SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR FINANCIAL WELFARE CONSULTING

Article 1 (Purpose) The purpose of this Ordinance is to provide information about various relief programs tailored to meet the conditions of the financially marginalized segment of the population who suffer from increasing financial hardship, such as household debt; and to provide support for substantial self-sufficiency, by providing for the necessary matters.



Article 2 (Responsibility of Mayor) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall provide information and support so that the financially marginalized segment of the population and debtors who owe insurmountable debts (hereinafter referred to as "debtor") among the citizens of the Seoul Metropolitan Government may have an economically sound household livelihood.



Article 3 (Details of Support) The Mayor may conduct the following programs for debtors' self-sufficiency:
1. Support for financial consulting to individual debtors;
2. Guidance and education on a debt mediation system and the introduction of relevant agencies to debtors;
3. Guidance and education on a welfare benefits system and the introduction of relevant agencies to debtors;
4. Other programs necessary to assist the self-sufficiency of debtors.



Article 4 (Debtor Support Plan) (1) Each year, the Mayor shall formulate and implement a debtor support plan (hereinafter referred to as "support plan") in order to provide support for the substantial self-sufficiency of debtors.
(2) The details of each support plan shall be prescribed by Rule of the Seoul Metropolitan Government.
(3) The Mayor shall report the achievements and outcomes of implementing a support plan in the previous year, to the competent standing committee of the Seoul Metropolitan Council by the end of February of the following year.



Article 5 (Seoul Financial Welfare Consulting Center) (1) The Mayor may establish and operate a Seoul Financial Welfare Consulting Center (hereinafter referred to as the "Center") in order to aid debtors efficiently and systematically.
(2) The Mayor may have the Center established under paragraph (1) affiliated to the Seoul Metropolitan Welfare Foundation, being an incorporated foundation.



Article 6 (Functions and Operation of Center) (1) The Center shall perform the following functions:
1. Matters concerning financial consulting for debtors;
2. Substantial support services, such as debt mediation for debtors;
3. Comprehensively linked services, such as finance, financial affairs, and welfare for debtors;
4. Establishment of a cooperation system with the Seoul Central District Court;
5. Education related to finance and welfare.
(2) The Mayor may subsidize funds necessary for establishing and operating the Center, within the budget.



Article 7 (Establishment, etc. of Support System) The Mayor shall prepare schemes for connection among financial institutions for under-privileged people; the credit recovery agency; employment, startup and welfare centers in the Seoul Metropolitan Government; and job centers and civil service centers operated by the Seoul Metropolitan Government, to efficiently operate the Center.



Article 8 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance shall be prescribed by Rule of the Seoul Metropolitan Government.
