SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF SMALL AND MEDIUM BUSINESS SUPPORT FACILITIES

CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to support and promote the establishment and development of small and medium enterprises which are located in the Seoul Metropolitan City pursuant to Article 9 (2) 3 of the Local Autonomy Act and Article 3 (2) of the Framework Act on Small and Medium Enterprises, as well as to contribute to the vitalization of the regional economy by the Seoul Metropolitan Government, by providing for matters necessary for the establishment and operation of the small and medium enterprise support facilities of the Seoul Metropolitan Government. <Amended by Ordinance No. 5623, Jan. 9, 2014; Ordinance No. 6386, Jan. 5, 2017; Ordinance No. 6872, May 3, 2018>

Article 2 (Scope of Application) (1) This Ordinance shall apply to supporting and fostering small and medium enterprises implemented by the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") and institutions invested or funded by the Seoul Government.
(2) Except as otherwise provided in other statutes, regulations, or Ordinances of the Seoul Government, this Ordinance shall apply. <Amended by Ordinance No. 6386, Jan. 5, 2017>

Article 2-2 (Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall formulate and implement policies for supporting and fostering small and medium enterprises.
(2) The Mayor shall endeavor to increase and strengthen small and medium enterprise support facilities of the Seoul Metropolitan Government in order to support the establishment, development, and markets of small and medium enterprises.

CHAPTER II ESTABLISHMENT AND OPERATION OF SMALL AND MEDIUM ENTERPRISE SUPPORT FACILITIES OF THE SEOUL METROPOLITAN GOVERNMENT Article 3 (Establishment of Small and Medium Enterprise Support Facilities of the Seoul Metropolitan Government) (1) The Mayor may establish and operate small and medium enterprise support facilities of the Seoul Metropolitan Government (hereinafter referred to as "support facilities") to stimulate the regional economy.
(2) The support facilities shall conduct the following duties: <Newly Inserted by Ordinance No. 6221, May 19, 2016>
1. Matters concerning support for establishing small and medium enterprises;
2. Matters concerning fostering and supporting small and medium enterprises;
3. Matters concerning research and development related to small and medium enterprises;
4. Matters concerning promoting the purchase of products manufactured by small and medium enterprises and providing support for their markets;
5. Matters concerning offering information sessions, consultation sessions, and education related to small and medium enterprises;
6. Other matters necessary for supporting and fostering small and medium enterprises.
(3) The names and functions of the support facilities established under paragraphs (1) and (2) shall be as specified in the attached Table, and the locations thereof shall be publicly notified by the Mayor. <Amended by Ordinance No. 6221, May 19, 2016>

Article 4 (Principles of Management and Operation) In managing and operating the support facilities, the Mayor and any person entrusted with such management and operation under Article 5 (1) shall do so in a manner consistent with the purpose of establishing those facilities. <Amended by Ordinance No. 6386, Jan. 5, 2017>

Article 5 (Entrustment of Management and Operation) (1) The Mayor may entrust any other administrative agency, juristic person, organization or individual belonging thereto capable of managing and operating support facilities with such management and operation for the efficient operation, such as securing expertise in management and operation.

6. Seoul Fashion Design Center;
7. Seoul Printing Center;
8. Seoul Design Center;

10. DMC (Digital Media City) High-Tech Industry Center.
(3) Articles 7 through 13 and Articles 15 through 19 of the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector shall apply mutatis mutandis to the procedures, methods, etc. necessary for the entrustment of management and operation of support facilities under paragraph (1). <Amended by Ordinance No. 4818, Jul. 30, 2009; Ordinance No. 6386, Jan. 5, 2017>

Article 6 (Operating Committee) (1) Any person who is entrusted with the management and operation of support facilities may organize and operate an operating committee for each support facility to deliberate on the following matters relating to management and operation: <Amended by Ordinance No. 6386, Jan. 5, 2017>
1. Matters concerning the budget and final accounts;
2. Matters concerning the establishment and implementation of the master plan for the management and operation of support facilities;

4. Other matters which are deemed necessary for the management and operation of support facilities and referred to the relevant operating committee for deliberation.
(2) Except as provided in paragraph (1), matters necessary for the organization and operation of the operating committees shall be determined by a person who is entrusted with the management and operation of support facilities with the approval from the Mayor.

CHAPTER III FOSTERING SMALL AND MEDIUM ENTERPRISES Article 7 (Formulating Policies for Small and Medium Enterprises and Fostering Plan therefor) (1) The Mayor shall establish a policy for small and medium enterprises under Article 3 (2) of the Framework Act on Small and Medium Enterprises and a plan to promote small and medium enterprises under Article 62-15 of the Small and Medium Enterprises Promotion Act (hereinafter referred to as "policy and promotion plan") for the following year, by December 31 of each year. <Amended by Ordinance No. 6872, May 3, 2018>
(2) The policy and the promotion plan for the following year under paragraph (1) shall reflect the implementation outcomes and analysis of the policy and the promotion plan for the preceding year.
(3) The Mayor may temporarily establish and operate a consultative body or council to formulate the policy and the promotion plan under paragraph (1).
(4) The members of a consultative body or council under paragraph (3) shall not exceed 10 and may include two members of the Seoul Metropolitan Council and at least two persons recommended by associations related to small and medium enterprises.
(5) When formulating the policy and the promotion plan, the Mayor shall conduct a status and fact-finding survey of small and medium enterprises located in the Seoul Metropolitan City every year, and shall report the outcomes of the survey to the competent standing committee. <Newly Inserted by Ordinance No. 6872, May 3, 2018>
(6) The Mayor shall make public the policy and the promotion plan under paragraph (1) on the website of the Seoul Government immediately after they are finalized. <Amended by Ordinance No. 6872, May 3, 2018>

Article 8 (Protecting Local Small and Medium Enterprises) The Mayor shall proactively endeavor to preferentially purchase goods manufactured by local small and medium enterprises by means of local priority regulations, etc., when producing or purchasing goods priced less than publicly notified by the Minister of the Interior and Safety under Article 5 (1) of the Act on Contracts to Which a Local Government Is a Party, to the extent of not affecting the prices, quality, and supply and demand of goods, to protect local small and medium enterprises; and shall include the locations of contractors in publishing the contract status. <Amended by Ordinance No. 6386, Jan. 5, 2017; Ordinance No. 6851, Mar. 22, 2018>

Article 9 (Support for Organizations Related to Small and Medium Enterprises) The Mayor may support projects implemented by organizations related to small and medium enterprises to promote business management of small and medium enterprises and to encourage independent economic activities of small and medium entrepreneurs, within budgetary limits.

Article 10 (Enforcement Rules) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Government.

ADDENDA
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Transitional Measures concerning Establishment and Management on Consignment of Support Facilities)
The facilities related to the support for small and medium enterprises established, and managed and operated by entrusted entities, under the Seoul Metropolitan Government Ordinance on Establishment of Public Facilities and the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector before this Ordinance enters into force, shall be deemed facilities established under this Ordinance and managed and operated under this Ordinance for the relevant entrustment period.
Article 3 (Transitional Measures concerning Permission for Use)
A person who obtained permission to use support facilities in accordance with related regulations, such as the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector and the Seoul Metropolitan Government Ordinance on Public Property Management, shall be deemed conferred with such permission until its expiry date.
