SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE SUPPORT TO OVERCOME SUBFERTILITY

Article 1 (Purpose) The purpose of this Ordinance shall be to contribute to the reduction of the psychological and economic burden on subfertile couples and the raising of awareness of social responsibility for low birth rate by stipulating matters necessary to support the overcoming of subfertility.

Article 2 (Definitions) The term "subfertility" refers to a state in which a couple (including couples of de facto marriage) is unable to get pregnant after 1 year or longer of unprotected sex.

Article 3 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall endeavor to formulate a policy that supports the overcoming of subfertility and secure sufficient finances required therefor.
(2) The Mayor shall endeavor to promote a customized policy that supports the overcoming of subfertility in light of the causes, characteristics, etc. of subfertile couples.

Article 4 (Relation with Other Ordinances) Except in cases specifically prescribed by the relevant ordinances concerning the support to overcome subfertility, what is prescribed by this Ordinance shall be followed.

Article 5 (Targets of Support) Targets of support under this Ordinance shall be subfertile couples who are registered as residents of Seoul Metropolitan City and reside therein in reality. The Mayor shall separately prescribe the details of support, such as standards, scope, etc.

Article 6 (Survey, etc.) The Mayor may conduct a survey on the cause, status, etc. of subfertility to promote a policy that supports the overcoming of subfertility and collect and manage statistics necessary to support the overcoming of subfertility.

Article 7 (Support Projects) (1) The Mayor may implement the following projects to overcome subfertility:
1. Project to educate the prevention of subfertility and provide information thereof;
2. Project to support psychological counseling for subfertile couples; and
3. Other support projects that the Mayor recognizes as necessary to overcome subfertility.
(2) The Mayor may support, within budgetary limits, expenses required for corporates, organizations, etc. to carry out the projects under paragraph (1) above.

Article 8 (Consignment of Tasks) The Mayor may consign professional agencies, organizations, etc. with all or part of the tasks to efficiently implement the support projects under Article 7.

Article 9 (Suspension of Support) The Mayor may suspend the support, where an subfertile couple falls under any of the following subparagraphs:
1. Where the couple is disqualified due to move-out;
2. Where the couple gets pregnant in the course of subfertility treatment; or
3. Where it is recognized that there is a reason to suspend the support, such as where the support was granted by dishonest means.

Article 10 (Prohibition of Leakage of Secrets) A person who is or was engaged in the support projects under Article 7 above shall not leak or use for personal purposes any secret he/she got to know in the conduct of business.

Article 11 (Building of Cooperation System) The Mayor may build a cooperation system with the state, districts, related institutions and organizations, etc. to efficiently implement policies that support the overcoming of subfertility.

Article 12 (Enforcement Rules) Matters required to enforce this Ordinance shall be prescribed as rules.

This Ordinance shall enter into force on the date of its promulgation.
