SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON ENCOURAGEMENT AND SUPPORT OF BLOOD DONATION

Article 1 (Purpose) The purpose of this Ordinance is to provide for matters necessary to organize a council for facilitating blood donation under Article 4-4 of the Blood Management Act and Article 2 (2) of the Enforcement Decree of that Act and to encourage blood donation activities with a view to promoting blood donation among citizens to protect the life and health of citizens. <Amended by Ordinance No. 7349, Sep. 26, 2019>

Article 2 (Definitions) The terms used in this Ordinance are defined as follows: <Amended by Ordinance No. 5815, Jan. 2, 2015; Ordinance No. 6386, Jan. 5, 2017; Ordinance No. 7349, Sep. 26, 2019>
1. The term "blood donation" means that a healthy person provides his or her blood to blood centers free of charge for patients in need of blood transfusion so that such patients receive blood transfusion;
2. The term "activity to encourage blood donation" means any activity that is carried out to encourage healthy citizens to donate their blood in accordance with Article 4 (1) of the Blood Management Act and Article 2 (2) of the Enforcement Decree of the same Act;
3. The term "encouragement of and support for blood donation" means any activity that is performed to ensure stable blood supply by engendering in citizens a spirit of donating blood and promoting blood donation among them through activities to encourage blood donation;
4. The term "volunteer services to encourage blood donation" means any non-remunerated activities to encourage blood donation that are carried out by any individual or organization by providing their time and effort on their own initiative to promote blood donation.

Article 3 (Responsibilities of Mayor of the Seoul Metropolitan Government) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall develop and implement policies necessary to help citizens actively participate in blood donation.
(2) The Mayor shall endeavor to engender in citizens a spirit of donating blood and encourage citizens to donate their blood by actively cooperating in activities to encourage blood donation that are carried out by the Korean National Red Cross under the Organization of the Korean National Red Cross Act and the blood center under Article 6 of the Blood Management Act. <Amended by Ordinance No. 5815, Jan. 2, 2015>

Article 4 (Establishment of Business Plan to Encourage and Support Blood Donation) (1) In order to promote blood donation among citizens, the Mayor shall establish an annual business plan to encourage and support blood donation (hereinafter referred to as "business plan"), with an annual implementation plan therefor, according to an annual plan for encouraging blood donation established by the Minister of Health and Welfare. <Amended by Ordinance No. 5815, Jan. 2, 2015>
(2) A business plan under paragraph (1) shall include the following:
1. Basic direction-setting for projects to encourage and support blood donation;
2. Matters relating to education, publicity and counseling on blood donation;
3. Matters relating to the raising and management of financial resources involved in implementing projects to encourage and support blood donation;
4. Other necessary matters regarding projects to encourage and support blood donation.

Article 5 (Establishment and Management of Blood Donation Centers) The Mayor may provide financial and administrative support to the President of the Korean National Red Cross if the latter intends to establish blood donation centers in the following places: <Amended by Ordinance No. 5815, Jan. 2, 2015>
1. The Seoul Metropolitan Government Office Building and its affiliated public health centers, and other public places such as libraries;
2. Business places under the jurisdiction of the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government");
3. Places managed and operated by the City-invested institutions;
4. Other places as are deemed suitable to establish blood donation centers.

Article 6 (Publicity for, and Provision of Information on, Blood Donation) In order to encourage and support blood donation, the Mayor shall include, in an annual business plan developed under Article 4, the publicity of projects related to blood donation and the provision of information to citizens by using the following media:
1. Electric signs and other outdoor advertising media managed by the Seoul Government;
2. Electric signs at bus stops, subway stations, etc.;
3. Publications by the Seoul Government;
4. Other media to facilitate the promotion of blood donation.

Article 7 (Designation and Operation of Blood Donor's Month) The Mayor may designate and operate a specific month of every year as blood donor's month to encourage public officials or citizens to donate their blood.

Article 8 (Organization of Council for Facilitating Blood Donation) (1) The Mayor may organize the Seoul Metropolitan Government’s council for facilitating blood donation (hereinafter referred to as the "council") in which the residents or organizations of a local community or public institutions participate to promote the facilitation of blood donation and to create a culture of active blood donation under Article 4-4 of the Blood Management Act.
(2) The council shall be comprised of not more than 15 ex officio members and commissioned members, including one chairperson and one vice-chairperson.
(3) The chairperson of the council shall be the Director-General of Citizens’ Health Bureau while the vice-chairperson shall be elected among and by its members.
(4) Ex officio members of the council shall be designated by the Mayor from among persons in charge of affairs related to blood donation, and its commissioned members shall be appointed by the Mayor from among the following persons:
1. Members of the Seoul Metropolitan Council recommended by the Seoul Metropolitan Council;
2. Heads of institutions or organizations such as offices of education, police stations, fire stations, troops, public health and medical institutions, non-governmental organizations, and Red Cross blood centers, or persons related thereto;
3. Citizens with great interest in blood donation, regional public health affairs, and other related issues.
(5) The chairperson may have a team that supports the practical affairs of the council for its efficient operation.

Article 9 (Functions of Council) The council shall consult on the following matters:
1. Securing sufficient blood donation resources mainly for local communities;
2. Recommending and encouraging blood donation systematically and efficiently;
3. Devising measures to manage crises such as a blood inventory shortage;
4. Supporting volunteer services to encourage blood donation;
5. Pursuing a business plan under Article 4;
6. Provision of information on, and public relations activities for, blood donation.

Article 10 (Term of Office of Member) The term of office of each member shall be two years and may be renewed consecutively only once: Provided, That a member who is a public official shall serve for the period during which he or she holds the relevant position, while a member appointed to fill a vacancy shall serve for the remaining term of his or her predecessor.

Article 11 (Duties of Chairperson) (1) The chairperson shall represent the council and exercise general supervision over its affairs.
(2) The vice-chairperson shall assist the chairperson and act on behalf of the chairperson when he or she is unable to perform his or her duties due to any unavoidable reason.

Article 12 (Dismissal of Members) The Mayor may dismiss a commissioned member in any of the following cases:
1. Where the member expresses his or her intention to resign from the council during his or her term of office;
2. Where the member is unsuitable for performing duties as a member due to injury to dignity or is sentenced by the court to imprisonment without labor or heavier punishment;
3. Where it is impracticable for the member to perform his or her duties due to a disease or long-term overseas stay for at least six months;
4. Where the member commits misconduct in connection with his or her duties;
5. Where it is deemed impracticable for the member to perform his or her duties due to any other reason.

Article 13 (Operation of Council) (1) Meetings of the council shall be convened when deemed necessary by the chairperson and upon a request from at least a majority of the members.
(2) A majority of the members of the council shall constitute a quorum and any decision thereof shall require the concurring vote of a majority of those present.
(3) The council shall have one executive secretary who deals with its affairs, and the deputy director of a division in charge of affairs related to blood donation shall be serve as the executive secretary.
(4) Travels expenses, etc. may be paid to the commissioned members who attend council meetings within the budget in accordance with the Seoul Metropolitan Government Ordinance on the Payment of Committee Allowances and Travel Expenses.

Article 14 (Post Management) The Mayor shall analyze and evaluate the performance of each year's projects to encourage blood donation and shall take into consideration the results of such evaluation in developing a business plan for the following year.

Article 15 (Assistance in Volunteer Services to Encourage Blood Donation) (1) Where the Mayor deems it necessary, he or she may reimburse expenses or provide support for volunteer service activities to the organizations that perform volunteer services to encourage blood donation with a view to promoting blood donation among citizens.
(2) Organizations entitled to reimbursement of expenses, methods of and procedures for such reimbursement, etc. under paragraph (1) shall be governed by the Seoul Metropolitan Government Ordinance on the Management of Local Subsidies and the Seoul Metropolitan Government Ordinance on Support of Volunteer Service Activities. <Amended by Ordinance No. 5930, May 14, 2015>
(3) Financial and administrative assistance may be provided to the organizations that promote events to commemorate World Blood Donor Day.
(4) The Mayor may provide such assistance as the reduction of rental fees for public facilities managed by the Seoul Government (Seoul Museum of Art, Seoul Museum of History, Sejong Center for the Performing Arts, etc.).
(5) Persons eligible for assistance, methods of and procedures for assistance, facilities subject to rental fee reduction, rates of such reduction, etc. under paragraph (4) shall be prescribed by rule of the Seoul Government.

Article 16 (Obligation to Maintain Confidentiality) No person who has been or is engaged in any project to encourage blood donation under this Ordinance shall divulge confidential information that he or she learned in the course of performing his or her duties.

Article 17 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Government.
