SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROMOTION AND SUPPORT OF FAIR TOURISM

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROMOTION AND SUPPORT OF FAIR TOURISM

Article 1 (Purpose) The purpose of this Ordinance shall be to establish a foundation for fair tourism and contribute to the development of sustainable tourism in Seoul by prescribing matters necessary to promote and support fair tourism.

Article 2 (Definitions) The term "fair tourism" in this Ordinance refers to tourism in which the tourism is developed and tourism activities are committed and tourism transactions are fairly rendered based on the equal relationship among tourists, local residents, tourist business operators, etc. and tangible and intangible benefits derived therefrom are distributed and returned and the lives, culture, environment, etc. of residents in tourist destinations are preserved.

Article 3 (Duties) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall formulate and enforce a policy to promote and support fair tourism.
(2) The Mayor shall endeavor to promote civil participation for revitalization of fair tourism.

Article 4 (Relation with Other Ordinances) This Ordinance shall be applied, before other ordinances, to matters related to promoting and supporting fair tourism.

Article 5 (Plan for Promoting and Supporting Fair Tourism) (1) The Mayor shall formulate a plan for promoting and supporting of fair tourism every 5 years to promote and support fair tourism.
(2) The plan for promoting and supporting fair tourism shall include the following:
1. Policy directions for promoting and supporting fair tourism;
2. Establishment of a foundation for fair tourism and expansion of infrastructure;
3. Development and operation of the fair tourism program;
4. Training and education of experts in fair tourism;
5. Plan for revitalization of fair tourism in which residents participate;
6. Plan for the establishment of a private-public cooperation system and revitalization of domestic and foreign network;
7. Plan to improve awareness of interested parties in fair tourism;
8. Plan for monitoring and evaluation of fair tourism;
9. Plan for financing to promote and support fair tourism; or
10. Other matters necessary to promote and support fair tourism.

Article 6 (Establishment and Functions of the Committee) The Mayor may establish the Seoul Metropolitan City Fair Tourism Committee (hereinafter referred to as the "Committee"), which shall exist for 5 years, to consult or deliberate the following matters:
1. Formulation and enforcement of plans under Article 5 above;
2. Improvement of a system for the revitalization of fair tourism and the presentation of policy alternatives therefor; or
3. Other matters necessary to promote and support fair tourism.

Article 7 (Organization of the Committee) (1) The Committee shall comprise about 10 members, including 1 chairperson and 1 vice-chairperson; Provided, That members of specific gender shall not exceed 6/10 of the number of commissioned members.
(2) The chairperson and the vice-chairperson of the Committee shall be elected by mutual vote among members.
(3) Members of the Committee are classified into ex-officio members and commissioned members. A head of the tourism division in Seoul Metropolitan City (hereinafter referred to as the "City") shall become an ex-officio member and the Mayor shall appoint a commissioned member among the following:
1. Members of the Seoul Metropolitan Council;
2. Experts in tourism, society, architecture, urban planning, environment, law, etc.;
3. Representatives of corporations and organizations related to fair tourism;
4. Citizens with interest and experience in fair tourism; or
5. Other persons with sufficient knowledge and experience in fair tourism.
(4) The Committee shall have 1 secretary to handle its affairs and a head of the tourism department shall become the secretary.

Article 8 (Term of Office of the Committee) (1) A term of office of ex-officio members shall be a period during which they hold their post.
(2) A term of office of commissioned members shall be 2 years and such members may serve consecutive terms only once.

Article 9 (Duties of the Chairperson) (1) A chairperson shall represent the Committee and supervise the work thereof.
(2) Where a chairperson cannot perform his/her duties due to unavoidable reasons, a vice-chairperson shall become an acting chairperson.

Article 10 (Meeting, Operation, etc. of the Committee) (1) Committee meetings are convened by a chairperson who shall become a chairperson.
(2) The Committee shall convene a meeting in the following cases:
1. When one-third or more of registered members request to convene a meeting; or
2. Where the chairperson recognizes as necessary.
(3) A meeting of the Committee shall be started when a majority of registered members are present and resolved by vote of a majority of the members present.
(4) A member of the Committee is excluded from deliberation and resolution in the following cases:
1. Where the member has direct interest in the relevant deliberation and resolution; or
2. Where the member worked or is working as an officer or an employee of a business related to the deliberation and resolution in the last 3 years.
(5) Where it is difficult to expect that a member deliberates and resolves the relevant matter in addition to any of the subparagraphs under paragraph (4) above, the Committee may resolve to exclude the member from the deliberation and resolution.
(6) Where a member falls under any of the subparagraphs of paragraph (4) above, the member shall, for himself/herself, abdicate the deliberation or resolution of the relevant matter.
(7) Allowances and traveling expenses may be provided for an ex-officio member participating in a meeting in accordance with the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Various Committees.
(8) Other matters concerning the Committee operation, among others, shall be governed by the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Various Committees.

Article 11 (Support Programs) The Mayor may implement the following programs for the promoting and supporting fair tourism:
1. Programs to establish a foundation for fair tourism and expand infrastructure;
2. Programs to train and educate experts in fair tourism;
3. Programs to develop contents and programs for fair tourism;
4. Programs to exchange and cooperate at home and abroad for fair tourism;
5. Programs to improve awareness and promote and market fair tourism; or
6. Other programs that the Mayor recognizes as necessary to promote and support fair tourism.

Article 12 (Fair Tourism Support Center) (1) The Mayor may establish the fair tourism support center (hereinafter referred to as the "Center") to efficiently promote programs under Article 11.
(2) Matters necessary for the establishment, operation, etc. of the Center shall be prescribed by rules.

Article 13 (Financial Support) (1) The Mayor may support the required expenses within the scope of their budget for corporations, organizations, etc. performing programs under Article 11.
(2) Matters necessary for the provision of expenses under paragraph (1) above, such as method, procedures, etc., shall be governed by the Seoul Metropolitan Government Ordinance on the Management of Local Subsidies.

Article 14 (Building of Cooperation System) Where it is required to promote and support fair tourism, the Mayor may build a cooperation system with the central government, districts, other local governments, public institutions, related corporations, organizations, etc.

Article 15 (Consignment or Deputization of Tasks) The Mayor may consign or deputize all or some of the tasks under this Ordinance to related corporations, organizations, etc. with expertise under Article 17(1) of the Seoul Metropolitan Government Ordinance on the Promotion of Tourism. In such cases, the Mayor may consign or deputize to tourism promotion agencies on a preferential basis.
