SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT TO OUT OF SCHOOL YOUTH
Amendment of Other Laws No. 7044, Mar. 28, 2019 Whole Amendment No. 7347, Sep. 26, 2019

Article 1 (Purpose) The purpose of this Ordinance is to provide support to out-of-school youth so that they may grow up to be healthy members of the community through education, such as alternative education to out-of-school youth, support for self-sufficiency, etc.

Article 1 (Purpose) The purpose of this Ordinance is to support out-of-school youth to become healthy members of society by providing provisions on support for such youth.

Article 2 (Definitions of Terms) The definitions of terms used in this Ordinance shall be as follows:
1. "Out-of-school youth" means all youth who do not receive regular school (schools under the provisions of Article 2 of the Elementary and Secondary Education Act) education, such as dropout youth, youth who do not enter into a school, and working youth;
2. "Alternative education" means education focusing on personality and aptitude, education focusing on field experience, and career education provided to meet the desire of out-of-school youth;
3. "Alternative education institution" means an institution which has not obtained approval under the provisions of Article 4 of the Elementary and Secondary Education Act, which is an institution conducting alternative education under subparagraph 2.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "youth" means a person as defined in the main clause of subparagraph 1 of Article 3 of the Framework Act on Youth;
2. The term "out-of-school youth" means any of the following youth:
(a) A youth who has been absent from elementary school or middle school as defined in Article 2 of the Elementary and Secondary Education Act, or a school providing equivalent courses for at least three months after entering school, or a youth whose obligation to attend school has been postponed pursuant to Article 14 (1) of the same Act;
(b) A youth who has been dismissed or expelled from, or who has dropped out of, high school as defined in Article 2 of the Elementary and Secondary Education Act or a school providing equivalent courses pursuant to Article 18 of the same Act;
(c) A youth who has not entered a high school as defined in Article 2 of the Elementary and Secondary Education Act or a school providing equivalent courses;
3. The term "out-of-school youth support project" means any support project including counseling, education, job experience and employment, and self-reliance, taking into account the individual characteristics and needs of the out-of-school youth.

Article 3 (Responsibilities and Duties of Mayor) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall protect out-of-school youth from harmful environments and implement a support policy meeting their desire so that they may recover their self-esteem and realize their future dream even in spaces outside of schools

Article 3 (Responsibilities of Mayor) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall implement support policies that protect out-of-school youth from harmful environments so that they can restore their self-esteem in spaces outside of school and pursue their dreams, while meeting their needs.

Article 4 (Formulation of Comprehensive Support Plan for Out-Of-School Youth) (1) The Mayor shall formulate and implement a comprehensive support plan for out-of-school youth (hereinafter referred to as "support plan") every year to provide systematic and continued support to out-of-school youth.
(2) A support plan shall include matters concerning out-of-school youth eligible for support, the size and methods of support to implement the following projects:
1. A project to improve social awareness of out-of-school youth;
2. A project to provide support for education of out-of-school youth;
3. A project to provide support for self-sufficiency of out-of-school youth;
4. Other projects necessary to provide support to out-of-school youth.
(3) The Mayor shall conduct surveys on the actual conditions of out-of-school youth every year, and evaluate performance achieved in the preceding year to formulate a support plan.
(4) When the Mayor has formulated a support plan, he/she shall immediately report the support plan to the competent standing committee of the Seoul Metropolitan Council, and reflect expenses to be incurred due to a support plan in the budget for the following year.

Article 4 (Out-of-School Youth Support Plan) (1) The Mayor shall establish and implement an out-of-school youth support plan (hereinafter referred to as "support plan") every year to provide systematic and uninterrupted support for the out-of-school youth.
(2) The support plan shall include matters regarding the target, scale, method, etc. of support to conduct the following projects:
1. Projects to prevent social discrimination and prejudice against out-of-school youth and raise social awareness of out-of-school youth;
2. Projects to develop and assist support programs for out-of-school youth;
3. Projects to establish and operate cooperation systems among the relevant agencies and community-based support systems to support out-of-school youth;
4. Projects to conduct investigations, research, education, public relations, and institutional improvement to support out-of-school youth;
5. Projects to secure and allocate financial resources to support out-of-school youth;
6. Other projects necessary for supporting out-of-school youth.
(3) The Mayor may conduct a survey on out-of-school youth in Seoul every three years and use the results to establish support plans.
(4) Where a support plan is established, the Mayor shall immediately report it to the standing committee under the Seoul Metropolitan Council, and the necessary expenses according to the support plan shall be reflected in the following year's budget.

Article 5 (Establishment of Out-of-School Youth Support Committee) (1) The Mayor shall establish the Out-of-School Youth Support Committee of the Seoul Metropolitan Government (hereinafter referred to as the "Committee") to deliberate and provide advice on policies to support out-of-school youth.
(2) The Committee shall deliberate and render advice on the following matters concerning policies to support out-of-school youth:
1. Matters concerning the formulation and alteration of a support plan;
2. Matters concerning financial support to projects to support out-of-school youth undertaken by non-profit corporations and non-governmental organizations;
3. Matters concerning the establishment of a network of institutions related to out-of-school youth and a cooperation system in the community;
4. Matters concerning petitions against and demand for improvement in human rights violation and discrimination of out-of-school youth to related agencies;
5. Important matters concerning the operation of the out-of-school youth support center of the Seoul Metropolitan Government under Article 11;
6. Other matters concerning support to out-of-school youth brought to meetings by the Mayor.
(3) A "subcommittee" under Article 6-2 of the Seoul Metropolitan Government Ordinance on Juvenile Support Committee shall perform the function of the Committee on its behalf. <Newly Inserted by Ordinance No. 5571, Oct. 4, 2013>

Article 5 (Support Committee for Out-of-School Youth) (1) The Mayor shall establish the Seoul Metropolitan Government Support Committee for Out-of-School Youth (hereinafter referred to as the "Committee") to deliberate and consult on support policies for out-of-school youth.
(2) The Committee shall deliberate and consult on the following matters regarding out-of-school youth support policies:
1. Establishment of plans to support out-of-school youth;
2. Improvement of ordinances and systems to support out-of-school youth;
3. Establishment of cooperation systems among the relevant agencies and community-based support systems;
4. Other matters requiring consultation on support for out-of-school youth.
(3) The "subcommittee" pursuant to Article 6-2 of Seoul Metropolitan Government Ordinance on the Youth Nurturing Committee shall take over the functions of the Committee.

Article 6 (Support for Counseling) The Mayor may provide psychiatric counseling, vocational guidance counseling, family counseling, etc. to provide effective and appropriate support for the out-of-school youth.

Article 7 (Support to Alternative Education Institutions) Where any alternative education institution implements a project to support out-of-school youth, the Mayor may subsidize all or some of expenses incurred within the budgetary limits.

Article 7 (Academic Support) In order to help out-of-school youth perform necessary studies without interruption and become self-reliant, the Mayor may support the following matters:
1. Individual learning programs including school graduation equivalency examinations;
2. Entering an alternative educational institution and re-enrollment and re-entry into elementary, middle, or high schools under the Elementary and Secondary Education Act;
3. Expenses for obtaining qualifications necessary for academic progress and employment;
4. Scholarships to provide career exploration opportunities;
5. Other matters necessary for educating out-of-school youth.

Article 8 (Lending of Public Property without Compensation, etc.) (1) Where necessary for the establishment and operation of an alternative education institution, the Mayor may lend public property without compensation, preferentially rent public property or reduce user fees pursuant to the Seoul Metropolitan Government Ordinance on Public Property and Commodity Management: Provided, That lending without compensation and reductions in user fees shall be limited to cases where the Seoul Metropolitan Government directly operates an alternative education institution or entrusts the operation thereof to any other person.
(2) The Mayor may transfer disused goods, etc. to alternative education institutions without compensation.

Article 8 (Vocational Experience and Support for Employment) The Mayor may provide the following support for the out-of-school youth to enable them to gain vocational experience and to receive training tailored to their aptitudes and abilities:
1. Career counseling programs tailored to individual aptitudes and abilities;
2. Vocational experience and training programs;
3. Introduction and management of careers;
4. Other matters necessary for out-of-school youth to gain vocational experience and to receive training.

Article 9 (Right to Use Public Facilities) Where any learner of an alternative education institution intends to use public facilities managed by the Seoul Metropolitan Government, the Mayor shall guarantee such learner the rights and conveniences same as those of students under the Elementary and Secondary Education Act.

Article 9 (Support for Self-Reliance) (1) The Mayor may provide life support, cultural space support, medical support, emotional support, or the like, which are necessary for the out-of-school youth to become more self-reliant.
(2) The Mayor may provide educational support on the subjects of economics, legal service, culture, or the like, which are necessary for the out-of-school youth to become more self-reliant.
(3) The Mayor may give priority to out-of-school youth requiring support provided in paragraph (1) in receiving special support for youth in crisis under Article 14 of the Youth Welfare Support Act.

Article 10 (Establishment of Cooperation System in Community) The Mayor shall closely cooperate with related agencies, such as the Seoul Metropolitan Office of Education and the Seoul Metropolitan Police Agency, and youth support institutions, related social organizations, etc. to support education and self-sufficiency of out-of-school youth.

Article 10 (Establishment of System for Cooperation of Communities) (1) The Mayor shall cooperate closely with related agencies such as the Seoul Metropolitan Office of Education and the Seoul Metropolitan Police Agency, youth support agencies, and related social groups to support education and self-reliance of out-of-school youth.
(2) The youth integrated support system for local communities shall be promoted in connection with the following facilities:
1. Youth counseling welfare centers;
2. Youth welfare facilities and support facilities;
3. Offices of education and district offices of education;
4. Schools of each level;
5. Local police agencies and police stations;
6. Local labor offices and branch offices;
7. Public health institutions and public health centers;
8. Juvenile delinquency prevention centers;
9. Probation offices;
10. Other agencies necessary for the operation of integrated support system for local communities.

Article 11 (Establishment, etc. of Out-of-School Youth Support Center) (1) The Mayor may establish an out-of-school youth support center of the Seoul Metropolitan Government (hereinafter referred to as the "Support Center") to efficiently implement projects to support out-of-school youth.
(2) The function of the Support Center shall be as follows:
1. Discovery and advertising of the cases of success of out-of-school youth;
2. Counselling for out-of-school youth and support for the protection thereof;
3. Surveys on the actual conditions of human rights and discrimination of out-of-school youth;
4. Development and dissemination of programs for alternative education;
5. Career education for out-of-school youth;
6. Operation of programs to support the employment of out-of-school youth;
7. Research on how to support out-of-school youth;
8. Establishment and management of the out-of-school youth support network;
9. Support to alternative education institutions;
10. Support for projects to prevent potential dropout youth;
11. Operation of programs to support the return of out-of-school youth to schools;
12. Other matters necessary for projects to support out-of-school youth implemented by the Mayor
(3) The Mayor shall prescribe matters necessary for the operation of the Support Center, such as the organization thereof.

Article 11 (Support Centers for Out-of-School Youth) (1) The Mayor may establish and operate Seoul Metropolitan Government support centers for out-of-school youth (hereinafter referred to as "support center") in order to efficiently promote out-of-school youth support projects.
(2) The functions of support centers shall be as follows:
1. Supporting out-of-school youth as provided in Articles 6 through 9;
2. Linking and cooperation with local community resources to support out-of-school youth;
3. Developing and disseminating programs for supporting out-of-school youth;
4. Providing information and engaging in public relations about programs for supporting out-of-school youth;
5. Discovering and disseminating exemplary cases of supporting out-of-school youth;
6. Activities of improving social awareness of out-of-school youth;
7. Other projects necessary for supporting out-of-school youth.
(3) Matters necessary for establishing and operating support centers shall be determined separately by the Mayor.

Article 12 (Entrustment of Support Center) The Mayor may entrust the operation of the Support Center to a non-profit corporation, non-governmental organization, etc. which implements projects related to youth to efficiently operate the Support Center. In this case, the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector shall apply mutatis mutandis to necessary matters, such as methods of entrustment or support.

Article 12 (Entrustment of Support Centers) (1) The Mayor may entrust support centers to non-profit corporations or private groups that conduct youth-related projects to efficiently operate support centers. In such cases, the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector shall apply mutatis mutandis to necessary matters such as entrustment methods and support.

Article 13 (Guidance and Inspection of Support Center) (1) Where the Mayor deems it necessary for the supervision, he/she may require the head of the Support Center to make a necessary report on the operation and property thereof and submit data, and require relevant public officials to inspect related documents, facilities, etc.
(2) The head of the Support Center shall immediately take corrective measures on matters pointed out at the time of guidance and supervision.

Article 13 (Guidance and Inspection of Support Center) (1) If deemed necessary for supervision, the Mayor may have a support center make necessary reports or submit data on the operation and property of the support center, and may have related public officials inspect related documents or facilities.
(2) The head of a support center shall immediately take corrective measures on matters pointed out during guidance and inspection.

Article 14 (Enforcement Rules) Necessary matters concerning the enforcement of this Ordinance shall be prescribed by rule.

Article 14 (Linking of Support Centers for Out-of-School Youth) (1) The Mayor shall support the support centers installed in autonomous Gus (hereinafter referred to as "autonomous Gu support center") to efficiently perform out-of-school youth support work through linking and cooperation activities.
(2) In order to strengthen the competence of autonomous Gu support centers, the Mayor shall periodically conduct educational programs and workshops for the employees of such support centers.
(3) The Mayor may provide support centers and autonomous Gu support centers with all or part of the expenses necessary for the performance and cooperative activities provided in each subparagraph of Article 10 (2) within the budgetary limit.

Article 15 (Public Facility Use Rights) The Mayor shall guarantee the same rights and convenience as students under the Elementary and Secondary Education Act when out-of-school youth intend to use public facilities managed by the Seoul Metropolitan Government.

Article 16 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Metropolitan Government.

ADDENDUM
This Ordinance shall enter into force on the date of its promulgation.
