SEOUL METROPOLITAN GOVERNMENT ENFORCEMENT RULE OF THE ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF INSTITUTIONS RELATED TO WOMEN

Article 1 (Purpose) The purpose of this Rule is to provide for matters mandated by the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Institutions Related to Women and those necessary for the enforcement thereof.

Article 2 (Scope of Application) This Rule shall apply to the Woman Craft Center, women's ability development institutes, women's development centers, and women's resources development centers: Provided, That with respect to matters pertaining to imposition, collection and return of user fees, this Rule shall also apply to Women's Plaza and SPACE SALLIM. <Amended on Oct. 15, 2020>

Article 3 (Relationship to Other Rules of the Seoul Metropolitan Government) This Rule shall apply to the establishment and operation of institutions related to women of the Seoul Metropolitan Government (hereinafter referred to as "institutions related to women") except as otherwise provided in other Rules of the Seoul Metropolitan Government.

Article 4 (Composition of Organization) Any institution related to women shall have the head of an institution related to women (hereinafter referred to as "head of an institution") and the following full-time employees: Provided, That matters regarding the head of the Seoul Woman Craft Center and its employees shall be separately provided for:
1. A professional occupation consultant related to employment or business startup;
2. A person responsible for education and training;
3. A person responsible for general affairs and accounting;
4. Other employees necessary for the operation of the institution.

Article 5 (Qualifications, Appointment and Dismissal of Heads of Institutions) (1) The head of an institution shall be a person who has at least three-year career experience in the field related to human resource development, support for employment and business startup and social participation of women: Provided, That any person who is serving as the representative of the operating entity of an institution related to women (referring to a corporation or organization that operates an institution related to women upon designation or entrustment by the Seoul Metropolitan Government; hereinafter the same shall apply) or who is engaged in any business for profit shall be disqualified as the head of the institution.
(2) The representative of the operating entity of an institution related to women (hereinafter referred to as "operating entity") shall obtain approval of the Mayor for the appointment or dismissal of a head of the institution.
(3) The retirement age of the head of an institution shall be 65: Provided, That the Mayor may require the dismissal of the head of an institution where any ground for disqualification arises, such as serving as the representative of the operating entity or engaging in any business for profit.

Article 6 (Qualifications, Appointment and Dismissal of Full-Time Employees) (1) The qualifications for full-time employees other than the head of an institution shall be as follows:
1. A professional occupation consultant related to employment or business startup:
(a) A holder of a certificate of occupation consultant class 1 or class 2 pursuant to the National Technical Qualifications Act;
(b) A professional occupation consultant who has at least one-year career experience in employment or business start-up consulting;
2. Employees responsible for education and training, general affairs and accounting or other necessary operations:
(a) A holder of a certificate of a lifelong education instructor or a college degree in the relevant department;
(b) A holder of a certificate of an occupation consultant or a certificate of vocational training teacher;
(c) A person who has completed education courses of at least three months regarding the relevant duties such as occupation consulting, vocational education and training.
(2) The representative of the operating entity or the head of an institution shall submit to the Mayor a report on the appointment or dismissal of an employee in the attached Form, not later than 15 days after the date of the appointment or dismissal.

Article 7 (Operating Committee) (1) Members of the operating committee pursuant to Article 24 (4) of the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Institutions Related to Women (hereinafter referred to as the "Ordinance") shall be commissioned by the chairperson from among the following persons:
1. A representative of women of the relevant district;
2. A company representative;
3. A public official of a local government;
4. A person of any other related organization;
5. An expert in accounting.
(2) Each member shall hold office for a term of two years and may be appointed consecutively until the expiry of the entrusted period.
(3) The chairperson shall convene a meeting of the operating committee at least once every six months.
(4) Meetings of the operating committee shall be convened with the attendance of a majority of all incumbent members and resolutions shall be adopted by the concurring vote of a majority of those present.
(5) The operating committee shall deliberate on each of the following matters and the operating entity shall fully reflect the outcomes of such deliberation in a business plan:
1. Formulation of an annual business plan;
2. Measures for developing the ability of women and promoting social participation by women;
3. Affairs regarding the appointment or dismissal of employees;
4. A plan for the use of surplus profits of the fiscal year;
5. Affairs regarding the management of credit related to security money for lease;
6. Other matters deemed necessary by the chairperson.

Article 8 (Qualifications and Fees for Training Instructors) (1) The qualification requirements for a vocational training instructor (hereinafter referred to as "training instructor") shall be as follows:
1. A person who majored in the relevant field in a university or an educational institution equivalent to a university;
2. A person who has obtained a certificate of vocational training teacher class 3 or higher;
3. A person who has engaged in the relevant field for at least one year.
(2) The head of an institution shall determine fees for instructors by obtaining approval of the operating committee.
(3) The representative of an operating entity or the head of an institution shall report to the Mayor matters concerning the determined fees for instructors when reporting the settlement of accounts of subsidies.

Article 9 (Priority to Users) (1) Any person pursuant to Article 17 (2) 1 through 7 of the Ordinance may take a vocational training course operated by a women's development center in preference to other applicants; in such cases, the quota shall be up to 20 percent of the fixed number of students for the relevant course.
(2) Where any person pursuant to Article 17 (2) 1 through 7 of the Ordinance attends a training course at a women's development center at least 60 percent of the number of days of the relevant training course, the cost of materials for practical training shall be subsidized by up to 20,000 won per month and the meal costs shall be subsidized by up to 30,000 won per month in consideration of the number of days of attendance.

Article 10 (Imposition and Collection of User Fees) The user fees by institution under Article 18 of the Ordinance shall be as specified in attached Tables 1 through 3 and attached Table 1-2. <Amended on Oct. 15, 2020>

Article 11 (Refund of User Fees) (1) Where a user fails to use any institution for any reason not attributable to such user pursuant to Article 21 of the Ordinance, such user shall be provided a refund of user fees for the period of non-use of the relevant institution.
(2) Where a person who has obtained permission to use an institution requests the revocation of an application for use before the commencement date of use, the user fees use shall be refunded according to the following criteria:
1. Where the person requests revocation on the commencement date of use: No refund;
2. Where the person requests revocation within 20 days before the commencement date of use: 50 percent refund of the user fee;
3. Where the person requests revocation within 30 days before the commencement date of use: 70 percent refund of the user fee;
4. Where the person requests revocation not later than 31 days before the commencement date of use: 100 percent refund of the user fee.
(3) The Criteria for the Settlement of Consumer Disputes publicly notified by the Fair Trade Commission shall apply to the refund of user fees, except as provided in this Rule.

Article 12 (Measures for Other Revenues) (1) The head of an institution shall incorporate revenues generated from the operations of the relevant institution into a revenue account of the relevant year without fail.
(2) The head of a women's ability development institute and the head of a women's development center shall carry forward the net income generated in the preceding fiscal year to the relevant year.
(3) The head of a woman resources development center shall use the net income generated in the preceding fiscal year to provide disbursements for proposed projects.

Article 13 (Keeping of Books and Documents) The head of an institution shall record and administer each of the following books and documents and retain such books and documents for five years:
1. A record of the history of the institution;
2. A business plan and the results of promoting the business according to the business plan;
3. A list of names of applicants for training courses and other users;
4. A statement of receipt of expenses from users;
5. Personnel record cards of the head and employees of the institution (including curriculum vitae and photographs);
6. Books related to accounting (a book of revenue, a book of expenditure, expense reports and a file of receipts);
7. The articles of association, the regulations and related written resolutions of a corporation, etc. to which the institution belongs;
8. A file of written reports and a file of documents of the related administrative agency;
9. A book of administration of goods;
10. Other documents necessary to operate an institution related to women.

Article 14 (Relocation of Institutions) The Mayor may decide to relocate an institution in consideration of changes in local conditions, resident buildings, etc. at the request of the operating entity of the institution or ex officio.

Article 15 (Operation Regulations) With respect to the facilities of women's resources development centers, the operation of child-care rooms of women's development centers, the regulations on operating venture incubation centers, and other matters related to institutions related to women, the operational regulations of the relevant institution shall apply.
