SEOUL METROPOLITAN GOVERNMENT ENFORCEMENT RULE OF THE ORDINANCE ON EMPLOYMENT SUPPORT FOR UNEMPLOYED YOUTH TO SMALL AND MEDIUM ENTERPRISES

Article 1 (Purpose) The purpose of this Rule is to provide for matters delegated by the Seoul Metropolitan Government Ordinance on Employment Support for Unemployed Youth to Small and Medium Enterprises and matters necessary for the enforcement thereof.

Article 2 (Scope of Enterprises subject to Payment of Employment Grants) (1) The scope of enterprises eligible for employment grants to unemployed youth shall be small enterprises operating the types of industry in the occupational categories of "national key strategic industries" provided by Article 15 of the Act on the Development of Workplace Skills of Workers based on “Korean Standards Industrial Classification” notified by the Commissioner of Statistics Korea.
(2) Enterprises which receive grants from the Seoul Metropolitan Government or other agencies for the purpose of creation of jobs among the small enterprises under paragraph (1) shall be excluded from those subject to payment.

Article 3 (Application of Employment Grants) (1) A subject to payment of employment grants under Article 6 of the Seoul Metropolitan Government Ordinance on Employment Support for Unemployed Youth to Small and Medium Enterprises (hereinafter referred to as “Ordinance”) shall submit an application of Attached Form for payment of employment grants within three months after employment: Provided, That a person to whom six month has not elapsed after retired from the enterprise which he/she has worked for, and whose working period is not more than one month from the date on which he/she is first on his/her duty may not apply therefor.
(2) The following documents shall be attached to an application for payment of employment grants of paragraph (1):
1. An employment contract;
2. A certificate of employment;
3. Relevant documents confirming the fact that his/her salary has been transferred.
(3) The Mayor shall inform a subject of whether to be selected as a subject to payment if he/she receives an application for payment of employment grants.
(4) A person selected as a subject to payment of employment grants shall apply for payment of employment grants with attachment of documents of paragraph (2) 3 before the date decided by the Mayor every month.

Article 4 (Payment of Employment Grants) (1) The Mayor shall pay the grants to a person selected as a subject to payment of employment grants every month.
(2) The Mayor shall identify the fact of salary transfer and whether to have the employment insurance in advance every month to pay the employment grants.
(3) The beginning date of payment of employment grants shall be based on the date on which his/her work actually begins.

Article 5 (Operation of Deliberative Committee on Employment Support) (1) The deliberative committee on employment support of Article 9 (3) of the Ordinance (hereinafter referred to as “deliberative committee”) shall be composed of 10 members or less.
(2) Members shall be appointed or entrusted from those among the following persons by the Mayor, and the chairperson shall be the director general for jobs: <Amended by Rule No. 3873, Sep. 28, 2012; Rule No. 3404, Dec. 30, 2014>
1. The director general for jobs;
2. The department head for job policies;
3. The department head for support on business start-up;
4. The department head for small commercial and industrial business persons;
5. Members of the Seoul Metropolitan Council;
6. Persons having abundant knowledge and experience related to the promotion of small and medium enterprises and dissolution of unemployment of youth.
(3) The chairperson shall administer all business affairs of the deliberative committee, and may call a meeting.
(4) The deputy director in charge of job support shall be assigned to as an executive secretary for processing affairs of the committee.
(5) The term of a member, who is an official, shall be the period in which he/she is in his/her office for the position, and the term of other members shall be two years from the date of entrustment but they may be reelected consecutively only once in the range of two years.
(6) The deliberative committee may be called when the chairperson deems necessary, and a majority of the members of the committee shall constitute a quorum and any decision thereof shall require the concurring vote of a majority of those present.
(7) Allowances and travel expenses may be paid to the members present in the deliberative committee within the budget: Provided, That the same shall not apply if a member who is an public official attends therein in relation with affairs under his/her jurisdiction.
(8) Preparation and disclosure of minutes shall be determined as prescribed by the Seoul Metropolitan Government Framework Ordinance on Participation of Citizens.
(9) Matters necessary for operation of the deliberative committee except matters provided by paragraphs (1) through (5) shall be determined by the chairperson in decision of the deliberative committee.

Article 6 (Exclusion and Avoidance, etc. of Members) (1) Where a member of the deliberative committee falls under any of the followings, he/she shall be excluded from the deliberation of applicable agenda:
1. Where a member is deemed to directly or indirectly have relation concerning the applicable deliberative agenda;
2. Where a member has been or is in special relation such as services or role of consultation concerning the applicable deliberative agenda.
(2) Where a member falls under any of the subparagraphs of paragraph (1), he/she shall apply for avoidance on deliberation or consultation of applicable agenda, but if he/she does not avoid or conduct unfair acts, the Mayor may dismiss the member before the his/her term of office terminates.
(3) Where a reason of exclusion falling under any of the subparagraphs of paragraph (1) occurs, the chairperson shall determine whether to exclude the relevant member in his/her authority or request of avoidance by any other member.

Article 7 (Prohibition of Leakage of Confidentiality) Any person attended a meeting of the deliberative committee shall not leak confidentiality which he/she officially obtains.

Article 8 (Support concerning Establishment of Business) (1) The Mayor may support matters concerning the management support such as education, consulting, territorial cultivation, and marketing, and funds and facilities where a person subject to payment of employment support under Article 10 of the Ordinance intends to establish business.
(2) Detailed matters concerning support of paragraph (1) shall be separately determined by the Mayor.
