SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PREVENTION OF DIGITAL SEX OFFENSES AND SUPPORT FOR VICTIMS

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PREVENTION OF DIGITAL SEX OFFENSES AND SUPPORT FOR VICTIMS

Article 1 (Purpose) The purpose of this Ordinance shall be to contribute to guarantee the dignity and value of human beings and improve human rights through the creation of an environment where citizens could be protected safely from digital sex offenses and the provision of support for citizens who suffer damage from digital sex offenses by stipulating matters necessary to prevent digital sex offenses and support victims.


Article 2 (Definitions) The term "digital sex offenses" in this Ordinance refers to the following acts with digital devices and information and communication technology as media:
1. An act to film, edit, compose, or process, without consent of the other party, pictures, images, etc. that could cause sexual desire or humiliation;
2. An act to spread or threaten to spread, possess, purchase, or store, without consent of the other party, digital sexual exploitation materials, such as filmed materials, edited materials, composed materials, processed materials, copied materials, etc. that could cause sexual desire or humiliation;
3. A criminal act under the Act on the Protection of Children and Youth against Sex Offenses, such as the production, spread, possession, etc. of child or youth sexual exploitation materials; and
4. An act to infringe another's sexual autonomy and personal right in a cyber space.


Article 3 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") may formulate and enforce policies that prevent the spread and dissemination of digital sexual exploitation materials and support victims and provide administrative or financial support necessary therefor.
(2) The Mayor shall endeavor to secure a budget and human resources necessary to enforce and support the policies under paragraph (1) above.


Article 4 (Formulation of a Plan) (1) The Mayor shall formulate and enforce every year a plan for the prevention of digital sex offenses and the support for victims including the following:
1. Policy for the prevention of digital sex offenses and support for victims;
2. Plan for awareness improvement, such as education on the prevention of digital sexual offenses, public relations of related policies, etc.;
3. Development of a cooperative system at home and abroad to respond to digital sexual offenses;
4. Improvement of institutions related to digital sexual offenses;
5. Plan for financing to promote policies; and
6. Other matters that the Mayor recognizes as necessary to prevent digital sexual offenses and support victims.
(2) Where it is recognized as necessary, the Mayor may formulate the plan under paragraph (1) above including annual implementation plans for the prevention of violence against women and the protection and support for victims under Article 5 of the Seoul Metropolitan Government Ordinance on the Prevention of Violence Against Women and the Protection and Support for Victims.
(3) When it is required to formulate and enforce the plan under paragraph (1) above, the Mayor may request public institutions or other corporations or organizations to cooperate.


Article 5 (Survey) (1) Where it is required to formulate a policy for the prevention of digital sexual offenses and support for victims, the Mayor may conduct the relevant surveys.
(2) The details of the surveys under paragraph (1) above, such as contents, procedures, etc. shall be separately prescribed by the Mayor.


Article 6 (Establishment of a Report System) (1) The Mayor may establish a system where citizens can report digital sexual exploitation materials suspected of digital sexual offenses.
(2) Where the report system under paragraph (1) above is established, the Mayor shall take necessary measures so that victims of digital sex offenses shall not suffer additional damage due to the report.


Article 7 (Projects) The Mayor may implement the following projects for the prevention of digital sex offenses and support for victims:
1. Support to delete images of victims of digital sex offenses and monitor afterwards;
2. Support and link counseling, medical services, and psychotherapy of victims of digital sex offenses;
3. Provide legal supports for victims of digital sex offenses;
4. Support self-help meetings of victims of digital sex offenses;
5. Support the training of experts in digital sex offenses;
6. Support to develop and use advanced technology, such as artificial intelligence in response to digital sex offenses;
7. Improve awareness by practicing prevention education on digital sex offenses and promoting related policies; and
8. Other projects necessary to prevent digital sexual offenses and support victims.


Article 8 (Budget Support) The Mayor may support the relevant corporates, organizations, etc. that promote the projects under Article 7 within a budgetary limit.


Article 9 (Building of a Cooperation System) (1) The Mayor may build a cooperation system with the central government, the Seoul Metropolitan Police, the Seoul Metropolitan Office of Education, other local governments, related corporations, organizations, etc. to prevent digital sex offenses and support victims.
(2) The Mayor may build an international cooperation system with international organizations, foreign corporations, universities, research institutes, organizations, etc. to actively respond to digital sex offenses and promote a policy necessary therefor.
(3) The Mayor may enter into agreements for information exchange, cooperation in order to build the cooperation systems under paragraphs (1) and (2) above.


Article 10 (Confidentiality) Any person who is or was engaged in affairs that prevent digital sex offenses and support victims under this Ordinance shall not divulge any confidential information acquired in the course of performing his or her duties to any other persons and shall conform to the Personal Information Protection Act.


Article 11 (Consignment of Tasks) (1) The Mayor may consign related specialized organizations, corporations, agencies, etc. with all or part of the tasks under Article 7 in order to efficiently prevent digital sex offenses and support victims.
(2) Detailed matters necessary for consignment under paragraph (1) above, such as procedures, methods, etc., shall be governed by the Seoul Metropolitan Government Ordinance on the Private Consignment of Administrative Affairs.

This Ordinance shall enter into force on the date of its promulgation.
