SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE RESPECTFUL TREATMENT OF AND SUPPORT FOR DONORS

Article 1 (Purpose) The purpose of this Ordinance shall be to admire the intention of donors and invigorate a healthy donation culture by prescribing matters necessary to respectfully treat and support donors, where they make donations for the development of Seoul Metropolitan City. <Amended on Oct. 8, 2015>

Article 1-2 (Duties of the Mayor) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall endeavor to create and support a voluntary donation culture of citizens and businesses.

Article 2 (Scope) This Ordinance shall apply to a person who voluntarily contributes donations or goods (hereinafter referred to as the "Donations") to the Mayor with their designated purpose and use under Article 5(2)1 of the Act on the Collection and Use of Donations (hereinafter referred to as the "Act") and subparagraphs 2 to 10 of Article 3 of the Act. <Amended on Dec. 30, 2021>

Article 3 (Definitions) The term "respectful treatment" means to provide donors with the following benefits: citations or acknowledgment and appreciation plaques in the name of the Mayor; conferring of buildings and spaces, etc.

Article 4 (Management of List of Donors, etc.) (1) The Mayor may issue a person who donates with a certificate verifying such facts (hereinafter referred to as the "Donation Certificate") under Article 2 above. <Amended on Dec. 30, 2021>
(2) A division in charge of overseeing donations may prepare a list of donors for preservation and inspection on a permanent basis.

Article 5 (Respectful Treatment of Donors) The Mayor may respectfully treat persons who are issued with the Donation Certificate as follows: <Amended on Oct. 8, 2015; Dec. 31, 2019; Dec. 30, 2021>
1. Establish the "Hall of Fame" in a specific place and attach a list of donors thereto;
2. Invite them to various events hosted by Seoul Metropolitan City (hereinafter referred to as the "City");
3. Confer citations and letters of appreciation and present an appreciation plaque by the Mayor;
4. Publicly announce a list of donors in various printed media, such as the City's gazette, Internet media, website, etc.;
5. Provide convenience of use of cultural, artistic, and welfare facilities administered and operated by the City; and
6. Other matters that the donation examination committee deliberates and resolves as necessary.

Article 5-2 (Invigoration of a Donation Culture) The Mayor may implement the following projects to invigorate a donation culture:
1. Promotion to invigorate a donation culture;
2. Development of a communication and cooperation system with local communities, related institutions, etc.; and
3. Other projects necessary to invigorate a donation culture.

Article 6 (Roles and Functions of the Donation Examination Committee) (1) The donation examination committee (hereinafter referred to as the "Committee") is established to examine the receipt of money and other articles voluntarily donated to the City under Article 5(2) of the Act, Article 5(6), etc. <Amended on Oct. 8, 2015; Dec. 30, 2021>
(2) The Committee shall deliberate matters concerning respectful treatment, such as the Hall of Fame as well as installation place, scale, type, and period. <Amended on Dec. 30, 2021>
(3) Where a person who is issued with the Donation Certificate intends to use cultural, artistic, and welfare facilities administered and operated by the City, the convenience may be provided under the rules stipulated by the Mayor.

Article 7 (Organization and Operation of the Committee) (1) The Committee shall comprise about 15 members including 1 chairperson and 1 vice-chairperson under Article 5(3) of the Act. <Amended on Dec. 30, 2021>
(2) The Mayor shall be the chairperson and Vice-Mayor I for Administrative Affairs shall be the vice-chairperson.
(3) The Mayor shall appoint or commission members as follows: 4 or less members from public officials; 2 or less members from the Seoul Metropolitan Council; and other members from those with sufficient knowledge and experience. <Amended on Dec. 30, 2021>
(4) A term of office of member other than public officials shall be 2 years and such member may serve consecutive terms only once.
(5) The Committee shall have 1 secretary to handle its affairs and the secretary shall become the head of the division in charge of examining donations. <Amended on Jan. 5, 2017>

Article 8 (Duties of the Chairperson, etc.) (1) A chairperson shall represent the Committee and supervise the work thereof.
(2) A vice-chairperson shall aid the chairperson; where the chairperson cannot perform his/her duties due to unavoidable reasons, the vice-chairperson shall become an acting chairperson.
(3) Where not only the chairperson but also the vice-chairperson are unable to perform their duties due to unavoidable reasons, a member whom the chairperson designates in advance shall perform the duties for them.

Article 9 (Meeting) (1) A chairperson shall convene a meeting of the Committee and serve as the chair.
(2) The Committee shall deliberate whether to accept donations voluntarily donated and on matters regarding the scope, method, etc. of respectful treatment of donors, such as the Hall of Fame.
(3) A meeting of the Committee shall be started when a majority of registered members are present and resolved by vote of a two-thirds majority of members present.
(4) Members shall not participate in the deliberation of matters in which they are interested.
(5) Other matters necessary for the operation of the Committee shall be decided by the chairperson after the Committee resolves them. <Amended on Dec. 31, 2019>

Article 10 (Hearing of Opinions, etc.) Where it is recognized as necessary for the Committee to deliberate, the chairperson may have related public officials or experts present and hear their opinions or request related institutions or organizations to submit materials, opinions, etc.

Article 11 (Allowances, etc.) Allowances may be provided, within the scope of the budget, for members present in the Committee and related public officials or experts present in the Committee under Article 9. Provided, That the same shall not apply where the related public officials attend a Committee meeting directly in relation to their duties.

Article 12 (Enforcement Rules) Matters required to enforce this Ordinance shall be prescribed as rules. <Amended on Dec. 30, 2021>
