SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR SINGLE-PARENT FAMILIES

CHAPTER 1 GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to support projects such as education and medical care in order to stabilize the livelihood of single-parent families in Seoul and to strengthen their self-reliance capabilities and to stipulate measures necessary for the establishment and operation of single-parent family support centers.

Article 2 (Definitions) The terms used in this Ordinance shall be in accordance with the Single-Parent Family Support Act (hereinafter referred to as the "Act") and the Enforcement Decree of the same Act (hereinafter referred to as the "Enforcement Decree"). <Amended on Jan. 2, 2015>

Article 3 (Duties of the Mayor) The Mayor of Seoul (hereinafter referred to as the "Mayor") shall create necessary systems and conditions to promote the welfare of single-parent families and establish and implement policies for this purpose.

CHAPTER 2 SUPPORT FOR SINGLE-PARENT FAMILIES Article 4 (Target of Support) (1) The Mayor may support projects to stabilize the livelihood and strengthen the self-reliance capabilities of those who fall under each of the following subparagraphs: <Amended on May 16, 2013, Jan. 2, 2015, Jan. 5, 2017>
1. Persons subject to protection under the law;
2. Persons receiving protection from single-parent family welfare facilities prescribed by law or those using such facilities;
3. Other persons recognized by the Mayor as needing support.
(2) Persons receiving support under other laws may be excluded from this support.

Article 5 (Fact-Finding Research) The Mayor may conduct fact-finding research on the current status of single-parent families in order to establish policies under Article 3.

Article 6 (Support Project) The Mayor may support projects falling under each of the following subparagraphs to support single-parent families: <Amended on May 14, 2014, May 18, 2017, Jul. 16, 2020>
1. Education and PR projects to promote a better understanding of single-parent families;
2. Support projects for raising and educating children of single-parent families;
3. Projects to support health and medical services necessary for single-parent families;
4. Consultation and information provision projects for single-parent families;
5. Education and self-reliance support projects for adolescent single parents;
6. Support projects for the self-reliance and stabilization of the livelihood of unmarried mothers and their families;
7. Housekeeping support services for a work-life balance for single-parent families;
8. Crisis pregnancy/childbirth/raising support projects;
9. Education support project for public officials related to support for single-parent families;
10. Other projects recognized by the Mayor as requiring support.

Article 7 (Selection of Target of Support) (1) The target and level of support for single-parent families shall be determined by the Mayor within budgetary limits, taking into consideration the age, family composition, and income level of single-parent families. <Amended on Jan. 5, 2017>
(2) If the country provides the same support as a policy after the enforcement of this ordinance, the support under this Ordinance may be adjusted according to the country's level of support.

Article 8 (Confiscation) In case the recipient of support is a person who has been found to be subject to suspension of support due to not meeting the selection criteria for the relevant year or has received support through fraudulent means, the Mayor may confiscate all or part of the support amount already paid. In this case, the method and procedure for confiscation shall follow the examples of imposition and collection of local taxes and disposition on default.

Article 9 (Support for Private Organizations) The Mayor may subsidize all or part of the necessary expenses for institutions, organizations, or individuals conducting single-parent family support program or may support matters necessary for the performance of such tasks.

Article 9-2 (Single-parent Family Day) The Mayor may implement or support projects such as events that meet the purpose of Single-Parent Family Day under Article 5-4 of the Act.

CHAPTER 3 SEOUL SINGLE-PARENT FAMILY SUPPORT CENTER Article 10 (Installation and Function) (1) The Mayor may establish and operate the Seoul Single-Parent Family Support Center (hereinafter referred to as the "Center") to stabilize the livelihood and promote the welfare of single-parent families.
(2) The center shall perform the following functions: <Amended on May 14, 2014, Jan. 2, 2015, May 18, 2017.>
1. Support such as education and counseling for single-parent families;
2. Provision of information and promotion of support services for single-parent families;
3. Competency building support and service linkage for single-parent family welfare organizations;
4. Education and PR to improve awareness of single-parent families;
5. Provision of support services to promote the welfare of unmarried mothers and fathers;
6. Program development and dissemination project to support single-parent families;
7. Implementation of other projects determined by the Mayor to support single-parent families.

Article 11 (Organization and Composition) (1) The center shall have a head of the center who oversees the operation of the center and workers necessary for carrying out the single-parent family support project.
(2) The qualifications of the head of the center and workers under paragraph (1) shall be social workers or healthy family supporters with experience in the field of social welfare, and the detailed standards for qualifications for workers and matters necessary for the organization of the center shall be determined by the Mayor. <Amended on Jan. 5, 2017>

Article 12 (Operating Committee) (1) The center may organize and operate an operating committee if necessary to carry out the single-parent family support project by taking measures such as establishing a network with related organizations and activating information exchanges.
(2) The committee shall consist of up to 10 members, including the chairperson, and the chairperson shall be the head of the center, and the members shall be commissioned by the chairperson from among public officials in charge and persons with abundant knowledge and experience in the provision of family-related projects and services. <Amended on Jan. 5, 2017>
(3) Other matters necessary for the organization and operation of the committee shall be determined by the chairperson with the approval of the Mayor. <Amended on Jan. 5, 2017>

Article 13 (Entrustment of Operation) (1) The Mayor may entrust the center to a non-profit corporation under Article 32 of the Civil Act when it is necessary and recognized for the efficient operation of the center.
(2) In case of entrusting the operation of the center pursuant to paragraph 1, the entrusted person shall appoint or dismiss the center head with the approval of the Mayor, and the head of the center shall appoint or dismiss other workers and report it to the Mayor.<Amended on Jan. 2, 2015>
(3) The Seoul Metropolitan Government Ordinance on the Administrative Work to the Private Sector shall apply mutatis mutandis to other regulations related to private entrustment.<Amended on Jan. 5, 2017>

Article 14 (Support for Center) The Mayor may provide the administrative support necessary for the organization and activities of the center and may subsidize some or all of the expenses and business expenses necessary for the establishment and operation of the center within budgetary limits.

Article 15 (Report and Investigation) When it is deemed necessary in relation to the center's operation and office handling, the Mayor may have the center head report matters concerning the center's facilities and operation or have the relevant public officials inspect the center's books or documents.

Article 16 (Obligation to Maintain Confidentiality) Public officials and center employees who perform support for single-parent families shall not divulge any secrets they have learned in the course of their work, even after leaving their duties.

ADDENDUM <Ordinance No. 7619, Jul. 16, 2020>
This Ordinance shall enter into force on the date of its promulgation.
