SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROTECTION AND PROMOTION OF CULTURAL DIVERSITY

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROTECTION AND PROMOTION OF CULTURAL DIVERSITY

Article 1 (Purpose) The purpose of this Ordinance shall be to contribute to improve the quality of citizens' cultural lives and realize a cultural city based on cultural diversity by prescribing matters delegated by the Act on the Protection and Promotion of Cultural Diversity and the Enforcement Decree of the same Act and matters necessary for the enforcement thereof.


Article 2 (Definitions) In this Ordinance, the term "cultural tolerance" refers to an attitude that respects diversity without limiting or prohibiting cultural expression according to differences in the nationality, ethnicity, race, religion, language, region, gender, generation, academic background, mental and physical ability, etc. of individuals or groups and support or participation in cultural and artistic activities; Provided, That cultural diversity that harms traditional custom of the society would not correspond to the cultural tolerance.


Article 3 (Rights and Duties of Social Members) All members of the society shall have freedom and rights of cultural expression and endeavor to respect cultural tolerance and the various cultural expressions of other members of society.


Article 4 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall do the following: devise a policy for the protection and promotion of cultural diversity; recommend, protect, and promote cultural and artistic activities based on cultural diversity; and actively secure finances necessary therefor.
(2) The Mayor shall endeavor to do the following: establish, enforce, investigate, and research a policy for cultural diversity; support cultural and artistic activities for the promotion of cultural diversity; develop a system for regional exchange and cooperation in relation to cultural diversity.
(3) The Mayor shall not discriminate support or participation in cultural expressions and cultural and artistic activities based on cultural difference in nationality, ethnicity, race, religion, language, region, gender, generation, etc. and shall endeavor to share the value of cultural diversity through cultural tolerance.


Article 5 (Relation with Other Ordinances) (1) Except in cases specifically prescribed by the relevant ordinances concerning the protection and promotion of cultural diversity, what is prescribed by this Ordinance shall be followed.
(2) Where other ordinances are enacted or revised in relation to the protection and promotion of cultural diversity, they shall coincide with this Ordinance.


Article 6 (Implementation Plan) (1) The Mayor shall formulate and enforce an annual implementation plan proper to a relevant region based on the Master Plan and the implementation plan under Article 6 of the Act on the Protection and Promotion of Cultural Diversity.
(2) The Mayor shall finalize and enforce an implementation plan after being deliberated by the Cultural Diversity Committee under Article 7.
(3) The Mayor shall endeavor that members of the society actively participate in the formulation and enforcement of an implementation plan.


Article 7 (Cultural Diversity Committee) (1) The Mayor shall establish the Cultural Diversity Committee (hereinafter referred to as the "Committee") to deliberate and coordinate the following matters:
1. Formulation, revision, and evaluation of implementation plans under Article 6;
2. Surveying under Article 10;
3. Support under Article 11;
4. Education under Article 12;
5. Expert training under Article 13;
6. Matters concerning cooperation among related organizations about a policy for the protection and promotion of cultural diversity;
7. Matters concerning cooperation among related local governments about a policy for the protection and promotion of cultural diversity; and
8. Other matters that a chairperson recognizes as necessary for the Committee to deliberate and adjust in relation to a policy for the protection and promotion of cultural diversity.
(2) The Committee shall comprise not more than 20 members including 1 chairperson and 1 vice-chairperson.
(3) The chairperson and the vice-chairperson shall be elected by mutual vote among members.
(4) Members of the Committee shall be appointed or commissioned among the following people:
1. Heads of departments in charge of cultural and artistic policy, welfare policy, disabled persons welfare policy, female and family policy, foreigner and multi-culture policy, etc.;
2. People with expertises and experience in a policy for the protection and promotion of cultural diversity and commissioned by the Mayor; or
3. Members of a standing committee under the Seoul Metropolitan Council.
(5) A chairperson shall represent the Committee and advance meetings. And a vice-chairperson shall aid the chairperson. Where the chairperson cannot perform his/her duties due to unavoidable reasons, the vice-chairperson shall become an acting chairperson.
(6) Members' term of office shall be 2 years and members may serve consecutive terms only once. And a term of office of a member newly commissioned due to resignation of an existing member shall be his/her predecessor's remaining term.
(7) 1 secretary shall handle the affairs of the Committee, who shall be an officer in charge of such affairs.
(8) Allowances and travel expenses may be provided for members of the Committee within a budgetary limit in accordance with the Seoul Metropolitan Government Ordinance on the Provision of Allowances and Travel Expenses to Committees; Provided, That the same shall not apply where a member who is a public official appear in meetings.
(9) Matters concerning the organization and operation of the Committee in addition to what is prescribed by this Ordinance shall be determined by a chairperson with resolution of the Committee.


Article 8 (Subcommittees) (1) The Committee may operate subcommittees to efficiently perform its tasks.
(2) Subcommittees shall comprise not more than 7 members appointed from among members of the Committee by a chairperson. And a chairperson of the subcommittee shall be elected by mutual vote among members.


Article 9 (Expert Members) (1) The Committee may have not more than 3 expert members.
(2) Expert members shall be commissioned from people with expertise in cultural diversity by the Mayor.
(3) Expert members may collect, investigate, and research materials about cultural diversity under the orders of a chairperson and speak at Committee meetings.


Article 10 (Cultural Diversity Survey) (1) The Mayor shall conduct a survey every 2 years on cultural factors comprising cultural diversity, level of awareness of the protection and promotion of cultural diversity, activities to create and enjoy culture, etc. (hereinafter referred to as the "Survey") and publicly announce the findings thereof.
(2) The Survey shall include the following:
1. Matters concerning a cultural diversity environment in local communities, such as the operation of cultural diversity-related facilities, the provision of cultural diversity services, etc.;
2. Matters concerning policies and institutions for the protection and promotion of cultural diversity;
3. Matters concerning social awareness regarding cultural diversity;
4. Matters concerning the cultural effect of main political projects;
5. Matters concerning projects related to cultural diversity, among main local projects; and
6. Other matters necessary to formulate a policy for the protection and promotion of cultural diversity.
(3) The Mayor may request agencies or organizations with expertise and human resources regarding cultural diversity to conduct the Survey.


Article 11 (Support for the Protection and Promotion of Cultural Diversity) (1) The Mayor may provide administrative and/or financial support for the following activities or cultural facilities therefor in fields, such as culture and arts, academics, sports, cultural industry, etc.:
1. An activity for coexistence and harmonization of various cultures; and
2. An activity for the expansion of opportunities to express and enjoy various cultures.
(2) When providing the support under paragraph (1) above, the Mayor may take the advice of related agencies, organizations, or experts.


Article 12 (Education on the Protection and Promotion of Cultural Diversity) The Mayor may conduct the following cultural diversity education of teachers, youths, and other objects who are recognized to be educated on cultural diversity:
1. Details of treaties, statutes, and policies for cultural diversity;
2. Various local cultures and folklore;
3. Matters concerning the detailed method that realizes the values of cultural tolerance and cultural diversity; and
4. Other matters recognized as necessary to protect and promote cultural diversity.


Article 13 (Training of Experts) The Mayor may promote the following projects to train experts required to protect and promote cultural diversity:
1. Collect and investigate experts-related information;
2. Support to develop teaching materials necessary to train experts; and
3. Provide other support necessary to train experts.


Article 14 (Operation of Local Partnership) (1) The Mayor may operate a partnership where various local private organizations, cultural agencies, etc. participate to protect and promote cultural diversity.
(2) The Mayor may provide space and support necessary to operate the local partnership without problems.


Article 15 (Recommendations, etc.) The Mayor may request public institutions, organizations, individuals, etc. to correct or improve culturally discriminatory acts and may support and check the detailed enforcement thereof.


Article 16 (Citations) The Mayor may honor every year individuals, organizations, agencies, etc. that contribute to the protection and promotion of cultural diversity under the Seoul Metropolitan Government Ordinance on Citations.

This Ordinance shall enter into force on the date of its promulgation.
