SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON PROMOTION OF THE PROVISION AND USE OF PUBLIC WIFI

CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to improve citizens' quality of life by prescribing matters necessary for deciding the basic direction of providing public WiFi and promoting the use thereof within the Seoul Metropolitan Government and for formulating and implementing related policies.

Article 2 (Basic Idea) The basic idea of this Ordinance is to realize and continuously develop a future smart city in which human dignity is guaranteed based on the equal right of access to digital data in the course of digital transition in a post-COVID era, in accordance with the Framework Act on Intelligent Informatization and the Framework Act on Broadcasting Communications Development which essentially guarantees all citizens the right of access to information.

Article 3 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "WiFi" means a wireless local area network based on the Institute of Electrical and Electronics Engineers (IEEE) 802.11 standards;
2. The term "public place" means a facility or place owned or managed by the State, a local government, or its affiliated agencies;
3. The term "public living zone" means a space where citizens live their daily lives, which specifically refer to the vicinity of a railway station, river, park, plaza, camping site, recreation center, traditional market, tourist and sports facility, main street, bus stop, etc. among seven land categories, which are roads, parks, historic sites, water sites, sports sites, parking lots, and amusement parks;
4. The term "public WiFi" means a WiFi service openly provided by the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") to all citizens free of charge in a public place, public living zone, or other space deemed necessary by the public WiFi Officer under Article 8;
5. The term "public WiFi facility" means a facility designated by the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") as a facility for the provision and use of public WiFi;
6. The term "information-poor group" means groups of people, such as persons with disabilities and the aged, who have trouble accessing or using information and communications services due to physical, social, and technical limitations, etc.

Article 4 (Responsibilities) (1) The Mayor shall formulate and implement policies to promote the provision and use of public WiFi (hereinafter referred to as "promotion of public WiFi"), taking into consideration the purpose under Article 1 and the basic idea under Article 2.
(2) The Mayor shall endeavor to prevent digital alienation of information-poor groups and to address the information gap between regions and groups through promotion of public WiFi.
(3) The Mayor shall take necessary measures, such as improving convenience in use of public WiFi and its accessibility so that all citizens can enjoy the benefits of public WiFi.
(4) The Mayor shall formulate measures to control security, to protect personal information and the like in the course of promoting public WiFi.
(5) The Mayor shall formulate measures to secure financial resources necessary for implementing policies for the promotion of public WiFi.

CHAPTER II SYSTEM FOR FORMULATING AND IMPLEMENTING POLICIES FOR THE PROMOTION OF PUBLIC WIFI Article 5 (Formulation of Master Plans) (1) The Mayor shall formulate a master plan for promoting the provision and use of public WiFi (hereinafter referred to as "master plan") every three years for the efficient and systematic implementation of policies for the promotion of public WiFi.
(2) A master plan shall include the following matters:
1. Basic objectives of and direction-setting for the promotion of public WiFi;
2. Plans for investment and financing necessary for the promotion of public WiFi;
3. Matters relating to cooperation and coordination with autonomous Gus;
4. Matters relating to the quality control of public WiFi;
5. Matters relating to security and the protection of personal information on public WiFi;
6. Other matters necessary for the promotion of public WiFi.

Article 6 (Formulation of Action Plans) (1) The Mayor shall formulate and implement an action plan for promoting public WiFi (hereinafter referred to as "action plan") every year in accordance with a master plan.
(2) An action plan shall include the following matters:
1. Basic objectives of and direction-setting for the action plan;
2. Matters relating to evaluation of performance, such as the results of implementing an action plan during the preceding year;
3. An annual execution plan to put into practice the master plan;
4. Matters relating to the relevant year's plan for budget operation related to public WiFi;
5. Other matters necessary for promoting public WiFi.

Article 7 (Survey of Current Status) (1) The Mayor may conduct a survey on the current status of facilities, installation plan, demand for use, current status of use, difficulties, etc. in order to formulate policies for the efficient and systematic promotion of public WiFi.
(2) The Mayor shall conduct a census on the following matters every two years in order to inspect the operational status and quality of public WiFi:
1. Whether the information found online as to the locations and availability of public WiFi access corresponds to the actual availability;
2. The status of attachment of public WiFi-related equipment, whether there is any problems with the external appearance of a logo or an emblem, etc.;
3. The public WiFi Service Set Identifier (SSID) and the speed of download and upload;
4. Other matters necessary for promoting public WiFi.
(3) If necessary to conduct a survey on the current status under paragraphs (1) and (2), the Mayor may request each autonomous Gu, institution, and bureau to submit relevant data.

Article 8 (Public WiFi Officer) (1) The Mayor may appoint an Officer who has general supervision and control of affairs related to the promotion of public WiFi of the Seoul Government (hereinafter referred to as "Officer") and may appoint working-level staff.
(2) The Director-General of the Smart City Policy Bureau shall serve as the Officer.
(3) The head of a bureau who intends to implement a project related to public WiFi shall review, among other things, the redundancy, validity, and efficiency of the project with the Officer in advance and coordinate details of the project accordingly.
(4) The Officer and working-level staff shall take charge of the following matters:
1. Overall coordination of, support for, and evaluation of policies for the promotion of public WiFi;
2. Linkage and coordination between public WiFi-related policies and other policies, plans, etc. of an institution;
3. General supervision and control of affairs related to the installation, management, and use of public WiFi;
4. Improved quality control and security of public WiFi services;
5. Other relevant affairs for promoting the provision and use of public WiFi.

Article 9 (Management Guidelines) (1) The Mayor shall prepare management guidelines for the creation and operation of public WiFi to efficiently implement policies for the promotion of public WiFi.
(2) The Mayor shall post the management guidelines under paragraph (1) on the website of the Seoul Government; and shall conduct affairs in accordance with said management guidelines.

Article 10 (Support for Promoting Public WiFi) The Mayor may provide necessary administrative and financial support with respect to the following matters to promote public WiFi:
1. Establishment and management of public WiFi networks and facilities in the Seoul Government, autonomous Gus, or relevant institutions or organizations, etc.;
2. Development and provision of new services using public WiFi networks and facilities in cooperation with affiliated public institutions, enterprises, individuals, etc. under the jurisdiction of the Seoul Government;
3. Other matters the Mayor deems necessary for promoting public WiFi.

CHAPTER III OPERATION AND MANAGEMENT OF PUBLIC WIFI Article 11 (Operation of Integrated Management Center) (1) The Mayor may establish and operate a center for integrated public WiFi management in order to ensure better quality, security, and systematic management of public WiFi.
(2) The integrated management center shall perform the following affairs:
1. The integrated monitoring of public WiFi and the receipt and handling of relevant civil petitions;
2. Provision of information online on available locations that provide public WiFi access and the status thereof;
3. Analysis of the status of the use of public WiFi as well as understanding the current status related thereto;
4. Measures for quality control regarding and improved security of public WiFi;
5. The SSID unification in public WiFi and the management of the certification process;
6. Other affairs necessary for promoting public WiFi.
(3) In order to efficiently manage and operate the center for integrated public WiFi management, the Mayor may entrust a relevant institution, corporation, or organization with some of the duties related to the management and operation of said center.

Article 12 (Quality Control) (1) The Mayor shall endeavor to ensure, among other things, quality control and a high level of quality of public WiFi in a stable manner.
(2) The Officer shall formulate guidelines setting out the quality standards for, measures for improvement of, equipment specifications, etc. for public WiFi.
(3) Other matters necessary for the quality diagnosis and evaluation of public WiFi, procedures for filing an application for quality certification, etc. shall be separately determined by the Mayor.

Article 13 (Security and Protection of Personal Information) The Mayor shall comply with the following matters to improve security and information protection in the course of implementing policies related to public WiFi:
1. When managing personal information, compliance with relevant statutes or regulations such as the Personal Information Protection Act, the Basic Guidelines for National Information Security, and the Seoul Metropolitan Government Rule on the Processing of Information and Communications Security Affairs;
2. Preparation of operating rules regarding safety and security control such as physical, managerial, and technical security measures and compliance with information protection guidelines;
3. Upon divulgence of personal information or occurrence of security accident or upon becoming aware of said event, immediate action and notification thereof to concerned parties and relevant institutions.

Article 14 (Enforcement Rules) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Government.

ADDENDUM <Ordinance No. 7816, Dec. 31, 2020>
This Ordinance shall enter into force on the date of its promulgation.
