SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON REMOVAL OF SNOW OR ICE BY BUILDING MANAGERS

Article 1 (Purpose) The purpose of this Ordinance is to provide further detail for matters regarding removal of snow and ice by building managers pursuant to Article 27 of the Countermeasures against Natural Disasters Act in order to minimize citizens’ inconvenience caused by snow or ice and promote their safety.

Article 2 (Definitions) Terms used in this Ordinance shall be defined as follows:
1.The term “sidewalk” means a path with its border indicated with a curb line (referring to a line of stones or the like, laid alongside a road in order to divide the road into lanes for vehicles and a sidewalk), safety signs, and other similar structures for the traffic of pedestrians (including baby carriages and wheelchairs for physically-disabled persons);
2.The term “back road” means a road used for traffic (excluding national expressways, national highways, Seoul metropolitan roads, and regional roads under the Road Act) with no division between lanes for vehicles and sidewalks and with a width of less than 12 meters;
3.The term “road for exclusive use by pedestrians” means a road indicated with safety signs and structures similar thereto, for the exclusive traffic of pedestrians;
4.The term “residential building” means a building only for residential purpose;
5.The term “non-residential building” means any building other than residential buildings;
6.The term “removal of snow or ice” means works for removing snow or ice from a sidewalk, a back road, or a road for exclusive use by pedestrians or removing obstacles to pedestrian and vehicle traffic by applying materials melting snow or ice or using sand or similar materials.

Article 3 (Priority of Responsibility for Removal of Snow or Ice) The priority of building managers’ responsibility for removal of snow or ice shall be as prescribed in the following subparagraphs: Provided, That the priority agreed between the owner, occupants, and manager of a building shall be enforced, if such priority has been agreed:
1.If the owner of a building resides in his/her building, the priority shall be in the order of the owner, the occupants, and the manager of such building;
2.If the owner of a building does not reside in his/her building, the priority shall be in the order of the occupants, the manager, and the owner of such building.

Article 4 (Extent of Removal of Snow or Ice) The extent to which a building manager shall remove snow or ice shall be as follows:
1.Sidewalk: The section that abuts onto the site of a building;
2.Back roads and roads for exclusive use by pedestrians:
(a) For a residential building: The section within one meter from the boundary line of a building site at the main entrance of the building thereon;
(b) For a non-residential building: The section within one meter from the boundary line of the site of the building.

Article 5 (Time to Remove Snow or Ice) Each building manager shall completely remove snow or ice by the deadline prescribed as follows: Provided, That if the depth of snow that has fallen during one day is ten centimeters or deeper, the deadline shall be 24 hours from the time snowfall stops:
1.By not more than four hours from the time when snowfall stops, if it has snowed during daytime;
2.By 11:00 a.m. the following day, if it has snowed during nighttime.

Article 6 (Method for Removal of Snow or Ice) Each building manager shall remove snow and ice in the following manners by using shovels, brooms, and other tools to ensure to eliminate obstacles to safe traffic of pedestrians and vehicles:
1.Snow or ice on a sidewalk: To be removed to the edges of the sidewalk, empty lots, or another appropriate area;
2.Snow or ice on a back road or a road for exclusive use by pedestrians: To be removed to the central section of the road, empty lots, or another appropriate area;
3.If it is difficult to remove ice, a material melting ice or sand shall be used, and the sand so used shall be cleared after ice melts.

Article 7 (Keeping of Equipment for Removal of Snow or Ice) Each building manager shall keep and maintain equipment necessary for the removal of snow or ice in the relevant building.

ADDENDUM
This Ordinance shall enter into force on the date of its promulgation.
