accordance with Articles 17 and 32-2 of the Local Finance Act:
1. Programs for providing public-works jobs;
2. Programs for training human resources and programs for rendering services for assistance in employment, including job referrals and counseling;
3. Programs for promoting employment in the private sector;
4. Programs for supporting cooperation between labor and management, workers' welfare, labor organizations, etc.;
5. Programs for supporting social enterprises, cooperatives, community enterprises, etc.;
6. Programs for supporting startup businesses.

Article 8 (Job Impact Assessment) The Mayor shall analyze and assess the impact of various policies of the Seoul Government on employment and the increase or decrease in jobs and shall endeavor to reflect outcomes thereof in the formulation and implementation of policies.

CHAPTER III JOB COMMITTEE Article 9 (Establishment and Functions of Job Committee) The Mayor shall establish the Job Committee (hereinafter referred to as the "Committee") in order to prepare comprehensive measures for jobs through the establishment of systems for integrated management of job policies and all aspects of projects and for cooperation between the public and private sectors, and to deliberate and advise on the following matters in regard to assistance in job creation:
1. The formulation and implementation of the framework plan for job policies under Article 4;
2. Assistance in projects under Articles 5, 6, and 7;
3. Matters concerning the promotion of employment, the development of occupational skills, and measures for the unemployed;
4. Assistance to unemployed youths in securing a job in a small or medium enterprise;
5. The evaluation of job policies;
6. Other matters tabled at a meeting by the chairperson, for job creation.

Article 9-2 (Duration of Existence of Committee) The Committee shall remain in existence until December 31, 2021.

Article 10 (Composition of Committee) (1) The Committee shall be comprised of approximately 30 members, including two co-chairpersons and one vice chairperson.
(2) Members of the Committee shall be appointed or commissioned by the Mayor from among the following persons:
1. Public officials who work as Director or in a higher position for a sector related to jobs in the Seoul Government;
2. Public officials who work as Director or in a higher position for the Seoul Regional Employment and Labor Office;
3. Representatives from various fields and sectors, including economic circles, labor groups, and social organizations;
4. Experts with abundant knowledge and experience in employment, labor relations, economics, and social issues;
5. Members of the Seoul Metropolitan Council;
6. Other persons whom the Mayor recognizes as those necessary.

Article 11 (Term of Office of Members) The term of office of each commissioned member shall be two years from the date of commissioning and may be renewed consecutively only twice.

Article 12 (Duties of Chairperson) (1) The Mayor shall serve as one of the co-chairpersons of the Committee and the other co-chairperson of the Committee shall be elected by and from among commissioned committee members, and the vice chairperson shall be elected by and from among commissioned committee members who have abundant knowledge and experience in a field related to jobs.
(2) Each chairperson shall represent the Committee regarding administrative work of the Committee and administer all affairs of the Committee.
(3) If the positions of chairpersons are vacant, chairpersons are unable to perform their duties in extenuating circumstances, or the chairpersons deem it necessary, the committee member designated by chairpersons in advance shall act on behalf of co-chairpersons.

Article 13 (Operation of Committee) (1) A chairperson shall convene and preside over meetings of the Committee.
(2) Meetings of the Committee shall be divided into regular meetings and special meetings.
(3) Regular meetings shall be convened semi-annually, while a special meeting shall be convened in either of the following cases:
1. Upon a chairperson's request for to convene a meeting;
2. Upon requested by at least 1/3 of current committee members to convene a meeting.
(4) A majority of current committee members shall constitute a quorum at a meeting, and any resolution thereby shall require the concurring vote of a majority of those present.

Article 14 (Working Committee) (1) The Committee shall establish a working committee in order to manage committee meetings efficiently.
(2) The working committee shall be comprised of working-level experts in employment, labor relations, industrial economy, urban regeneration, etc.
(3) The working committee shall formulate and evaluate job policies, and monitor the implementation of such policies, and expenses incurred in performing research tasks may be subsidized, within budgetary limits.

Article 15 (Executive Secretary) The Committee shall have one executive secretary and one clerk who shall carry out administrative work of the Committee, and the Director in charge of affairs related to jobs, shall serve as executive secretary, while the officer in charge of affairs related to jobs shall serve as clerk.

Article 16 (Allowances) Allowances may be paid and travel expenses reimbursed to committee members who attend a meeting of the Committee in accordance with the Seoul Metropolitan Government Ordinance on the Payment of Allowances and Travel Expenses for Committees, within the budget: Provided, That the foregoing shall not apply where a public official attends a meeting of the Committee in direct connection with an affair within the scope of the affairs assigned to him or her.

Article 17 (Operating Rules) Except as provided in this Ordinance, matters necessary for the operation of the Committee and the working committee shall be determined by the Mayor after resolution by the Committee.

CHAPTER IV JOB SUPPORT FACILITIES Article 18 (Job Support Facilities) (1) The Mayer may establish and operate job support facilities, such as Seoul Job Plus Center, in order to provide the following services:
1. Counseling and referrals for job offers and job search;
2. Education for assistance in securing a job;
3. Provision of employment information, including job fairs;
4. Other services necessary for assistance in securing a job.
(2) Pursuant to Article 63 of the Enforcement Decree of the Balanced Regional Development and Support for Local Small and Medium Enterprises Act, the Mayor may establish and operate a startup support center in order to provide the following services:
1. The provision of incubators for startup businesses, the provision of information, and the operation of programs for assisting startup businesses, including education and consulting services;
2. The provision of funds for startup businesses and assistance in marketing, including exhibitions and stores;
3. Other services necessary for assisting startup businesses.

Article 19 (Administrative and Financial Support) (1) The Mayor may render administrative support and financial support, within budgetary limits, for the following projects for creating jobs:
1. The project costs to be incurred in a project for creating jobs under the subparagraphs of Article 5;
2. The project cost to be incurred in a project for assistance in securing a job under the subparagraphs of Article 6;
3. The project cost to be incurred in a subsidized project under the subparagraphs of Article 7;
4. The project cost to be incurred in operating job support facilities specified in Article 18;
5. The project cost to be incurred in information, education, and publicity services provided to enterprises and citizens in relation to jobs;
6. The treatment of and support for enterprises, individuals, organizations, etc. that have contributed, or plan to contribute, to job creation.
(2) The Seoul Metropolitan Government Ordinance on the Management of Local Subsidies shall apply to the methods, procedure, etc. for the subsidization of project costs under paragraph (1).
(3) The Mayor may select outstanding enterprises, individuals, and organizations in creating jobs and award commendations thereto; the Seoul Metropolitan Government Ordinance on Official Commendations shall apply to the kinds of commendation, recommendation, examination of deeds, etc.

Article 20 (Cooperation with Related Institutions) (1) The Mayor shall cooperate with central administrative agencies, other local governments, and institutions, organizations, etc. related to jobs in providing services for assistance in creating jobs.
(2) The Mayor may sign agreements, etc. for creating jobs with central administrative agencies, other local governments, and institutions, organizations, etc. related to jobs.

Article 21 (Entrustment of Services) (1) The Mayor may entrust all or some services under this Ordinance to a related institution, a nonprofit organization, or a City-invested or City-funded institution, which perform services related to jobs.
(2) The Seoul Metropolitan Government Ordinance on the Administrative Affairs to the Private Sector shall apply where services are entrusted under paragraph (1).

ADDENDA
Article 1 (Enforcement Decree)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Duration of Existence of Job Committee)
The Job Committee established under this Ordinance shall remain in existence for two years from the date the Committee is initially formed, but the duration of existence may be extended based upon the evaluation of results of operation.
