SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR THE PROTECTION OF INTOXICATED PERSONS

Article 1 (Purpose) The purpose of this Ordinance is to determine the matters concerning the protection of intoxicated persons, and the provision of protective facilities for such persons, in order to keep them safe from harm and contribute to public safety and welfare


Article 1-2 (Fundamental Principle) The Seoul Metropolitan City Mayor (hereinafter referred to as the “Mayor”) shall respect the human rights of intoxicated persons in protecting them, and shall prevent infringements of their human rights such as willful acts of violence or the undue use of force.

Article 2 (Definition) The definitions of the terms used in this Ordinance shall be as follows:
1. "Intoxicated person" refers to a person whose judgment and physical bodily functions are impaired by the consumption of alcohol, such that they require help from others.
2. "Protective facility for intoxicated persons" is a facility capable of taking custody of an intoxicated person as provided under the foregoing subparagraph 1 for up to 24 hours to ensure their physical and psychological stability, in cases where the intoxicated person is unconscious, unsteady, or cannot be handed over to a guardian.



Article 3 (Responsibilities of the Mayor) The Mayor may formulate and implement comprehensive policies necessary for the protection of intoxicated persons, and may provide the necessary administrative and financial support.<Amended on Jul. 14, 2025>



Article 4 (The Formulation and Execution of Implementation Plans) Every two years the Mayor shall formulate and execute plans for the protection of intoxicated persons, including the following:
1. Policies necessary for the protection of intoxicated persons;
2. Establishment of a reporting system for the protection of intoxicated persons;
3. Establishment and operation of cooperative systems with the relevant administrative agencies, corporations, organizations, etc. for the protection of intoxicated persons;
4. Other measures deemed necessary by the Mayor for the protection of intoxicated persons.



Article 5 (Establishment of Protective Facilities for Intoxicated Persons, Etc.) (1) For the protection of intoxicated persons, the Mayor may establish and operate protective facilities for intoxicated persons in consultation with the Seoul Metropolitan Police Agency (hereinafter referred to as the “Police Agency”), medical institutions, etc. to perform the following duties:<Amended on Jul. 14, 2025>
1. Evaluate whether a person is eligible for protection as an intoxicated person;
2. Accept, protect, and manage intoxicated persons;
3. Notify and hand over an intoxicated person to another person(s) with whom he or she has a close connection, such as a family member(s) or friend(s);
4. Transfer to an emergency medical institution and request treatment, if medical treatment is necessary or indicated;
5. Other matters necessary for the protection of intoxicated persons and the prevention of harm.
(2) The Mayor may entrust part of the management and operation of protective facilities for intoxicated persons under paragraph (1) to the relevant institutions, corporations, or organizations to ensure the efficiency of such management and operations.
(3) The entrustment of affairs under paragraph (2) shall conform with the Seoul Metropolitan Government Ordinance on the Entrustment of Administrative Affairs to the Private Sector.



Article 6 (Establishment of Cooperative Systems) (1) The Mayor shall liaise and cooperate with the relevant institutions, including police agencies, fire agencies, and medical institutions, to ensure the effective protection of intoxicated persons.
(2) The Mayor may conclude a memorandum of understanding for cooperation on establishing systems of liaison and cooperation, etc. as provided under paragraph (1).



Article 7 (Confidentiality) Any person who has engaged in or presently engages in duties relating to the protection of intoxicated persons under this Ordinance shall not disclose confidential information acquired in the course of performing such duties, and shall comply with the provisions of the Personal Information Protection Act.



Article 8 (Enforcement Rule) The matters necessary for the enforcement of this Ordinance may be determined by Enforcement Rule.

This Ordinance shall enter into force on the date of its promulgation.
