SEOUL METROPOLITAN GOVERNMENT ENFORCEMENT RULE OF THE ORDINANCE ON PRESERVATION, MANAGEMENT, ETC. OF HANYANGDOSEONG, THE SEOUL CITY WALL

Article 1 (Purpose) The purpose of this Rule is to prescribe matters delegated by the Seoul Metropolitan Government Ordinance on Preservation, Management, etc. of Hanyangdoseong, the Seoul City Wall (hereinafter referred to as the "Ordinance") and matters necessary for enforcing said Ordinance.

Article 2 (Scope of Application) Except as otherwise expressly provided for in other statutes and municipal ordinances, the preservation, management, and utilization of Hanyangdoseong shall be governed by this Rule.

Article 3 (Scope of Persons Subject to Consensus Gathering on Master Plans) The scope of interested parties to gather consensus on a master plan for preservation and management of Hanyangdoseong formulated under Article 6 (3) of the Ordinance (hereinafter referred to as "master plan") shall be as follows: <Amended by Rule No. 4283, Aug. 2, 2018>
1. Residents of houses in a heritage site or buffer zone designated under Article 7 of the Ordinance; or the owners of land or buildings therein;
2. Implementers of development projects for whom the implementation of development projects, such as a redevelopment project, is to be affected by the formulation of the master plan.

Article 4 (Procedures for Gathering Consensus on Master Plans) (1) To gather consensus from interested parties regarding a master plan, the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall publicly announce major contents of a draft master plan in the Official Gazette of the Seoul Metropolitan Government published by the Seoul Metropolitan Government and on its website to ensure that the plan is available for public inspection for at least 20 days. <Amended by Rule No. 4259, Jan. 17, 2019>
(2) Any interested party who has an opinion about the contents of the draft master plan may submit a written opinion to the Mayor within the inspection period specified in paragraph (1).

Article 5 (Functions of Hanyangdoseong Advisory Committee) The Hanyangdoseong Advisory Committee established under Article 4 (4) of the Ordinance (hereinafter referred to as the "Advisory Committee") shall provide advice on the following:
1. Policy directions and basic principles for preserving and managing Hanyangdoseong and its surrounding areas;
2. Formulation and implementation of plans to preserve and manage Hanyangdoseong;
3. Formulation and implementation of various plans for the surrounding areas of Hanyangdoseong;
4. Other matters on which the Mayor seeks advice from the Advisory Committee, as they are deemed to have significant impacts on the preservation and management of Hanyangdoseong and its surrounding areas.

Article 6 (Composition of Advisory Committee) (1) The Advisory Committee shall consist of up to 20 members, including one chairperson, and any particular gender shall not exceed 6/10 of the members commissioned under the main sentence of Article 21 (2) of the Framework Act on Gender Equality: Provided, That this shall not apply where any inevitable ground, such as lack of professionals of a particular gender in the relevant field, is deemed to exist, and the Working Committee on Gender Equality adopts a resolution thereon. <Amended by Rule No. 4259, Jan. 17, 2019>
(2) The chairperson shall be elected from among members of the Committee.
(3) The Chief Officer of the Culture Headquarters, the Chief Officer of the Urban Regeneration Headquarters, the Director-General of the Urban Planning Bureau, and the Director of the Seoul Museum of History shall serve as ex officio members; and commissioned members shall be appointed by the Mayor from among the following persons: <Amended by Rule No. 4259, Jan. 17, 2019>
1. Persons who hold at least a bachelor's degree in the relevant field, such as world heritage, history, architecture, urban planning, landscape, conservation science, and tourism, or who have three years of working experience in the relevant field;
2. Persons from the media, business circles, or civic groups who have extensive knowledge of and experience in the relevant field.

Article 7 (Functions of Hanyangdoseong Administration Council) The Hanyangdoseong Administration Council established under Article 4 (5) of the Ordinance (hereinafter referred to as the "Administration Council") shall deliberate on and coordinate matters specified in each subparagraph of Article 5 between the Seoul Metropolitan Government and relevant autonomous Gus.

Article 8 (Composition of Administration Council) (1) The Administration Council shall be comprised of up to 25 members, including one chairperson. <Amended by Rule No. 4259, Jan. 17, 2019>
(2) The Vice-Mayor I for Administrative Affairs shall serve as the chairperson; and the Vice-Mayor II for Administrative Affairs, the Deputy Mayor of the Planning and Administration Office, the Chief Officer of the Culture Headquarters, the Chief Officer of the City Transportation Headquarters, the Director-General of the Local Autonomy Administration Bureau, the Chief Officer of the Safety Management Bureau, the Chief Officer of the Urban Regeneration Headquarters, the Director-General of the Urban Planning Bureau, the Director-General of the Housing and Architecture Bureau, the Director-General of the Green Seoul Bureau, the vice heads of Jongno-Gu, Jung-Gu, Yongsan-Gu, Seongbuk-Gu, and Seodaemun-Gu, and public officials of other related institutes, shall serve as members of the Council. <Amended by Rule No. 4259, Jan. 17, 2019>

Article 9 (Composition and Operation of Working Council) Where necessary to examine agenda items before a meeting of the Administration Council is held, a Hanyangdoseong working council may be organized and operated which is comprised of related Directors and Director-Generals of autonomous Gus.

Article 10 (Terms of Office of Members) (1) The term of office of each commissioned member of the Committee for Inscription of Hanyangdoseong on the World Heritage List established under Article 4 of the Ordinance (hereinafter referred to as the "Committee for Inscription") and the Advisory Committee shall be two years and he or she may be recommissioned only twice: Provided, That the term of office of a member newly commissioned for filling a vacancy shall be the remainder of the term of office of his or her predecessor. <Amended by Rule No. 4259, Jan. 17, 2019>
(2) The term of office of each ex officio member of each committee shall coincide with the term of his or her service in the position. <Amended by Rule No. 4259, Jan. 17, 2019>

Article 11 (Duties of Chairperson) (1) The chairperson shall represent each relevant committee or the Administration Council, exercise overall control of the affairs of the committee or council, and preside over meetings thereof.
(2) Where the chairperson is unable to perform his or her duties due to extenuating circumstances, a temporary chairperson shall be elected by members present.
(3) Where the chairperson of the Administration Council is unable to perform his or her duties due to extenuating circumstances, the Vice-Mayor II for Administrative Affairs shall act on behalf of the chairperson. <Amended by Rule No. 4259, Jan. 17, 2019>

Article 12 (Decommission of Members) The Mayor may decommission a member of any committee in any of the following cases: <Amended by Rule No. 4259, Jan. 17, 2019>
1. Where the member wishes to be decommissioned;
2. Where the member becomes unable to perform his or her duties for a long period due to his or her death, serious illness requiring long-term treatment, overseas stay, at least six-month overseas travel, etc.;
3. Where the member discloses any confidential information acquired in the course of performing his or her duties or uses such information for personal purposes;
4. Where the member has committed any wrongdoing in the course of performing his or her duties or any wrongdoing that makes him or her unfit as a committee member;
5. Where the member does not refrain despite falling under any subparagraph of Article 13 (1);
6. Where the member is deemed unfit as a committee member on the grounds of neglect of duties, damage to dignity, and others.

Article 13 (Disqualification, Challenge, and Refrainment) (1) Where a member of each committee falls under any of the following cases, the member shall be disqualified for the committee's deliberation, consulting and voting:
1. Where the member or his or her current or former spouse is a party to the agenda item at issue or such person shares rights or obligations with the party to the agenda item;
2. Where a member is a current or former relative of a party to the agenda item;
3. Where a member has provided or conducted any testimony, statement, consulting, research, appraisal, or other contracted services;
4. Where a member or the corporation he or she has worked for is the former or current agent of a party to the agenda item.
(2) A party to the agenda item may file with the committee an application for challenge where grounds for disqualification exist or where he or she has reasonable grounds to believe that it would be difficult to expect fairness from the member in deliberation, consulting, and voting, and the committee shall make a decision by vote. In such cases, the member in question shall not participate in voting.
(3) Where a member falls under the subparagraphs of paragraph (1), the member shall voluntarily refrain from deliberation, consulting, and voting on the agenda item.

Article 14 (Meetings) (1) Meetings of each committee shall be called by the chairperson if deemed necessary by the chairperson or if requested by at least 1/3 of the incumbent members.
(2) Where necessary to efficiently conduct the affairs of each committee, a subcommittee may be established thereunder.
(3) Where necessary for deliberation, counseling, etc. of each committee, relevant public officials, external experts, and other persons may be requested to attend a meeting of the committee to hear their opinions, or a field survey may be conducted.

Article 15 (Executive Secretary) (1) Each committee shall have one executive secretary to conduct its affairs.
(2) The head of a division in charge of Hanyangdoseong shall serve as the executive secretary.
(3) The executive secretary shall prepare and keep minutes of meetings.

Article 16 (Allowances) Allowances may be provided, within the budget, to members, external experts, personnel from civic groups, etc. who attend a meeting of any committee, pursuant to the Seoul Metropolitan Government Ordinance on the Payment of Committee Allowances and Travel Expenses.

Article 17 (Operating Rules) Except as otherwise provided for in this Rule, matters necessary for operating each committee and the Administration Council as well as for preserving and managing Hanyangdoseong shall be separately determined by the Mayor.
