SEOUL METROPOLITAN GOVERNMENT ON MISUSE AND ABUSE PREVENTION AND SAFETY OF NARCOTICS AND HARMFUL DRUGS

SEOUL METROPOLITAN GOVERNMENT ON MISUSE AND ABUSE PREVENTION AND SAFETY OF NARCOTICS AND HARMFUL DRUGS

Article 1 (Purpose) The purpose of this Ordinance is to prescribe measures regarding the misuse and abuse prevention and safety of narcotics and harmful drugs in order to protect citizens from misuse or abuse of narcotics and harmful drugs as prescribed in Article 2-2 (1) of the Narcotics Control Act and Article 5 (1) of the Youth Protection Act. <Amended on Jul. 16, 2020>

Article 2 (Definitions) (1) The terms used in this Ordinance are defined as follows:
1. The term "narcotics" refers to narcotics, psychotropic substances, and cannabis;
2. The term "treatment and protection" refers to hospital treatment and outpatient treatment for the rehabilitation of a narcotic addict as a healthy member of society by helping the addict overcome his or her psychological and physical dependence on narcotics and preventing a relapse;
3. The term “harmful drugs” refers to hallucinogenic substances as defined in the Chemical Substances Control Act, alcoholic beverages as defined in the Liquor Tax Act and tobacco as defined in the Tobacco Business Act;
(2) For other terms, definitions in the Narcotics Control Act and Youth Protection Act shall apply. <Amended on Jul. 16, 2020>

Article 3 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall endeavor to prevent the abuse of narcotics and other drugs in order to protect the mental and physical health of citizens from narcotics and harmful drugs and facilitate the treatment and protection of narcotic addicts and their return to society as well as prevent the abuse and misuse of harmful drugs.
(2) The mayor shall promote public health care projects necessary for research and investigation and education on drug prevention.

Article 4 (Formulation and Implementation of Prevention Plan) (1) The Mayor may formulate and implement a prevention plan (hereinafter referred to as the "prevention plan") every year for the prevention of misuse and abuse of narcotics and harmful drugs by citizens. <Newly Inserted on Jul. 16, 2020>
(2) The prevention plan may include the following: <Newly Inserted on Jul. 16, 2020>
1. Matters concerning treatment and protection projects for narcotic and hallucinogenic substance addicts;
2. Matters related to customized education on drug prevention and the danger of narcotics and hallucinogenic substances;
3. Matters concerning the financing of projects regarding drug misuse and abuse prevention and the safety of narcotics and hallucinogenic substances;
4. Matters related to the establishment of a cooperative system for misuse and abuse prevention and the safety of narcotics and hallucinogenic substances;
5. Other matters the Mayor deems necessary.

Article 5 (Treatment and Protection Projects) (1) The Mayor may promote the following projects for misuse and abuse prevention and the safety of narcotics and hallucinogenic substances:
1. Treatment and protection projects for narcotic and hallucinogenic substance addicts;
2. Life cycle customized prevention education and promotion projects for misuse and abuse prevention and the safety of narcotics and hallucinogenic substances;
3. Healthcare projects to protect citizens from narcotics and harmful drugs;
4. Development and evaluation of projects to foster and support specialized experts in prevention education for misuse and abuse prevention and the safety of narcotics and hallucinogenic substances;
5. Other projects the Mayor deems necessary.
(2) The Mayor may provide necessary administrative and financial support to medical institutions and organizations to enable them to carry out their professional projects under paragraph (1).

Article 6 (Duty of Confidentiality) No current or former person involved in projects for misuse and abuse prevention and the safety management of narcotics and hallucinogenic substances in accordance with this Ordinance shall disclose externally any matters which he or she has learned in the course of performing his or her duties. <Amended on Jul. 16, 2020>

Article 7 (Direction and Supervision) The Mayor shall direct and supervise specialized institutions that receive financial support in accordance with Article 5 and may order the submission of reports or related documents regarding their work when necessary. <Amended on Jul. 16, 2020>

Article 8 (International Narcotics Eradication Day Event) (2) The Mayor may grant an official commendation to any individual, institution, or organization that has made an outstanding contribution to prevent the misuse and abuse of narcotics and hallucinogenic substances of citizens on International Narcotics Eradication Day in accordance with paragraph (1), in accordance with the Seoul Metropolitan Government Ordinance on Official Commendation.
