Seoul Metropolitan Government Ordinance on Employment Improvement and Support for Domestic Workers

Article 1 (Purpose) The purpose of this Ordinance is to create quality jobs related to domestic services by regulating matters with regards to improving and supporting the employment of domestic workers, and to contribute to employment stability and the improvement of working conditions for domestic workers and the revitalization of domestic services.

Article 2 (Definitions) 1. “Domestic service” refers to performing tasks necessary for maintaining and managing a household, such as cleaning, laundry, kitchen work, and care and childcare of household members, in accordance with Article 2, Paragraph 1 of the Act on the Employment Improvement of Domestic Workers (hereinafter referred to as the “Act”).
2. “Domestic service provider” refers to a certified institution pursuant to Article 7 of the Act and provides domestic services pursuant to the Act.
3. “Domestic worker” refers to a person or persons who enter into a labor contract with an employer of a domestic service provider (an employer as defined in Article 2, Paragraph 1, Subparagraph 2 of the Labor Standards Act) and provides domestic services to users of domestic services as defined in Article 2, Paragraph 3 of the Act.
4. "Other housekeeping labor service workers" refers to individuals who are not domestic workers under Article 3 but provide housekeeping labor services and earn income through job placement under the Employment Security Act and related online platforms.

Article 3 (Scope of Application)

Article 4 (Duties of the Mayor) (1) The Seoul Metropolitan City Mayor (hereinafter referred to as the “Mayor”) shall endeavor to ensure employment stability, improve the rights and interests of domestic workers, and create jobs.
(2) The Mayor must strive to improve the working conditions of domestic workers and create a sound domestic service market.

Article 5 (Relationship with Other Ordinances) This Ordinance shall take precedence over other Ordinances in relation to the improvement and support of employment of domestic workers.

Article 6 (Basic Plan) (1) The Mayor shall establish and implement a basic plan every three (3) years that includes the following items to improve and support the employment of domestic workers. <Amended on May 22, 2023>
1. Goals and directions of the policy for improving and supporting employment of domestic workers
2. Sector-specific implementation strategies for improving employment and supporting domestic workers
3. Measures to secure the necessary financial resources to support domestic workers
4. Other matters deemed necessary by the Mayor
(2) The Mayor may establish the basic plan of Paragraph 1 by including it in the basic labor plan according to Article 7 of the Seoul Metropolitan Government Framework Ordinance on Labor.



Article 7 (Implementation Plan) (1) The Mayor shall establish and implement an implementation plan every year to improve and support the employment of domestic workers in accordance with the basic plan.
(2) The Mayor shall inspect and evaluate the progress of the implementation plan and reflect it in the implementation plan for the following year.

Article 8 (Fact-Finding Survey) (1) In cases where it is necessary to establish a basic plan pursuant to Article 6, the Mayor may conduct a fact-finding survey on the employment conditions and working environment of domestic workers and other housekeeping labor service workers in Seoul Metropolitan City. <Amended on Dec. 30, 2022>
(2) The Mayor may entrust a specialized institution with the fact-finding survey pursuant to Paragraph 1, and in this case, may support the necessary expenses within the scope of the budget.

Article 9 (Support Projects, Etc.) (1) The Mayor may implement the following projects to improve the employment of domestic workers and create a sound domestic service market.
1. Provision of advice and information necessary for the operation of domestic service providers, etc.
2. Support for education and training to improve the professionalism of domestic workers
3. Matters necessary for the rights and interests of domestic workers, such as handling grievance settlements and counseling
4. Other matters deemed necessary by the Mayor
(2) In cases where necessary for business pursuant of Paragraph 1, the Mayor may provide administrative and financial support within the scope of the budget.
(3) The Mayor may entrust specialized institutions with the promotion of the business pursuant of Paragraph 1.

Article 10 (Set up and Function of a Domestic Workers Support Center) (1) The Mayor may establish the Seoul Metropolitan Government Domestic Workers Support Center (hereinafter referred to as the “Center”) to protect and promote the rights and interests of domestic workers.
(2) The Center shall perform the following functions.
1. Fact-finding surveys on housekeeping labor, and research and development of policies
2. Legal and educational support for the rights and interests of domestic workers
3. Improving awareness of housekeeping labor and campaign activities
4. Support for improving working conditions for domestic workers
5. Projects related to housekeeping labor safety, health, and industrial accident prevention
6. Projects to build a cooperative system with labor rights and interests-related organizations and groups
7. Any other business deemed necessary by the Mayor to protect and promote the rights and interests of domestic workers
(3) The Mayor may entrust the operation of the Center to a related organization or corporation in accordance with the Seoul Metropolitan Government Ordinance on the Administrative Work to the Private Sector. In such cases, all or part of the Center's operating expenses may be supported within the scope of the budget.

Article 11 (Local Tax Reduction and/or Exemption) The Mayor may reduce local taxes for domestic service providers under Article 2, Paragraph 2 and domestic service users under Article 2, Paragraph 3 of the Act, in accordance with the Act on Restriction on Special Cases Concerning Local Taxation and other tax-related laws or ordinances.

Article 12 (Establishment of the Committee) (1) The Mayor may establish a Seoul Metropolitan Government Domestic Workers Employment Improvement and Support Committee (hereinafter referred to as the “Committee”) to deliberate and advise on the following matters regarding domestic workers. <Amended on Dec. 30, 2022>
1. Matters concerning the establishment of plans pursuant to Articles 6 and 7
2. Matters concerning the fact-finding survey pursuant to Article 8
3. Matters concerning the promotion of support projects pursuant to Article 9
4. Other matters deemed necessary by the Chairperson during related meetings
(2) In the case where a subcommittee on domestic workers is established within the Seoul Metropolitan City Workers’ Rights Protection Committee pursuant to the Seoul Metropolitan Government Framework Ordinance on Labor, the Mayor may have it perform the functions of the Committee pursuant to Paragraph 1

Article 13 (Organization of the Committee) (1) The Committee shall be composed of no more than ten (10) members, including one (1) Chairperson and one (1) Vice Chairperson. <Amended on May 22, 2023>
(2) The Chairperson and Vice Chairperson shall be elected from among the members.
(3) The ex officio members shall be the heads of departments in charge of work related to improving and supporting the employment of domestic workers, and the appointed members shall be appointed by the Mayor from among those with extensive knowledge and experience in the field of improving and supporting the employment of domestic workers. However, a specific gender must not exceed six (6) of the ten (10) appointed members.
(4) The term of office for appointed members shall be two (2) years, and they may be reappointed only once.
(5) To ensure smooth progress of the Committee’s work, one (1) secretary shall be appointed.

Article 14 (Operation of the Committee) (1) The Chairperson shall represent the Committee and oversee its affairs.
(2) When the Chairperson is unable to perform their duties due to unavoidable reasons, the Vice Chairperson shall act on behalf of the Chairperson.
(3) The Committee meetings shall be convened by the Chairperson; regular meetings shall be held once a year and special meetings shall be held when necessary.
(4) The Committee meetings shall begin when a majority of registered members are present and resolved by vote of a majority of the members present.
(5) Matters concerning the composition and operation of the Committee that are not provided for in this Ordinance shall be governed by the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Various Committees.

Article 15 (Cooperation System)


Article 16 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Metropolitan Government.

Addendum (Seoul Metropolitan Government Framework Ordinance on Labor) <No. 8752, May 22, 2023>
Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of promulgation.
Articles 2 and 3 Omitted
Article 4 (Amendment of Other Ordinances) (1) Part of the Seoul Metropolitan Government Ordinance on Employment Improvement and Support for Domestic Workers is revised as follows:
In Article 6, Paragraph 1, in the part other than each item, “five (5) years” is changed to “three (3) years.”
In Article 13, Paragraph 1, “fifteen (15) people” is changed to “ten (10) people.”
