SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON ENCOURAGEMENT AND SUPPORT OF BLOOD DONATION

Article 1 (Purpose) The purpose of this Ordinance is to provide for matters necessary to encourage blood donation activities with a view to promoting blood donation among citizens to protect the life and health of citizens pursuant to Article 2 (2) of the Enforcement Decree of the Blood Management Act.

Article 2 (Definitions) The definitions of terms used in this Ordinance shall be as follows:
1.The term “activity to encourage blood donation” means any activity that is carried out to encourage healthy citizens to donate their blood in accordance with Article 4 (1) of the Blood Management Act and Article 2 (2) of the Enforcement Decree of the same Act;
2.The term “encouragement of and support for blood donation” means any activity that is performed to ensure stable blood supply by engendering in citizens a spirit of donating blood and promoting blood donation among them through activities to encourage blood donation;
3.The term “volunteer services to encourage blood donation” means any non-remunerated activities to encourage blood donation that are carried out by any individual or organization by providing their time and effort on their own initiative to promote blood donation.

Article 2 (Definitions) The definitions of terms used in this Ordinance shall be as follows: <Amended by Ordinance No. 5815, Jan. 2, 2015; Ordinance No. 6386, Jan. 5, 2017>
1. The term "activity to encourage blood donation" means any activity that is carried out to encourage healthy citizens to donate their blood in accordance with Article 4 (1) of the Blood Management Act and Article 2 (2) of the Enforcement Decree of the same Act;
2. The term "encouragement of and support for blood donation" means any activity that is performed to ensure stable blood supply by engendering in citizens a spirit of donating blood and promoting blood donation among them through activities to encourage blood donation;
3. The term "volunteer services to encourage blood donation" means any non-remunerated activities to encourage blood donation that are carried out by any individual or organization by providing their time and effort on their own initiative to promote blood donation.

Article 3 (Seoul Metropolitan Government Mayor’s Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”) shall develop and implement policies necessary to help citizens actively participate in blood donation.
(2) The Mayor shall endeavor to engender in citizens a spirit of donating blood and encourage citizens to donate their blood by actively cooperating in activities to encourage blood donation that are carried out by the Korean National Red Cross under the Organization of the Korean National Red Cross Act and the blood center under Article 6 of the Blood Management Act.

Article 3 (Seoul Metropolitan Government Mayor's Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall develop and implement policies necessary to help citizens actively participate in blood donation.
(2) The Mayor shall endeavor to engender in citizens a spirit of donating blood and encourage citizens to donate their blood by actively cooperating in activities to encourage blood donation that are carried out by the Korean National Red Cross under the Organization of the Korean National Red Cross Act and the blood center under Article 6 of the Blood Management Act. <Amended by Ordinance No. 5815, Jan. 2, 2015>

Article 4 (Development of Programs to Encourage and Support Blood Donation) (1) In order to promote blood donation among citizens, the Mayor shall develop an annual business plan to encourage and support blood donation (hereinafter referred to as “business plan”), with an annual implementation plan therefor, according to an annual plan for encouraging blood donation established by the Minister of Health, Welfare and Family Affairs.
(2) A business plan under paragraph (1) shall include the following:
1. Basic direction-setting for projects to encourage and support blood donation;
2. Matters relating to education, publicity and counseling on blood donation;
3. Matters relating to the raising and management of financial resources involved in implementing projects to encourage and support blood donation;
4. Other necessary matters regarding projects to encourage and support blood donation.

Article 4 (Development of Programs to Encourage and Support Blood Donation) (1) In order to promote blood donation among citizens, the Mayor shall develop an annual business plan to encourage and support blood donation (hereinafter referred to as "business plan"), with an annual implementation plan therefor, according to an annual plan for encouraging blood donation established by the Minister of Health and Welfare. <Amended by Ordinance No. 5815, Jan. 2, 2015>
(2) A business plan under paragraph (1) shall include the following:
1. Basic direction-setting for projects to encourage and support blood donation;
2. Matters relating to education, publicity and counseling on blood donation;

4. Other necessary matters regarding projects to encourage and support blood donation.

Article 5 (Establishment and Management of Blood Donation Centers) The Mayor may provide financial and administrative support to the President of the Korean National Red Cross if the latter seeks to establish blood donation centers in the following places:
1. The Seoul Metropolitan Government Office Building and its affiliated public health centers, and other public places such as libraries;
2. Business places under the jurisdiction of the Seoul Metropolitan Government (hereinafter referred to as the “City”);
3. Places managed and operated by the City-invested institutions;
4. Other places as are deemed suitable to establish blood donation centers.

Article 5 (Establishment and Management of Blood Donation Centers) The Mayor may provide financial and administrative support to the President of the Korean National Red Cross if the latter intends to establish blood donation centers in the following places: <Amended by Ordinance No. 5815, Jan. 2, 2015>
1. The Seoul Metropolitan Government Office Building and its affiliated public health centers, and other public places such as libraries;
2. Business places under the jurisdiction of the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government");
3. Places managed and operated by the City-invested institutions;
4. Other places as are deemed suitable to establish blood donation centers.

Article 6 (Publicity for, and Provision of Information on, Blood Donation) In order to encourage and support blood donation, the Mayor shall include in an annual business plan developed under Article 4 the publicity of projects related to blood donation and the provision of information to citizens by using the following media:
1. Electric signs and other outdoor advertising media managed by the City;
2. Electric signs at bus stops, subway stations, etc.;
3. Publications by the City;
4. Other media to facilitate the promotion of blood donation.

Article 6 (Publicity for, and Provision of Information on, Blood Donation) In order to encourage and support blood donation, the Mayor shall include, in an annual business plan developed under Article 4, the publicity of projects related to blood donation and the provision of information to citizens by using the following media:
1. Electric signs and other outdoor advertising media managed by the Seoul Government;
2. Electric signs at bus stops, subway stations, etc.;
3. Publications by the Seoul Government;
4. Other media to facilitate the promotion of blood donation.

Article 7 (Designation and Operation of Blood Donor’s Month) The Mayor may designate and operate a specific month of every year as blood donor’s month to encourage public officials or citizens to donate their blood.

Article 8 (Post Management) The Mayor shall analyze and evaluate the performance of each year’s projects to encourage blood donation and shall take into consideration the results of such evaluation in developing a business plan for the following year.

Article 9 (Assistance in Volunteer Services to Encourage Blood Donation, etc.) (1) Where the Mayor deems it necessary, he/she may reimburse expenses or provide support for volunteer service activities to the organizations that perform volunteer services to encourage blood donation with a view to promoting blood donation among citizens.
(2) Organizations entitled to reimbursement of expenses, methods of and procedures for such reimbursement, etc. under paragraph (1) shall be governed by the Seoul Metropolitan Government Ordinance on the Management of Subsidies and the Seoul Metropolitan Government Ordinance on the Support of Volunteer Service Activities.
(3) Financial and administrative assistance may be provided to the organizations that promote events to commemorate World Blood Donor Day.
(4) The Mayor may provide such assistance as the reduction of rental fees for public facilities managed by the City (Seoul Museum of Art, Seoul Museum of History, Sejong Center for the Performing Arts, etc.).
(5) Persons eligible for assistance, methods of and procedures for assistance, facilities subject to rental fee reduction, rates of such reduction, etc. under paragraph (4) shall be prescribed by the Enforcement Rule.

Article 9 (Assistance in Volunteer Services to Encourage Blood Donation) (1) Where the Mayor deems it necessary, he or she may reimburse expenses or provide support for volunteer service activities to the organizations that perform volunteer services to encourage blood donation with a view to promoting blood donation among citizens.

(3) Financial and administrative assistance may be provided to the organizations that promote events to commemorate World Blood Donor Day.
(4) The Mayor may provide such assistance as the reduction of rental fees for public facilities managed by the Seoul Government (Seoul Museum of Art, Seoul Museum of History, Sejong Center for the Performing Arts, etc.).
(5) Persons eligible for assistance, methods of and procedures for assistance, facilities subject to rental fee reduction, rates of such reduction, etc. under paragraph (4) shall be prescribed by rule of the Seoul Government.

Article 10 (Duty to Maintain Confidentiality) No person who has been or is engaged in any project to encourage blood donation under this Ordinance shall divulge confidential information that he/she learned in the course of performing his/her duties.
