SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE SUPPORT FOR WORK-LIFE BALANCE

Article 1 (Purpose) The purpose of this Ordinance shall be to contribute to improve the quality of the lives of citizens of Seoul and realize gender equality in Seoul by promoting a balance among work and family life of workers, paternity and maternity care, private life where leisure and culture could be enjoyed, etc. in accordance with the Act on the Promotion of Creation of Family-Friendly Social Environment and the Equal Employment Opportunity and Work-Family Balance Assistance Act.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "work-life balance" means that various types of individuals and families run work and life in a balanced and harmonious way;
2. The term "work-life balance social environment" refers to an environment where the work-life balance under subparagraph (1) above can be maintained at work, family and the society at large;
3. The term "work-life balance work environment" refers to a work environment that operates family-friendly institutions so that workers can run their work and lives harmoniously.

Article 3 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall formulate and enforce a comprehensive policy necessary to support work-life balance.
(2) The Mayor shall endeavor to develop financial resources and create conditions necessary for work-life balance in order to implement the tasks under paragraph (1) above.

Article 4 (Duties of Employers) (1) Employers shall endeavor to create a work-life balance work environment, such as adoption, expansion, etc. of a family-friendly institution.
(2) Employers shall endeavor to promote workers' participation in the operation of family-friendly institutions.

Article 5 (Formulation of an Implementation Plan) (1) The Mayor shall formulate and enforce every year an implementation plan under Article 6 of the Act on the Promotion of Creation of Family-Friendly Social Environment.
(2) The implementation plan shall include the following:
1. Basic direction and objective of the policy for work-life balance;
2. Matters concerning the reinvigoration of family-friendly institutions;
3. Matters concerning the creation of and support for work-life balance work environment;
4. Matters concerning facilities for work-life balance and operation thereof;
5. Matters concerning the creation of and support for local community family care environment; and
6. Other matters necessary to support work-life balance.
(3) Where it is necessary to formulate and enforce an implementation plan, the Mayor may ask heads of Gu, public institutions, corporations, or organizations to cooperate. Heads of Gu who are requested shall cooperate, unless there are extenuating circumstances.
(4) The Mayor shall report the annual performance of the implementation plan to the work-life balance committee of Seoul Metropolitan City under Article 6.

Article 6 (Establishment and Functions of the Work-Life Balance Committee) (1) The life-work balance committee of Seoul Metropolitan City (hereinafter referred to as the "Committee") may be established to deliberate and coordinate the following in relation to work-life balance:
1. Matters concerning the formulation of the implementation plan under Article 5;
2. Matters concerning the inspection and evaluation of the annual performance of the implementation plan under Article 5;
3. Matters concerning coordination and cooperation on projects regarding a work-life balance policy;
4. Matters concerning the evaluation of and research on a work-life balance policy; and
5. Other matters necessary for the work-life balance policy.
(2) The functions of the Committee may be performed by the gender equality committee under Article 6 of the Seoul Metropolitan Government Framework Ordinance on Gender Equality.

Article 7 (Organization of the Committee) (1) The Committee shall comprise about 15 members including 1 chairperson and 1 vice-chairperson.
(2) The following people can be members of the Committee:
1. Ex-officio members: Public officials who are directors of bureau or above, in charge of the support for work-life balance.
2. Commissioned members: People commissioned by the Mayor from among people who fall under any of the following items. The number of commissioned members of a specific gender shall not exceed 6/10 of the total number of commissioned members under Article 21(2) of the Framework Act on Gender Equality; Provided, That this shall not apply where any unavoidable cause, such as lack of professional workforce of a particular gender in the relevant field, is deemed to exist and a working committee adopts a resolution thereon.
A. People with sufficient knowledge or experience in work-life balance and support;
B. People recommended by organizations and corporations related to work-life balance or work; or
C. People recommended by the Seoul Metropolitan Council.
(3) The term of office of commissioned members shall be 2 years and such members may serve consecutive terms only once; Provided, That a supplementary member who is commissioned due to resignation of a former member shall serve the remaining term of office of the former member:
(4) Notwithstanding paragraph (3) above, the Mayor may dismiss a member even before his/her term of office expires under Article 8-2 of the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Various Committees.

Article 8 (Chairperson, etc.) (1) The chairperson and the vice-chairperson shall be elected by mutual vote from among members.
(2) A chairperson shall represent the Committee and supervise the work thereof.
(3) Where a chairperson cannot perform his/her duties due to unavoidable reasons, a vice-chairperson shall become an acting chairperson.

Article 9 (Operation of the Committee) (1) Regular Committee meetings shall be held twice a year and special meetings shall be held in the following cases:
1. Where a chairperson recognizes as necessary to be held; or
2. When 1/3 or more of registered members request to hold;
(2) Committee meetings shall be started when a majority of registered members are present and resolved by vote of a majority of the members present.
(3) Where it is difficult to expect that a member would deliberate fairly an agenda notwithstanding his/her direct interest in the agenda, the member shall be excluded, recused, or avoided from the deliberation on the agenda.
(4) Where it is recognized as necessary in relation to an agenda, a chairperson shall have related public officials or experts attend the Committee and listen to their opinions or present materials.
(5) The Committee may have 1 secretary to handle its affairs and the secretary shall become a head of department in charge of work-life balance.
(6) Other matters concerning preparation, disclosure, etc. of minutes shall be governed by Article 9-2 of the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Various Committees.

Article 10 (Detailed Regulations) Matters necessary for the operation of the Committee in addition to what is prescribed by this Ordinance shall be determined by a chairperson with resolution of the Committee.

Article 11 (Establishment and Function of the Work-Life Balance Support Center) (1) The Mayor may establish and operate the work-life balance support center of Seoul Metropolitan City (hereinafter referred to as the "Center") to create a work-life balance social environment.
(2) The Center shall implement the following projects:
1. Support a policy for work-life balance;
2. Consult businesses about support for work-life balance;
3. Educate and promote support for work-life balance;
4. Develop the private-public cooperation for support for work-life balance;
5. Collect and provide information on work-life balance; and
6. Other projects that the Mayor recognizes as necessary.

Article 12 (Consignment of Center Operations) (1) The Mayor may consign related non-profit corporations, organizations, etc. to systematically operate the Center.
(2) Other than matters stipulated by this Ordinance, procedures, method, etc. for consignment shall be governed by the Seoul Metropolitan Government Ordinance on the Private Consignment of Administrative Affairs.

Article 13 (Surveys) (1) The Mayor shall conduct surveys on a regular basis to understand the support for work-life balance of workers in Seoul Metropolitan City.
(2) The target, contents, method, etc. of surveys shall be determined separately by the Mayor.

Article 14 (Support Projects) (1) The Mayor may promote the following projects to promote the creation of work-life balance social environment:
1. Project that creates and diffuses the work-life balance culture;
2. Project that trains experts in work-life balance;
3. Project that develops and supplies work-life balance programs;
4. Project that educates and consults about the family-friendliness certification that the Ministry of Gender Equality and Family issues to public institutions and businesses;
5. Project that investigates, researches, educates, and promotes the creation of work-life balance social environment; and
6. Other projects necessary to create the work-life balance social environment.
(2) The Mayor may promote the projects under paragraph (1) above or provide, within a budgetary limit, administrative and financial support for corporations or organizations related to the work-life balance work environment.

Article 15 (Enforcement Rules) Matters required to enforce this Ordinance shall be prescribed as rules.

Addenda <Ordinance No. 7620, Jul. 16, 2020>
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Abolition of Other Ordinances)
The Seoul Metropolitan Government Ordinance on the Creation of and Support for Family-Friendly Social Environment shall be revoked.
Article 3 (Term)
The Work-Life Balance Committee of Seoul Metropolitan City under Article 6 shall exist for three years.
