Article 1 (Purpose) The purpose of this Ordinance is to provide support to out-of-school youth so that they may grow up to be healthy members of the community through education, such as alternative education to out-of-school youth, support for self-sufficiency, etc.

Article 2 (Definitions of Terms) The definitions of terms used in this Ordinance shall be as follows:
1. "Out-of-school youth" means all youth who do not receive regular school (schools under the provisions of Article 2 of the Elementary and Secondary Education Act) education, such as dropout youth, youth who do not enter into a school, and working youth;
2. "Alternative education" means education focusing on personality and aptitude, education focusing on field experience, and career education provided to meet the desire of out-of-school youth;
3. "Alternative education institution" means an institution which has not obtained approval under the provisions of Article 4 of the Elementary and Secondary Education Act, which is an institution conducting alternative education under subparagraph 2.

Article 3 (Responsibilities and Duties of Mayor) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall protect out-of-school youth from harmful environments and implement a support policy meeting their desire so that they may recover their self-esteem and realize their future dream even in spaces outside of schools

Article 4 (Formulation of Comprehensive Support Plan for Out-Of-School Youth) (1) The Mayor shall formulate and implement a comprehensive support plan for out-of-school youth (hereinafter referred to as "support plan") every year to provide systematic and continued support to out-of-school youth.
(2) A support plan shall include matters concerning out-of-school youth eligible for support, the size and methods of support to implement the following projects:
1. A project to improve social awareness of out-of-school youth;
2. A project to provide support for education of out-of-school youth;
3. A project to provide support for self-sufficiency of out-of-school youth;
4. Other projects necessary to provide support to out-of-school youth.
(3) The Mayor shall conduct surveys on the actual conditions of out-of-school youth every year, and evaluate performance achieved in the preceding year to formulate a support plan.
(4) When the Mayor has formulated a support plan, he/she shall immediately report the support plan to the competent standing committee of the Seoul Metropolitan Council, and reflect expenses to be incurred due to a support plan in the budget for the following year.

Article 5 (Establishment of Out-of-School Youth Support Committee) (1) The Mayor shall establish the Out-of-School Youth Support Committee of the Seoul Metropolitan Government (hereinafter referred to as the "Committee") to deliberate and provide advice on policies to support out-of-school youth.
(2) The Committee shall deliberate and render advice on the following matters concerning policies to support out-of-school youth:
1. Matters concerning the formulation and alteration of a support plan;
2. Matters concerning financial support to projects to support out-of-school youth undertaken by non-profit corporations and non-governmental organizations;
3. Matters concerning the establishment of a network of institutions related to out-of-school youth and a cooperation system in the community;
4. Matters concerning petitions against and demand for improvement in human rights violation and discrimination of out-of-school youth to related agencies;
5. Important matters concerning the operation of the out-of-school youth support center of the Seoul Metropolitan Government under Article 11;
6. Other matters concerning support to out-of-school youth brought to meetings by the Mayor.
(3) A "subcommittee" under Article 6-2 of the Seoul Metropolitan Government Ordinance on Juvenile Support Committee shall perform the function of the Committee on its behalf. <Newly Inserted by Ordinance No. 5571, Oct. 4, 2013>

Article 7 (Support to Alternative Education Institutions) Where any alternative education institution implements a project to support out-of-school youth, the Mayor may subsidize all or some of expenses incurred within the budgetary limits.

Article 8 (Lending of Public Property without Compensation, etc.) (1) Where necessary for the establishment and operation of an alternative education institution, the Mayor may lend public property without compensation, preferentially rent public property or reduce user fees pursuant to the Seoul Metropolitan Government Ordinance on Public Property and Commodity Management: Provided, That lending without compensation and reductions in user fees shall be limited to cases where the Seoul Metropolitan Government directly operates an alternative education institution or entrusts the operation thereof to any other person.
(2) The Mayor may transfer disused goods, etc. to alternative education institutions without compensation.

Article 9 (Right to Use Public Facilities) Where any learner of an alternative education institution intends to use public facilities managed by the Seoul Metropolitan Government, the Mayor shall guarantee such learner the rights and conveniences same as those of students under the Elementary and Secondary Education Act.

Article 10 (Establishment of Cooperation System in Community) The Mayor shall closely cooperate with related agencies, such as the Seoul Metropolitan Office of Education and the Seoul Metropolitan Police Agency, and youth support institutions, related social organizations, etc. to support education and self-sufficiency of out-of-school youth.

Article 11 (Establishment, etc. of Out-of-School Youth Support Center) (1) The Mayor may establish an out-of-school youth support center of the Seoul Metropolitan Government (hereinafter referred to as the "Support Center") to efficiently implement projects to support out-of-school youth.
(2) The function of the Support Center shall be as follows:
1. Discovery and advertising of the cases of success of out-of-school youth;
2. Counselling for out-of-school youth and support for the protection thereof;
3. Surveys on the actual conditions of human rights and discrimination of out-of-school youth;
4. Development and dissemination of programs for alternative education;
5. Career education for out-of-school youth;
6. Operation of programs to support the employment of out-of-school youth;
7. Research on how to support out-of-school youth;
8. Establishment and management of the out-of-school youth support network;
9. Support to alternative education institutions;
10. Support for projects to prevent potential dropout youth;
11. Operation of programs to support the return of out-of-school youth to schools;
12. Other matters necessary for projects to support out-of-school youth implemented by the Mayor
(3) The Mayor shall prescribe matters necessary for the operation of the Support Center, such as the organization thereof.

Article 12 (Entrustment of Support Center) The Mayor may entrust the operation of the Support Center to a non-profit corporation, non-governmental organization, etc. which implements projects related to youth to efficiently operate the Support Center. In this case, the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector shall apply mutatis mutandis to necessary matters, such as methods of entrustment or support.

Article 13 (Guidance and Inspection of Support Center) (1) Where the Mayor deems it necessary for the supervision, he/she may require the head of the Support Center to make a necessary report on the operation and property thereof and submit data, and require relevant public officials to inspect related documents, facilities, etc.
(2) The head of the Support Center shall immediately take corrective measures on matters pointed out at the time of guidance and supervision.

Article 14 (Enforcement Rules) Necessary matters concerning the enforcement of this Ordinance shall be prescribed by rule.

ADDENDA <Ordinance No. 5328, Jul. 30, 2012>
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Transitional Measures concerning Entrusted Operation)
The Alternative Education Center of the Seoul Metropolitan Government being operated after the operation thereof was entrusted at the time this Ordinance enters into force shall be deemed the Out-of-School Youth Support Center of the Seoul Metropolitan Government under this Ordinance.

This Ordinance shall enter into force on the date of its promulgation.
