SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE RIGHT GUARANTEE AND SUPPORT FOR PERSONS WITH AUDIOVISUAL DISABILITIES

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE RIGHT GUARANTEE AND SUPPORT FOR PERSONS WITH AUDIOVISUAL DISABILITIES

Article 1 (Purpose) The purpose of this Ordinance is to promote the social participation of persons with audiovisual disabilities, protect their rights, and contribute to their leading decent human lives by prescribing measures to guarantee and support their rights.

Article 2 (Definition) The term "persons with audiovisual disabilities" in this Ordinance refers to persons with both visual and hearing impairments under Appendix Form 1 of the Enforcement Decree of the Act on Welfare of Persons With Disabilities

Article 3 (Duties of the Mayor) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall actively promote comprehensive welfare service policies to guarantee and support the rights of persons with audiovisual disabilities so that they can lead decent human lives.

Article 4 (Duties of Citizens) All citizens shall respect the personality of persons with audiovisual disabilities and strive to cooperate in improving the welfare of persons with audiovisual disabilities based on the ideology of social integration.

Article 5 (Relationship with Other Ordinances) This Ordinance takes precedence over other ordinances with respect to guaranteeing rights and support for persons with audiovisual disabilities.

Article 6 (Establishment and Implementation of Master Plans) (1) The Mayor shall establish and implement a master plan for guaranteeing rights and support for persons with audiovisual disabilities (hereinafter referred to as "master plan") every three years.
(2) The master plan shall include the following matters:
1. Policy goals and direction for persons with audiovisual disabilities;
2. Status of fact-finding research on types of persons with audiovisual disabilities and welfare needs;
3. Major measures for persons with audiovisual disabilities;
4. Establishment of a cooperative system for discovery, connection, and support of target persons;
5. Financing measures for the support for persons with audiovisual disabilities;
6. Improvement of laws and systems to guarantee the rights of persons with audiovisual disabilities;
7. Other matters necessary for guaranteeing rights and supporting persons with audiovisual disabilities.
(3) The Mayor shall establish and implement an implementation plan every year according to the basic plan.
(4) When establishing and implementing the basic plan and the implementation plan, the Mayor shall collect the opinions of persons with audiovisual disabilities, their families, related experts, and organizations, and strive to reflect them as much as possible.

Article 7 (Fact-Finding Reseasrch) (1) The Mayor may conduct fact-finding research on persons with audiovisual disabilities and their families, if necessary, in order to efficiently promote policies to ensure rights and support for persons with audiovisual disabilities. In this case, the fact-finding research is limited to a scope that does not overlap with the fact-finding research pursuant to Article 31 of the Act on Welfare of Persons With Disabilities and other laws and ordinances.
(2) Specific matters such as the contents, methods, procedures, etc. of the fact-finding resesarch under paragraph 1 shall be determined separately by the Mayor.

Article 8 (Projects to Support Persons with Audiovisual Disabilities) (1) The Mayor may promote the following projects to support persons with audiovisual disabilities:
1. Support for communication and mobility;
2. Independent living education and training, vocational rehabilitation;
3. Operation and activation of self-help groups and establishment of networks;
4. Psychological counseling, participation in cultural and leisure activities;
5. Education, training and dispatch of professional personnel for smooth communication and daily activities;
6. Research, development, and dissemination of communication forms and related assistive devices;
7. Socio-cultural awareness improvement and publicity related to persons with audiovisual disabilities;
8. Other projects necessary to support persons with audiovisual disabilities.
(2) The Mayor may subsidize all or part of necessary expenses within budgetary limits for autonomous districts, corporations, organizations, etc. that promote support projects for persons with audiovisual disabilities.

Article 9 (Establishment of Support Center for Persons with Audiovisual Disabilities) (1) The Mayor may install and operate the Seoul Metropolitan Government Support Center for Persons with Audiovisual Disabilities (hereinafter referred to as the "center") for the systematic and effective support for persons with audiovisual disabilities.
(2) The center under paragraph 1 shall perform the following functions:
1. Discovery and consultation of persons with audiovisual disabilities;
2. Provision of convenience and care for persons with audiovisual disabilities;
3. Development and research of support systems and means for persons with audiovisual disabilities;
4. Other matters deemed necessary to support persons with audiovisual disabilities;
(3) If necessary for the efficient operation of the center, the Mayor may entrust all or part of the affairs to specialized institutions or organizations. In this case, necessary matters, such as the procedure and method of entrusting affairs, shall be in accordance with the Seoul Metropolitan Government Ordinance on the Administrative Work to the Private Sector.

Article 10 (Establishment and Operation of Committee) (1) The Mayor may establish and operate the Seoul Metropolitan Government Support Committee for Persons with Audiovisual Disabilities (hereinafter referred to as the “Committee”) to provide advice on guaranteeing rights and supporting policies for persons with audiovisual disabilities.
(2) The Committee shall provide advice on the following matters:
1. Matters concerning the establishment, implementation, and change of the basic plan and the implementation plan under Article 6;
2. Matters concerning the analysis and evaluation of the basic plans, implementation plans, and performance;
3. Matters concerning the implementation of support projects under Article 8;
4. Other matters determined by the Mayor regarding the guarantee of rights and support for persons with audiovisual disabilities.
(3) The committee shall consist of up to 10 members, including one chairperson and one vice chairperson, and the Mayor shall appoint one of the following persons:
1. Persons with audiovisual disabilities and their families;
2. Persons with considerable knowledge and experience in persons with audiovisual disabilities;
3. Members of the relevant standing committee recommended by the Seoul Metropolitan Council Chairman;
4. Public officials at the level of director or higher in departments related to support for the disabled in Seoul.
(4) Matters such as the duties of the chairperson, the term of office of the members, and the operation of the committee shall follow the Seoul Metropolitan Government Ordinance on Welfare Committee for the Disabled.

Article 11 (Establishment of Cooperation System) In order to provide comprehensive welfare services to persons with audiovisual disabilities, the Mayor shall strive to establish a close cooperative system with the central government, autonomous districts, organizations and facilities related to persons with audiovisual disabilities, and medical institutions.

Article 12 (Enforcement Rule) Matters necessary for enforcing this Ordinance shall be prescribed by rule of the Seoul Government

This Ordinance shall enter into force on the date of its promulgation.
