Article 1 (Purpose)
The purpose of this Ordinance is to contribute to the efficient conservation and development of the Seoul Special Metropolitan City by prescribing matters necessary for the comprehensive and systematic improvement and management of the urban landscape of the City.

CHAPTER I GENERAL PROVISIONS
Article 1 (Purpose)
The purpose of this Ordinance is to contribute to efficiently conserving and developing the Seoul Metropolitan City by providing for matters necessary for improving and managing urban design of the Seoul Metropolitan City comprehensively and systematically.

Article 2 (Definitions)

Article 3 (Urban Design Master Plans)
(1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall formulate and implement an urban design master plan for the Seoul Special Metropolitan City (hereinafter referred to as "urban design master plan") on a five-yearly basis in order to comprehensively and systematically improve and manage urban design. <Amended by Ordinance No. 4765, Apr. 22, 2009>

Article 3 (Duties of Mayor)
The Mayor shall formulate and implement a comprehensive plan to create safe and pleasant urban spaces, etc., reflecting opinions of citizens.

Article 4 (Establishment of Design Seoul Guidelines)
(1) The Mayor shall establish the Design Seoul Guidelines for the comprehensive and systematic improvement and management of the urban landscape. <Newly Inserted by Ordinance No. 4765, Apr. 22, 2009>

Article 4 (Relationship with other Ordinance)
Except as otherwise expressly provided for in other ordinances, this Ordinance shall apply to urban design for conserving and improving urban spaces, etc.

Article 5 (Certification of Outstanding Public Designs, etc.)
(1) The Mayor may take necessary measures, such as the operation of a system for the certification of outstanding public designs, in order to facilitate the development and dissemination of public designs. <Newly Inserted by Ordinance No. 4765, Apr. 22, 2009>

CHAPTER II FORMULATION, ETC. OF BASIC URBAN DESIGN PLAN
Article 5 (Basic Principles for Urban Design)
Urban design shall be planned and managed under any of the following principles:

Article 6 (Cooperation with Related Agencies)
(1) The Mayor may request related agencies to formulate measures necessary for the promotion of urban design in order to ensure smooth implementation of urban design and may provide budgetary and administrative assistance for such purpose. <Amended by Ordinance No. 4765, Apr. 22, 2009>

Article 6 (Formulation of Basic Urban Design Plan)
(1) Every five years, the Mayor shall formulate and implement basic urban design plans of the Seoul Metropolitan City (hereinafter referred to as "basic urban design plans") to improve and manage urban design in a comprehensive and systematic manner.

Article 7 (Establishment of Committee)
(1) There is hereby established a Seoul Citizen Design Committee (hereinafter referred to as the "Committee") under the jurisdiction of the Mayor to deliberate on the following matters concerning the promotion of urban design: <Amended by Ordinance No. 4765, Apr. 22, 2009; Ordinance No. 5164, Sep. 29, 2011>

Article 7 (Formulation of Urban Design Guidelines)
(1) The Mayor shall formulate urban design guidelines to improve and manage urban design comprehensively and systemically.

Article 8 (Composition of Committee)

CHAPTER III URBAN DESIGN PROJECTS, ETC.
Article 8 (Urban Design Projects)
(1) The Mayor may implement urban design projects in accordance with basic urban design plans.

Article 8-2 (Abstention and Withdrawal of Committee Members)
(1) The Committee shall have a Committee member in any of the following cases abstain from deliberation and advisory service on the case at issue:

Article 8-3 (Dismissal of Committee Members)
If a Committee member falls under any of the following cases, the Mayor may dismiss him/her from office even before the expiration of his/her term of office, and the term of office for a Committee member newly commissioned to fill a vacancy shall be the remainder of his/her predecessor's term:

Article 9 (Chairperson's Duties)
(1) The chairperson of the Committee shall represent the Committee and shall preside over its affairs. <Amended by Ordinance No. 4765, Apr. 22, 2009; Ordinance No. 5164, Sep. 29, 2011>

Article 9 (Certification of Excellent Public Design)
(1) The Mayor may take necessary measures, such as operating excellent public design certification system, in order to promote developing and disseminating public design.

Article 10 (Meetings)
(1) Whenever the chairperson of the Committee deems it necessary, he/she shall convene a meeting and shall preside over the meeting. <Amended by Ordinance No. 4765, Apr. 22, 2009>

Article 10 (Cooperation from Relevant Institutions)
(1) The Mayor may request related institutions to formulate measures necessary for implementing urban design to ensure smooth implementation of urban design; and may provide budgetary and administrative support accordingly.

Article 11 (Working Committees)
(1) The chairperson of the Committee shall establish three working committees under the Committee to efficiently conduct affairs of the Committee.

CHAPTER IV DELIBERATION ON URBAN DESIGN
Article 11 (Timing for Deliberating on Urban Design)
If necessary for deliberation by the Seoul Urban Design Committee pursuant to subparagraphs 4 and 5 of Article 13, an application for deliberation shall be filed before preliminary design is completed under Article 71 of the Enforcement Decree of the Construction Technology Promotion Act: Provided That, where construction documents are prepared including the details of a basic design plan, an application shall be filed before the construction documents are completed.

Article 12 (Keeping Minutes of Meetings, etc.)
The Committee shall prepare and keep minutes of meetings or written deliberations and resolutions and may assign stenographers to prepare minutes of meetings. <Amended by Ordinance No. 4765, Apr. 22, 2009>

Article 12 (Deliberative Procedures for Urban Design)
(1) Upon receipt of an application for deliberation, the Mayor shall submit the agenda item(s) for deliberation to the Seoul Urban Design Committee and notify the relevant applicant of the outcomes thereof.

Article 13 (Requests for Cooperation)
If necessary for performing duties, the Committee may require a related public officer, an appropriate expert, or an interest party to attend a meeting to hear his/her opinion or request a related agency, organization, etc. to submit necessary data.

CHAPTER V URBAN DESIGN COMMITTEE
Article 13 (Establishment of Committee)
The Mayor shall establish the Seoul Urban Design Committee (hereinafter referred to as "Committee") to deliberate on the following:

Article 14 (Allowances)
Committee members, experts, etc. who attend a meeting of the Committee may be reimbursed for actual expenses, including allowances and travel expenses, within budgetary limits: Provided, That the foregoing shall not apply to public officials who attend a meeting in direct connection with their duties. <Amended by Ordinance No. 4765, Apr. 22, 2009>

Article 14 (Composition of Committee)
(1) The Committee shall be comprised of at least 15 but not exceeding 25 members, including one chairperson and one vice chairperson, considering gender equality.

Article 15 (Detailed Rules for Operation)
Except otherwise prescribed by this Ordinance, matters concerning the operation of the Committee and the working committees shall be determined by the Chairperson of the Committee following resolutions by the Committee. <Amended by Ordinance No. 4765, Apr. 22, 2009; Ordinance No. 5001, Jul. 15, 2010; Ordinance No. 5164, Sep. 29, 2011>

Article 15 (Term of Office for Members)
The term of office for commissioned members shall be two years, and their term may be renewable for only one further term: Provided That, the term of office of a member filling a vacancy shall be the remainder of his/her predecessor's term of office.

Article 16 (Exclusion and Recusal of Members)
(1) The Committee shall exclude any of the following members from relevant deliberation and advice:

Article 17 (Dismissal of Members)
The Mayor shall dismiss any of the following members from office even before the term of office of such members ends; and the term of office of a member filling a vacancy shall be the remainder of his/her predecessor's term of office:

Article 18 (Duties of Chairperson)
(1) The chairperson shall represent the Committee and administer its affairs.
|
|
Article 19 (Meeting)
(1) If deemed necessary, the chairperson shall convene and preside over meetings of the Committee.
|
|
Article 20 (Keeping of Minutes, etc.)
The Committee shall prepare and keep meeting minutes of or written resolution by the Committee and may allow a stenographer to take stenographic notes of the minutes.

Article 21 (Requests for Cooperation)
If deemed necessary to perform its duties, the Committee may require relevant public officials, experts, or stake holders, etc. to attend its meetings and present their opinions, or require relevant institutions or organizations, etc. to submit necessary documents.

Article 22 (Allowance)
Allowances and travel expenses may be reimbursed to members and experts, etc. who participate in a Committee meeting, within budgetary limits: Provided That, this shall not apply where a public official participates therein in direct relation with his/her duty.

Article 23 (Operational Regulations)
Except as otherwise expressly provided for in this Ordinance, matters necessary for the operation of the Committee shall be determined by the chairperson of the Committee upon resolution passed by the Committee.
