SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON CREATION OF SOUND DRINKING CULTURE

Article 1 (Purpose) The purpose of this Ordinance is to contribute to residents being able to live healthier lives by creating a sound drinking culture through education, publicity, etc., concerning how excessive drinking impairs health, pursuant to Article 8 of the National Health Promotion Act.

Article 2 (Definitions) The terms used in this Decree are defined as follows:
1. The term "sound drinking culture" means Seoul Metropolitan citizens' (hereinafter referred to as "citizens") life style of protecting themselves from alcohol-related harm by practicing responsible drinking habits daily;
2. The term "moderate drinking" means drinking to the extent not to cause mental, physical and social damage to drinkers themselves and other persons;
3. The term "no drinking" means not drinking alcohol at all;
4. The term "public institution" means an institution, etc. invested or funded by the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government"); an agency outsourced under the Seoul Metropolitan Government Ordinance on Enstrustment of Administrative Affairs to the Private Sector; or a corporation, organization or institution subsidized by the Seoul Government pursuant to the Seoul Metropolitan Government Ordinance on the Management of Local Subsidies;
5. The term "no-drinking area" means an area designated and controlled by the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor"), in which drinking alcohol is restricted to prevent wrongful conducts caused by drinking, such as any disturbance or disorder;
6. The term "alcoholic beverage seller" means a person holding an alcoholic beverage sales license under the Liquor Tax Act;
7. The term "intoxicated person" means a person in need of help due to his/her impaired judgment or physical mobility, who is likely to cause danger to his/her or other person's life, body or property, or other citizen's safety.

Article 3 (Responsibilities of Mayor) (1) The Mayor shall formulate and implement various policies for creating an environment for a sound drinking culture, including education and publicity concerning how excessive drinking impairs health and the danger of driving while intoxicated.
(2) The Mayor shall proactively support campaigns, etc. for moderate drinking which the Seoul Government and public institutions promote pursuant to Article 8 of the National Health Promotion Act.

Article 4 (Designation of No-Drinking Areas) (1) The Mayor may designate all or part of any of the following places as a no-drinking area in order to create a comfortable and safe social environment by preventing alcohol-related harm:
1. An urban park (referring to a park under the Act on Urban Parks and Greenbelts) and a children's playground;
2. Other places the Mayor deems necessary.
(2) When designating a no-drinking area, the Mayor shall install or attach a signboard informing such designation at the entrance(s) of such no-drinking area.
(3) When intending to designate a no-drinking area pursuant to paragraph (1), the Mayor may gather consensus from the relevant organizations and local residents.
(4) When designating a no-drinking area pursuant to paragraph (1), the Mayor shall publicly announce the purpose of such designation, and the designated place and its scope in the Official Gazette of the Seoul Metropolitan Government.
(5) The Mayor shall discourage people from drinking alcohol in a no-drinking area designated pursuant to paragraph (1).

Article 5 (Support for Autonomous Gus) The Mayor may monitor activities for creating a sound drinking culture in autonomous Gus; and may support such activities or reflect them in policies of the Seoul Government.

Article 6 (Education and Publicity) (1) The Mayor may educate citizens on moderate drinking and no drinking.
(2) The Mayor may publicize activities for creating an environment for a sound drinking culture.
(3) The Mayor may entrust the projects referred to in paragraphs (1) and (2) pursuant to the Seoul Metropolitan Seoul Government Ordinance on Enstrustment of Administrative Affairs to the Private Sector.

Article 7 (Restriction on Advertising and Sponsoring Alcoholic Beverages) (1) The Mayor may restrict the provision of alcoholic beverages at the events targeting juveniles within his/her jurisdictional areas; or may direct alcoholic beverage companies to refrain from sponsoring such events in return for their alcoholic beverage advertising, etc.
(2) The Mayor may encourage to refrain from advertising alcoholic beverages to recommend or induce excessive drinking at the events held by the Seoul Government or public institutions.

Article 8 (Citizens' Participation and Rights of Alcoholic Beverage Sellers) (1) Citizens may present their opinions and voluntarily participate in the course of implementing projects for creating a sound drinking culture; and the Mayor shall endeavor to increase citizens' participation by holding public hearings, seminars, etc.
(2) Alcoholic beverage sellers shall have a right to refuse to sell alcoholic beverages to intoxicated persons.

Article 9 (Evaluation and Support for Research) (1) Each year, the Mayor shall evaluate projects for creating a sound drinking culture and reflect the findings of such evaluation.
(2) The Mayor may support the corporations or organizations which conduct research and surveys on moderate drinking and no drinking.

Article 10 (Imposition and Collection of Administrative Fines) (1) The Mayor may impose and collect administrative fines not exceeding one hundred thousand won from persons causing other persons to feel uncomfortable by creating loud noise or odor, due to drinking alcoholic beverages in no-drinking areas, pursuant to Articles 49 (1) 3 and 56 (2) and (3) of the Act on Urban Parks, Greenbelts, Etc.
(2) Procedures for imposing and collecting administrative fines under paragraph (1) and raising objections shall be governed by the Act on the Regulation of Violations of Public Order. <Amended on Jan. 7, 2021>

Article 11 (Enforcement Rule) Matters necessary for enforcing this Ordinance shall be prescribed by rule of the Seoul Metropolitan Government.

ADDENDUM <Ordinance No. 6508, May 18, 2017>
This Ordinance shall enter into force six month after the date of its promulgation.
ADDENDUM <Ordinance No. 7849, Jan. 7, 2021>
This Ordinance shall enter into force on the date of its promulgation.
