SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON URBAN ENVIRONMENTAL DESIGN FOR CRIME PREVENTION

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for applying urban environmental design for crime prevention to buildings and urban spaces, so that citizens of the Seoul Metropolitan Government can live in an urban environment safe from crime.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows: <Amended on Dec. 31, 2020>
1. The term "urban environmental design for crime prevention" means creating buildings and urban spaces according to plans, or altering or improving the structures or shapes thereof so as to prevent or reduce crime;
2. The term "standards for urban environmental design for crime prevention" means guidelines presented by the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") by specifying measures for implementing basic directions of urban environmental design for crime prevention;
3. The term "public agency" means a public corporation or authority established by the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") or an institution referred to in Article 2 of the Seoul Metropolitan Government Ordinance on the Operation of Institutions Invested or Funded by the Seoul Metropolitan Government.

Article 3 (Basic Directions) Basic direction-setting for urban environmental design for crime prevention, shall be as follows: <Amended on Jan. 5, 2017>
1. Buildings and urban spaces shall be arranged to make it possible to naturally monitor them by ensuring an open view, and insufficient landscape, lighting, etc., if any, shall be supplemented;
2. Entrances, fences, landscape, lighting, etc. of buildings or urban spaces shall be properly arranged to make it possible to control access thereto;
3. The territoriality of urban spaces shall be reinforced to enable citizens of the Seoul Metropolitan Government (hereinafter referred to as "citizens") to freely use or occupy them;
4. Facilities useful for enhancing exchanges between citizens and strengthening their activities shall be attracted or arranged, and shall be maintained and managed in good repair so as to create a pleasant environment.

Article 4 (Responsibilities of Mayor) (1) The Mayor shall seek efficient measures and implement relevant policies so that a safe urban environment can be created through urban environmental design for crime prevention.
(2) The Mayor shall encourage public agencies, autonomous Gus, enterprises, etc. to comply with the standards for urban environmental design for crime prevention, and to participate in relevant policies. <Amended on Jan. 5, 2017>
(3) The Mayor shall endeavor to increase participation of citizens when formulating major policies relating to urban environmental design for crime prevention. <Newly Inserted on Jan. 5, 2017>

Article 5 (Formulation and Implementation of Plans) (1) To systematically promote the creation of an environment where citizens can live a life safe from crime, the Mayor shall formulate and implement a master plan for urban environmental design for crime prevention for the Seoul Government (hereinafter referred to as "master plan") every five years, that contains the following matters: Provided, That if deemed necessary by the Mayor, he/she may formulate the master plan by including it into either the master construction plan referred to in Article 5 of the Seoul Metropolitan Government Framework Ordinance on Building or in the public design promotion plan referred to in Article 5 of the Seoul Metropolitan Government Ordinance on Public Design Promotion: <Amended on Mar. 24, 2016; Mar. 28, 2019>
1. Objectives and direction-setting for urban environmental design for crime prevention;
2. Strategies to prevent crimes through environmental design;
3. Promotion of urban environmental design for crime prevention;
4. Schemes to raise funding for performing relevant projects;
5. Establishment of a cooperation system between local communities to efficiently perform relevant projects;
6. Evaluation of projects for urban environmental design for crime prevention;
7. Any other matters necessary for promoting urban environmental design for crime prevention.
(2) Where the Mayor formulates a master plan, he/she shall first consult with relevant agencies and reflect the results thereof in the plan.
(3) To efficiently formulate and implement the master plan, the Mayor may conduct a survey on the current status, status, etc. of urban environmental design for crime prevention.
(4) The Mayor shall seek for diverse opinions in writing, via internet, or through public hearings when formulating the master plan. <Newly Inserted on Jan. 5, 2017>

Article 6 (Standards for Urban Environmental Design for Crime Prevention) (1) The Mayor may determine the standards for urban environmental design for crime prevention as guidelines.
(2) The standards referred to in paragraph (1) shall be publicly announced in the Seoul Government newspaper and on the Seoul Government's web-site.

Article 7 (Scope of Application) (1) The Mayor shall endeavor to apply the standards for urban environmental design for crime prevention to any of the following projects: <Amended on Jan. 5, 2017>
1. A construction project or a space creation project performed by the Seoul Government or a public agency;
2. A building or space, the management of which is entrusted by the Seoul Government;
3. A building or space fully or partially financed by the Seoul Government;
4. Other new town projects, downtown redevelopment projects, residential environmental improvement projects, projects for the installation of public facilities and environment improvement, etc. carried out by the Seoul Government or public agencies.
(2) The Mayor shall endeavor to apply the standards referred to in Article 6 to the projects subject to deliberation by the Building Committee referred to in Article 5 of the Seoul Metropolitan Government Ordinance on Building and the Urban Planning Committee referred to in Article 56 of the Seoul Metropolitan Government Ordinance on Urban Planning.

Article 8 (Urban Environmental Design Projects for Crime Prevention) In order to create an urban environment safe from crime, the Mayor may promote any of the following urban environmental design projects for crime prevention: <Amended on Oct. 5, 2020>
1. A pilot project for urban environmental design for crime prevention;
2. A project to establish an urban environmental design certification system for crime prevention;
3. An urban environmental design project for crime-prone areas;
4. A research project for urban environmental design for crime prevention;
5. Any other projects deemed necessary by the Mayor.

Article 9 (Composition and Operation of Urban Environmental Design Committee for Crime Prevention) (1) The Mayor may establish an Urban Environmental Design Committee for Crime Prevention for the Seoul Government (hereinafter referred to as the "Committee") in order to deliberate, or advise, on the following matters for promoting urban environmental design for crime prevention:
1. Matters on the formulation and amendment of a master plan referred to in Article 5;
2. Matters on the establishment, amendment, and application of the standards for urban environmental design for crime prevention referred to in Article 6;
3. Matters on the improvement of systems to promote urban environmental design for crime prevention.
(2) Notwithstanding paragraph (1), the Mayor may have either the Building Committee referred to in Article 5 of the Seoul Metropolitan Government Ordinance on Building or the Public Design Promotion Committee of the Seoul Metropolitan Government referred to in Article 8 of the Seoul Metropolitan Government Ordinance on Public Design Promotion, perform the functions of the Committee on its behalf, if deemed necessary by the Mayor. In such cases, a crime prevention-related expert shall participate in the Building Committee or the Public Design Promotion Committee. <Amended on Mar. 24, 2016; Mar. 28, 2019>
(3) The committees referred to in paragraph (2) shall perform functions classified as follows: <Amended on Mar. 24, 2016; Mar. 28, 2019>
1. The Building Committee: Matters specified in each subparagraph of Article 9 (1) in relation to buildings;
2. The Public Design Promotion Committee: Matters specified in each subparagraph of Article 9 (1) in relation to urban spaces.

Article 10 (Establishment of Cooperation System) To promote urban environmental design for crime prevention, the Mayor shall establish a cooperative system jointly with the Seoul Metropolitan Office of Education, Seoul district public prosecutor's office, etc.

Article 11 (Education and Publicity) (1) The Mayor shall endeavor to conduct education on the promotion of urban environmental design for crime prevention, for public agencies, or for institutions, organizations, corporations, etc. subsidized by the Seoul Government.
(2) To activate urban environmental design for crime prevention, the Mayor may publicize exemplary cases, etc. in the Seoul Government newspaper, the Seoul Government's web-site, etc.
