SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON TOW, ETC. OF VEHICLES STOPPING OR PARKING ILLEGALLY

Article 1 (Purpose)
The purpose of this Ordinance is to provide for matters delegated by the Road Traffic Act (hereinafter referred to as the "Act"), the Enforcement Decree thereof (hereinafter referred to as the "Decree") and the Enforcement Rules thereof (hereinafter referred to as the "Rules") concerning the towing, custody and return of vehicles stopping or parking illegally and matters necessary for the implementation thereof. <Amended on Jul. 30, 2008>

Article 2 (Towing and Custody of Cars)
The head of a Gu may directly tow and take custody of vehicles stopping or parking illegally or have a legal entity, etc. under the provisions of Article 36 (1) of the Road Traffic Act (hereinafter referred to as the "Act") conduct the same business for him/her. <Amended on Jul. 30, 2008>

Article 3 (Calculation of Expenses Incurred)
(1) Expenses incurred in the towing of vehicles shall be referred to as a towing charge and expenses incurred in the custody of vehicles shall be referred to as a custody charge, out of the expenses incurred under Article 15 (3) of the Enforcement Decree of the Road Traffic Act. <Amended on Jul. 30, 2008>

(2) The standards for calculation of towing charges and custody charges under paragraph (1) shall be as attached Table.

Article 4 (Imposition and Collection of Expenses Incurred)
(1) Towing charges and custody charges under Article 3 shall be notified to users or drivers of vehicles by a notice for payment in Form Nos. 1 and 2 attached hereto.

(2) Towing charges under paragraph (1) shall be appropriated as the revenue of the relevant autonomous Gu and custody charges shall be the income of a custodian under Article 2.

Article 5 (Vicarious Execution of Business by Legal Entity for Gu)
(1) The scope of business a legal entity intends to conduct for a Gu, out of tasks involving the towing, custody and return of vehicles, shall be specified in the operational regulations concerning the conduct of business for a Gu referred to in Article 23 (1) 2 of the Enforcement Rules of the Road Traffic Act. <Amended on Jul. 30, 2008>

(2) Towing charges under Article 4 (2) shall be paid to a legal entity, etc. conducting business related to the towing of vehicles for a Gu, out of tasks involving the towing, custody and return of vehicles under Article 36 (1) of the Act, as expenses for vicarious execution. <Amended on Jul. 30, 2008>

(3) The head of each Gu shall reimburse expenses for vicarious execution under paragraph (2) twice a month at the request of a legal entity, etc. conducting business for the relevant Gu, etc.

This Ordinance shall enter into force on January 1, 1995.

This Ordinance shall apply to vehicles towed away on or after the date this Ordinance enters into force.

This Ordinance shall enter into force on the date of its promulgation.
