SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON TOW, ETC. OF VEHICLES STOPPING OR PARKING ILLEGALLY

Article 1 (Purpose) The purpose of this Ordinance is to provide for matters delegated by the Road Traffic Act, the Enforcement Decree of said Act, and the Enforcement Rule of said Act, concerning the towing, custody, and return of vehicles stopping or parking illegally and matters necessary for enforcing said statutes. <Amended by Ordinance No. 4670, Jul. 30, 2008; Ordinance No. 6386, Jan. 5, 2017>

Article 1 (Purpose) The purpose of this Ordinance is to provide for matters delegated by the Road Traffic Act, the Enforcement Decree of said Act, and the Enforcement Rule of the said Act, concerning the towing, custody, and return of vehicles stopping or parking illegally and matters necessary for enforcing said statutes. <Amended on Jul. 30, 2008; Jan. 5, 2017>

Article 2 (Towing and Custody of Vehicles) The head of an autonomous Gu (hereinafter referred to as "head of a Gu") may directly tow and take custody of vehicles stopping or parking illegally or entrust the corporations, etc. specified in Article 36 (1) of the Road Traffic Act (hereinafter referred to as the "Act") the towing and custody of such vehicles. <Amended by Ordinance No. 4670, Jul. 30, 2008; Ordinance No. 5908, May 14, 2015; Ordinance No. 6386, Jan. 5, 2017>

Article 2 (Towing and Custody of Vehicles) The head of an autonomous Gu (hereinafter referred to as the "head of a Gu") may directly tow and take custody of vehicles stopping or parking illegally or entrust the corporations, etc. specified in Article 36 (1) of the Road Traffic Act (hereinafter referred to as the "Act") the towing and custody of such vehicles. <Amended on Jul. 30, 2008; May 14, 2015; Jan. 5, 2017>

Article 3 (Calculation of Expenses Incurred) (1) Expenses incurred in towing vehicles shall be referred to as towing charges, and expenses incurred in taking custody of vehicles shall be referred to as custody charges, among the expenses incurred under Article 15 (3) of the Enforcement Decree of the Road Traffic Act. <Amended by Ordinance No. 4670, Jul. 30, 2008; Ordinance No. 5908, May 14, 2015; Ordinance No. 6386, Jan. 5, 2017>
(2) The guidelines for calculating towing charges and custody charges under paragraph (1) shall be prescribed in attached Table. <Amended by Ordinance No. 5908, May 14, 2015; Ordinance No. 6386, Jan. 5, 2017>

Article 3 (Calculation of Expenses Incurred) (1) Expenses incurred in towing vehicles shall be referred to as towing charges, and expenses incurred in taking custody of vehicles shall be referred to as custody charges, among the expenses incurred under Article 15 (3) of the Enforcement Decree of the Road Traffic Act. <Amended on Jul. 30, 2008; May 14, 2015; Jan. 5, 2017>
(2) The guidelines for calculating towing charges and custody charges under paragraph (1) shall be prescribed in attached Table. <Amended on May 14, 2015; Jan. 5, 2017>

Article 4 (Imposition and Collection of Expenses Incurred) (1) A towing charge or custody charge under Article 3 shall be notified to the user or driver of the relevant vehicle by a notice for payment in attached Form No 1 or 2. <Amended by Ordinance No. 5908, May 14, 2015; Ordinance No. 6386, Jan. 5, 2017>
(2) Towing charges under paragraph (1) shall be appropriated as the revenue of the relevant autonomous Gu, while custody charges shall be treated as the income of the custodian under Article 2. <Amended by Ordinance No. 5908, May 14, 2015; Ordinance No. 6386, Jan. 5, 2017>

Article 4 (Imposition and Collection of Expenses Incurred) (1) A towing charge or custody charge under Article 3 shall be notified to the user or driver of the relevant vehicle by a notice for payment in attached Form 1 or 2. <Amended on May 14, 2015; Jan. 5, 2017>
(2) Towing charges under paragraph (1) shall be appropriated as the revenue of the relevant autonomous Gu, while custody charges shall be treated as the income of the custodian under Article 2. <Amended on May 14, 2015; Jan. 5, 2017>

Article 5 (Performance of Administrative Work by Entrusted Corporations) (1) The operating regulations for processing entrusted administrative work under Article 23 (1) 2 of the Enforcement Decree of the Road Traffic Act shall specify in detail the scope of work to be entrusted and the business territory for such work, among the administrative work for towing, taking custody of, and returning vehicles. <Amended by Ordinance No. 4670, Jul. 30, 2008; Ordinance No. 5908, May 14, 2015>
(2) Towing charges collected under Article 4 (2) shall be paid to the corporations, etc., towing vehicles, among the administrative work for towing, taking custody of, and returning vehicles under Article 36 (1) of the Act, for expenses incurred in performing the entrusted work. <Amended by Ordinance No. 4670, Jul. 30, 2008; Ordinance No. 5908, May 14, 2015; Ordinance No. 6386, Jan. 5, 2017>
(3) The head of each Gu shall reimburse entrusted corporations, etc. twice a month for expenses incurred in performing entrusted work, upon request of the entrusted corporations, etc. <Ordinance No. 5908, May 14, 2015; Ordinance No. 6386, Jan. 5, 2017>

Article 5 (Performance of Administrative Work by Entrusted Corporations) (1) The operating regulations for processing entrusted administrative work under Article 23 (1) 2 of the Enforcement Rule of the Road Traffic Act shall specify in detail the scope of work to be entrusted and the business territory for such work, among the administrative work for towing, taking custody of, and returning vehicles. <Amended on Jul. 30, 2008; May 14, 2015>
(2) Towing charges collected under Article 4 (2) shall be paid to the corporations, etc., towing vehicles, among the administrative work for towing, taking custody of, and returning vehicles under Article 36 (1) of the Act, for expenses incurred in performing the entrusted work. <Amended on Jul. 30, 2008; May 14, 2015; Jan. 5, 2017>

ADDENDUM <Ordinance No. 3148, Dec. 31, 1994>
This Ordinance shall enter into force on January 1, 1995.

This Ordinance shall enter into force one month after the date of its promulgation.

Article 1 (Enforcement Date)
This Ordinance shall enter into force on March 1, 2002.
Article 2 (Applicability)
This Ordinance shall apply to vehicles towed on or after the date this Ordinance enters into force.

This Ordinance shall enter into force on the date of its promulgation.

Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation: Provided, That the provisions concerning imposing towing charges on two-wheeled motor vehicles shall enter into force two years after the date of promulgation of the Ordinance.
Article 2 (Transitional Measure concerning Towing Charges)
Notwithstanding the amended provisions of the attached Table, the former provisions shall apply where the guidelines for imposing towing charges shall apply to the vehicles towed before this Ordinance enters into force.

This Ordinance shall enter into force on the date of its promulgation.

Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation: Provided, That the provisions concerning imposing towing charges on two-wheeled motor vehicles shall enter into force two years after the date of promulgation of the Ordinance.

Notwithstanding the amended provisions of the attached Table, the former provisions shall apply where the guidelines for imposing towing charges shall apply to the vehicles towed before this Ordinance enters into force.

This Ordinance shall enter into force on the date of its promulgation.
Articles 2 (Applicability)
The amended provisions of the attached Table shall apply beginning with motor vehicles to be towed after this Ordinance enters into force.
