SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE DEVELOPMENT OF AND SUPPORT FOR THE BEAUTY INDUSTRY

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE DEVELOPMENT OF AND SUPPORT FOR THE BEAUTY INDUSTRY

Article 1 (Purpose) The purpose of this Ordinance shall be to contribute to the creation of a foundation for the beauty industry, the reinforcement of competitiveness thereof, and the revitalization of the local economy with job creation by prescribing matters necessary for the development of and support for the beauty industry in Seoul Metropolitan City.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "beauty industry" refers to an industry that falls under any of the following items:
A. Barbering business, beauty parlor business, and service industry related thereto under Articles 2(1)4 and 5 of the Public Health Control Act;
B. An industry related to the manufacturing, development and improvement of cosmetics, functional cosmetics, natural cosmetics, organic cosmetics, custom cosmetics and subsidiary materials thereof under subparagraphs 1 through 3-2 of Article 2 of the Cosmetics Act;
C. Other industries stipulated by rules as an industry related to materials, goods, and services necessary to manage and keep bodies healthy and beautiful;
2. The term "beauty business operator" refers to a business operator which carries out economic activities related to a beauty industry.
3. The term "beauty industry product" refers to materials, goods, services, made or rendered to manage and keep bodies healthy and beautiful.

Article 3 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall endeavor to formulate and enforce a policy for the development of and support for the beauty industry, create a foundation for the beauty industry, and reinforce the competitiveness of the beauty industry.
(2) The Mayor shall formulate a policy necessary for the protection of rights and interests of consumers who use the beauty industry products in promoting the revitalization of the beauty industry.

Article 4 (Formulation of the Master Plan for the Beauty Industry) (1) The Mayor shall formulate the master plan for the development of and support for the beauty industry (hereinafter referred to as the "Master Plan") every 5 years.
(2) The Master Plan shall include the following:
1. Matters concerning the direction and objective of support for the development of the beauty industry;
2. Matters concerning the training of experts in the development of the beauty industry;
3. Matters concerning the construction, management, technical support, etc. for infrastructure of the beauty industry;
4. Matters concerning the establishment of events, technology development, research projects, etc. regarding the beauty industry;
5. Matters concerning domestic and foreign exchange and information exchange in the beauty industry;
6. Matters concerning financial support for the development of and support for the beauty industry; and
7. Other matters necessary for the development of and support for the beauty industry
(3) The Mayor shall formulate and enforce an annual implementation plan based on the Master Plan.
(4) The Mayor shall report the implementation results of the implementation plan for the previous year, the Master Plan and the implementation plan under paragraphs (1) and (3) to the standing committee concerned of Seoul Metropolitan City.
(5) The Mayor may conduct a survey on the current state of the beauty industry to efficiently formulate and enforce the Master Plan and an implementation plan.

Article 5 (Support Projects) (1) The Mayor may implement the following projects for the development of and support for the beauty industry:
1. Provision of consultation, education and information on business start-up, technology development and management;
2. Support for training and employment of experts;
3. Support for production of beauty industry products and development of brands;
4. Support for marketing and promotion at home and abroad;
5. Support for domestic and foreign certification, exports, and investment attraction of beauty industry products;
6. Support for domestic and foreign exhibition and technology contests; and
7. Other projects that the Mayor recognizes as necessary for the development of and support for the beauty industry.
(2) The Mayor may provide beauty industry corporations, organizations, etc. promoting projects under paragraph (1) above with part of the expenses within a budgetary limit under the Seoul Metropolitan Government Ordinance on the Management of Local Subsidies.

Article 6 (Training of Experts) (1) The Mayor may implement the following projects for the training of experts necessary for the development of and support for the beauty industry:
1. Support for development and education on education programs for training of experts in the beauty industry;
2. Support for employment of and business start-up for experts; and
3. Other matters that the Mayor recognizes as necessary for the training of experts in the beauty industry.
(2) The Mayor shall develop a cooperation system with corporations, institutions, organizations, etc. with human resources and facilities for the beauty industry, such as universities, research institutions, etc. in order to train the experts under paragraph (1) above.

Article 7 (Technology Development) (1) The Mayor may provide the necessary expenses for a person who implements technology development and research to promote the development of the beauty industry-related technology.
(2) The Mayor may promote joint research among university, institutions, and businesses to implement research on and development of beauty industry-related products.
(3) The Mayor may separately determine matters necessary for recipients, method, etc. of support for expenses for technology development and research under paragraph (1) above.

Article 8 (Development of Industrial Infrastructure) The Mayor may implement the following projects for the development of industrial infrastructure for the beauty industry:
1. Development of an integrated complex of the beauty industry;
2. Development of infrastructure for the beauty industry, such as service experience space, museums, etc.;
3. Research and service for the revitalization of the beauty industry; and
4. Other projects necessary to develop the infrastructure of the beauty industry.

Article 9 (Support for Business) The Mayor may provide the following support with beauty business operators, beauty industry-related corporations, organizations, agencies, etc. to develop and support the beauty industry:
1. Loans of the small and medium enterprise development fund under the Seoul Metropolitan Government Ordinance on the Establishment and Operation of the Small and Medium Enterprise Development Fund;
2. Guarantee of the Seoul Credit Guarantee Foundation;
3. Part of the expenses necessary for holding beauty industry-related contests, exhibitions, etc.; and
4. Other matters that the Mayor recognizes as necessary to support businesses to develop the beauty industry.

Article 10 (Holding and Operation of Beauty Exhibitions) (1) The Mayor may hold and operate international and national beauty exhibitions, technology contests, forums, etc. (hereinafter referred to as "Beauty Exhibitions") to develop and support the beauty industry.
(2) The Mayor may provide, within a budgetary limit, expenses necessary for sales promotion activities, such as support for participation in domestic and foreign exhibitions for beauty business operators or beauty-related corporations, organizations, agencies, etc. for the revitalization of the beauty industry.

Article 11 (Establishment of the Beauty Industry Development Committee) (1) The Mayor may establish the beauty industry development committee (hereinafter referred to as the "Committee") of Seoul Metropolitan City to deliberate the main policy for the development and support of the beauty industry.
(2) The Committee shall deliberate the following:
1. Matters concerning the establishment, enforcement, etc. of the Master Plan and implementation plan under Article 4;
2. Matters regarding the support projects under Article 5;
3. Matters concerning cooperation and coordination among beauty-related agencies, organizations, etc.;
4. Matters concerning the training of experts in the beauty industry and business start-up, management, technical support, etc. of the beauty industry;
5. Matters concerning the beauty industry development events, such as beauty exhibitions, etc.;
6. Matters concerning the support for beauty industry-related agencies, organizations, etc.; and
7. Other matters that the Mayor recognizes as necessary for the revitalization of the beauty industry.

Article 12 (Organization of the Committee) (1) The Committee shall comprise not more than 20 members including 1 chairperson and 1 vice-chairperson. The chairperson shall be elected from among the members by mutual vote.
(2) Members are appointed or commissioned by the Mayor from among persons that fall under any of the following subparagraphs: Heads of offices, headquarters, and divisions related to the beauty industry shall become ex-officio members;
1. People who work in beauty-related agencies, organizations, etc.;
2. People with sufficient knowledge and experience in the beauty industry;
3. Member of the Seoul Metropolitan Council; or
4. Other persons whom the Mayor recognizes as necessary to be designated accordingly.
(3) The term of office of members shall be 2 years and such members may serve consecutive terms once; Provided, That a term of office of ex-officio members shall be a period during which they hold their position. A term of office of commissioned members who are members of the Seoul Metropolitan Council shall be their tenure of the standing committee affiliated with the time of commission.
(4) Commissioned members of a specific gender shall not exceed 6/10 of the total number of Committee members under paragraph (1) above in accordance with Article 21(2) of the Framework Act on Gender Equality; Provided, That the same shall not apply where it is recognized that any unavoidable cause, such as lack of professional workforce of a particular gender in the relevant field, is deemed to exist according to a proviso to the same paragraph.
(5) The Committee may have a secretary and a clerk to supervise its affairs and prepare minutes. The secretary shall become an officer at the department supervising the Committee and the clerk shall become a deputy officer.
(6) Committee meetings shall be started when a majority of registered members are present and resolved by vote of a majority of the members present.
(7) Unless stipulated otherwise by this Ordinance, the organization and operation of the Committee shall be governed by the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Various Committees.

Article 13 (Direction and Supervision) (1) The Mayor shall verify whether subsidized beauty business operators use the subsidy as it is intended and provide direction and supervision.
(2) Where subsidized beauty business operators use the subsidy other than it is intended, the Mayor may change or revoke the grant of subsidy or collect the subsidy already granted.

Article 14 (Consignment of Tasks) (1) The Mayor may consign beauty industry-related organizations, corporations, agencies, etc. with all or part of the tasks under this Ordinance in order to efficiently promote the development of and support for the beauty industry.
(2) Detailed matters necessary for consignment under paragraph (1) above, such as procedures, methods, etc., shall be governed by the Seoul Metropolitan Government Ordinance on the Private Consignment of Administrative Affairs.

Article 15 (Enforcement Rules) Matters required to enforce this Ordinance shall be prescribed as rules.

This Ordinance shall enter into force on the date of its promulgation.
