SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR ECO-FRIENDLY MILEAGE

Article 1 (Purpose) The purpose of this Ordinance shall be to prescribe matters necessary for Seoul Metropolitan City to operate and manage environment-friendly mileage, so that the emission of greenhouse gases and air pollutants shall be reduced by inducing citizens to practice environment-friendly lives on a voluntary basis. <Amended on Jul. 11, 2022>


Article 2 (Definitions) The terms used in this Ordinance are defined as follows: <Amended on Jul. 11, 2022>
1. The term "environment-friendly mileage" refers to a generic name of programs that induce the practice of environment-friendly lives and include echo mileage, motor vehicle mileage, and green practice mileage;
2. The term "echo mileage" refers to citizen participation programs that incentivize, in a form of mileage, energy savings, such as electricity, water supply and waterworks, urban gas, district heating, etc.;
3. The term "motor vehicle mileage" refers to citizen participation programs that incentivize depending on the voluntary reduction of motor vehicle mileage by citizens;
4. The term "green practice mileage" refers to support programs that incentivize the practice of environment-friendly lives, such as reduction or recycling of waste, use of bicycles, use of public transportation, etc. other than echo mileage and motor vehicle mileage;


Article 3 (Basic Duties) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall actively endeavor to enforce the relevant policy and promote environment-friendly mileage in order to reduce greenhouse gases and air pollutants through the practice of environment-friendly lives by citizens. <Amended on Jul. 11, 2022>
(2) The Mayor shall actively promote climate change policies through collecting opinions and consulting from various fields such as citizens, civic groups, and related experts.
(3) Autonomous Gu heads shall actively cooperate to efficiently promote environment-friendly mileage. <Amended on Jul. 11, 2022>
(4) Citizens shall endeavor to reduce greenhouse gas emissions and air pollutants generated in daily life, and cooperate with the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") or an autonomous Gu's climate change policy.


Article 4 (Objects of Application) (1) Echo mileage shall be applied to the following: individual members, such as the general public; or members of business associations, such as a multi-family housing complex, school, business, micro enterprise, religious facility, etc.
(2) Motor vehicle mileage shall be applied to the following: passenger vehicles or motor vehicles for passengers and freight with 12-seater or less registered as non-commercial in the City; and owners thereof. However, motor vehicles owned by corporations or organizations, rental cars, commercial motor vehicles, etc. shall be excluded.
(3) Green practice mileage shall be applied to individual members or institutional members that apply to participate in environment-friendly activities, such as reduction and/or recycling of waste, use of bicycles, use of public transportation, etc. <Newly Inserted on Jul. 11, 2022>

Article 5 (Application for Participation) (1) Participation in echo mileage and motor vehicle mileage may be filed, at the discretion of participants, directly through websites or in person at community service centers or in the relevant departments of the autonomous Gu.
(2) In case of the motor vehicle mileage, only the owner of a motor vehicle may file an application for participation through websites. On the other hand, the owner of a motor vehicle or his/her family members may file an application for participation at the relevant organizations.
(3) In case of the green practice mileage, an application for participation may be filed and an activity therefor may be conducted by signing up a website for environment-friendly activity participation programs, linking mileages, or using other methods, etc. <Newly Inserted on Jul. 11, 2022>


Article 6 (Application for Withdrawal) (1) A participant in the echo mileage, motor vehicle mileage, or green practice mileage may withdraw directly through websites. <Amended on Jul. 11, 2022>
(2) Withdrawal from driving mileage on the website shall be applied only by the vehicle owner, and withdrawal by a visit to the relevant institution may be applied by either the vehicle owner or the owner's family member.
(3) Where it is verified that a participant in the motor vehicle mileage is incentivized by dishonest means, such as intention, gross negligence, etc., he/she may be withdrawn ex officio. <Amended on Jul. 11, 2022>


Article 7 (Operation of Eco-Mileage Program) (1) The Mayor may provide information and technology for energy saving to individuals and business group members participating in eco-mileage and may provide incentives such as mileage through evaluation.
(2) The Mayor may provide shopping bags, promotional materials and promotional supplies to citizens to induce participation in energy saving.
(3) The Mayor may establish an eco-mileage management system to systematically operate and manage eco-mileage participants, etc.
(4) The Mayor may clawback the incentives obtained by an eco-mileage participant through improper means with intent, gross negligence or the like.


Article 8 (Operation of Driving Mileage Program) (1) The Mayor may provide incentives such as mileage to members of a driving mileage program who cooperate with reduction of vehicle mileage and restrictions on driving.
(2) The Mayor may provide promotional materials and promotional supplies to citizens to induce participation in a driving mileage program.
(3) For systematic management of a driving mileage program, a driving-mileage management system may be established and operated.
(4) Where a participant of driving mileage program obtains incentives by improper means with intent or gross negligence, the incentives may be clawed back.


Article 9 (Operation of Green Practice Mileage) (1) The Mayor may provide information and technology for environment-friendly life practice activities for individuals, organizations, etc. that participate in the green practice mileage. Also, the Mayor may provide incentives, such as mileage, through assessment.
(2) The Mayor may provide citizens with promotional materials, goods, etc. to induce them to live environment-friendly lives.
(3) The Mayor may develop and operate management systems, such as green practice mileage website, to be able to systematically manage the practice of environment-friendly lives.
(4) Where a participant in the green practice mileage is incentivized by dishonest means, such as intention, gross negligence, etc., the Mayor may redeem the incentives so provided.

Article 10 (Integrated Operation of Mileage) (1) The Mayor may integrate and operate environment-friendly mileages, such as echo mileage, motor vehicle mileage, green practice mileage, etc.
(2) The Mayor may develop management systems, such as the website for the integration and use of environment-friendly mileages, such as echo mileage, motor vehicle mileage, green practice mileage, etc.
(3) The Mayor may separately determine details of budget execution, mileage conversion, etc. according to the integration of echo mileage, motor vehicle mileage, green practice mileage, etc.

Article 11 (Financial Support) (1) The Mayor may provide administrative and financial support for the promotion of environment-friendly mileage by the autonomous Gu. <Amended on Jul. 11, 2022>
(2) The Mayor may reward citizens, organizations, public officials, and agencies that contribute to the promotion of environment-friendly mileage. Procedures for reward shall be governed by the Seoul Metropolitan Government Ordinance on Citations. <Amended on Jul. 11, 2022>

Article 12 (Education and Public Relations) The Mayor shall devise various policies for the improvement of awareness of citizens and the diffusion of voluntary practice culture that are necessary for the promotion of environment-friendly mileage. <Amended on Jul. 11, 2022>

ADDENDA
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Transitional Measures)
All benefits for participants of the no driving day system enrolled prior to the enforcement of this Ordinance shall expire six months from the enforcement date of this Ordinance: Provided, That in the case of autonomous Gus, related ordinances or regulations of the autonomous Gus shall govern.
Article 3 (Repeal of Other Ordinances of Seoul Government)
The Seoul Metropolitan Government Ordinance on Support for Weekly No-Driving Day Program and Driving Mileage Program shall be repealed.
ADDENDA <Ordinance No. 7472, Jan. 9, 2020>
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Transitional Measures)
All benefits provided for participants in the car-free day campaign who signed up prior to the enforcement of this Ordinance shall be terminated from the date 6 months therefrom. However, in case of an autonomous Gu, its own ordinance, regulation, etc. shall govern.
Article 3 (Abolition of Other Ordinances)
This is abolished by the Seoul Metropolitan Government Ordinance on Support for the Car-Free Day Campaign and Motor Vehicle Mileage.
ADDENDA <Ordinance No. 8434, Jul. 11, 2022>
This Ordinance shall enter into force on the date of its promulgation.
