SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE DEVELOPMENT AND SUPPORT OF CULTURAL CONTENT INDUSTRIES

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE DEVELOPMENT AND SUPPORT OF CULTURAL CONTENT INDUSTRIES

Article 1 (Purpose) The purpose of this Ordinance shall be to contribute to the improvement of the quality of citizens' cultural lives and the development of the local economy by prescribing matters necessary for the development and support of a cultural content industry to build a foundation for the development of cultural content industry in Seoul Metropolitan City and reinforce its competitiveness.


Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "cultural content industry" refers to an industry that is related to planning, developing, manufacturing, producing, distributing, and consuming contents creating economic values added by commercializing culture and arts and falls under any of the following items:
A. Industry related to movies or video materials;
B. Industry related to publishing, printing, or periodicals;
C. Industry related to music or games;
D. Industry related to broadcast pictures;
E. Industry related to cartoons, characters, animation, edutainment, mobile cultural content, or design (excluding industrial designs);
F. Industry engaged in collecting, processing, developing, manufacturing, producing, storing, searching, distributing, etc. of digital cultural content or multimedia cultural content, or services related thereto; or
G. Other industries that the Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") recognizes as necessary to develop and support a cultural content industry.
2. The term "content" refers to materials or information, such as codes, letters, diagrams, colors, voices, sound, images or videos (including the combination thereof).
3. The term "digital content" refers to what is manufactured or processed in digital format so as to enhance the usefulness of the preservation or utilization of content.
4. The term "digital cultural content" refers to digital content in which cultural elements are embodied.
5. The term "multimedia content" refers to content which have new functions of expression or storage by systematically combining media related to codes, letters, diagrams, colors, voices, sound, images or videos, etc.
6. The term "edutainment" refers to cultural content planned or manufactured by systematically combining cultural content, which may be used for educational purposes.


Article 3 (Duties) (1) The Mayor shall create a foundation for the development and support of a cultural content industry and actively find and promote a policy therefor.
(2) The Mayor shall build a cooperation system with related private organizations, corporations, agencies, etc. to efficiently promote the policy for the development and support of a cultural content industry.


Article 4 (Relation with Other Ordinances) Except in cases specifically prescribed by the relevant ordinances concerning the development and support of a cultural content industry, what is prescribed by this Ordinance shall be followed.


Article 5 (Formulation of a Master Plan, etc.) (1) The Mayor shall formulate and enforce, every 5 years, a master plan for the development and support of a cultural content industry of Seoul Metropolitan City (hereinafter referred to as the "Master Plan") that includes the following to create and develop the cultural content industry:
1. Basic direction and objective of the development and support of the cultural content industry;
2. Strategies and main policies by field for the development and support of the cultural content industry;
3. Plan for financing to develop and support the cultural content industry;
4. Improvement of laws, institutions, etc. related to the development and support of a cultural content industry; and
5. Other matters necessary to develop and support the cultural content industry.
(2) When formulating and enforcing the Master Plan, the Mayor shall link the Master Plan with a comprehensive plan for a cultural citizen city under Article 13 of the Seoul Metropolitan Government Framework Ordinance on Cultural City.
(3) The Mayor shall formulate and enforce an annual implementation plan based on the Master Plan.
(4) When formulating the Master Plan and an annual implementation plan, the Mayor shall endeavor to take and reflect on pieces advice from Gu heads, agencies, corporations, organizations, experts, etc. in the cultural content industry.


Article 6 (Projects for the Development and Support of the Cultural Content Industry) (1) The Mayor may implement the following projects for the development and support of the cultural content industry:
1. Build infrastructure for a cultural content industry;
2. Provide space and rent for corporations, organizations, businesses, creators, etc. engaged in a cultural content industry;
3. Support startup, manufacturing, marketing, technology development businesses, etc. related to a cultural content industry;
4. Support the training and employment of experts in a cultural content industry;
5. Support to expand into an overseas market and attract international exchange and investment;
6. Build a cooperation system among industries, universities, and government to develop a cultural content industry;
7. Provide experience and training programs to improve the understanding of cultural contents; and
8. Other projects that the Mayor recognizes as necessary to develop and support a cultural content industry.
(2) The Mayor may have projects under paragraph (1) consigned or executed by corporations, organizations, etc. related to the cultural content industry;
(3) The Mayor may support, within a budgetary limit, autonomous Gus, corporations, organizations, etc. related to a cultural content industry which promote the projects under paragraph (1) above.
(4) Where a business or a research institute that performs the projects under paragraph (1) above moves in Seoul Metropolitan City, the Mayor may provide support necessary therefor.


Article 7 (Development of a Cultural Industrial Complex and a Cultural Industry Promotional Zone, etc.) (1) Where it is necessary to develop a cultural industrial complex and a cultural industry promotional zone designated under the Framework Act on the Promotion of Cultural Industries, the Mayor may provide the required expenses for a party that implements a development plan within a budgetary limit.
(2) The Mayor may, to promote a cultural content industry, develop facilities promoting cultural industries in a cultural industrial complex or have such facilities move into such complex under the Framework Act on the Promotion of Cultural Industries.
(3) The Mayor may provide the required expenses for a party that intends to install facilities promoting cultural industries.


Article 8 (Cultural Content Industry Development Committee) (1) The Mayor may establish the cultural content industry development committee of Seoul Metropolitan City (hereinafter referred to as the "Committee") to deliberate the following matters concerning the development and support of the cultural content industry or provide the Mayor with advice:
1. Formulation and revision of the Master Plan and an annual implementation plan;
2. Evaluation of main policies for the cultural content industry;
3. Development of projects that develop and support cultural content industry under Article 6; and
4. Other matters that the Mayor recognizes as necessary.
(2) Where there is another committee suitable to perform the functions of the Committee under paragraph (1) above, such committee may substitute for such functions of the Committee.


Article 9 (Organization of the Committee) (1) The Committee shall comprise about 15 members including 1 chairperson and 1 vice-chairperson.
(2) The chairperson and the vice-chairperson shall be elected by mutual vote among members.
(3) Members of the Committee shall be appointed or commissioned from among the following by the Mayor. In such cases, the members of specific gender shall not exceed 6/10 of the number of commissioned members:
1. Members of Seoul Metropolitan Council;
2. A head of department in charge of a cultural content industry; and
3. Persons with sufficient knowledge and experience in the cultural content industry.
(4) A term of office of ex-officio members shall be a period corresponding to such position, and a term of office of commissioned members shall be 2 years. The members may serve consecutive terms only once.
(5) The Mayor may decommission a member in the following cases:
1. Where the member becomes unable to do his/her duties due to mental weakness for a long period of time;
2. Where the member commits an irregularity as a matter of duty; or
3. Where it is recognized that the member is nor right for his/her position due to neglect of duty, injury to dignity, etc.;


Article 10 (Duties of the Chairperson, etc.) (1) A chairperson shall represent the Committee and supervise the work thereof.
(2) A vice-chairperson shall assist a chairperson and where the chairperson is unable to perform his/her duties due to unavoidable reasons, the vice-chairperson shall perform the duties for the chairperson:
(3) Where not only the chairperson but also the vice-chairperson are unable to perform their duties due to unavoidable reasons, a member whom the chairperson designates in advance shall perform their duties for them.


Article 11 (Operation of the Committee) (1) Committee meetings shall be started when a majority of registered members are present and resolved by vote of a majority of the members present.
(2) Allowances and travel expenses may be provided for members, experts, etc. present in the Committee within the scope of budgets in accordance with Seoul Metropolitan Government Ordinance on the Provision of Allowances and Travel Expenses to Committees.
(3) When it is recognized as necessary for performance of duties, the Committee may request related organizations, agencies, etc. to provide necessary cooperation, such as submission of materials, advice, etc.
(4) Matters concerning the organization, operation, etc. of the Committee other than as stipulated by this Ordinance shall be governed by the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Various Committees.


Article 12 (Consignment of Tasks) (1) Where it is necessary to promote a cultural content industry, the Mayor may consign related corporations, organizations, etc. with affairs for the development and support of the cultural content industry.
(2) Where affairs are consigned under paragraph (1) above, the Mayor shall follow the Seoul Metropolitan Government Ordinance on the Private Consignment of Administrative Affairs.


Article 13 (Enforcement Rules) Matters required to enforce this Ordinance shall be prescribed as rules.

This Ordinance shall enter into force on the date of its promulgation.
