SEOUL METROPOLITAN GOVERNMENT ENFORCEMENT RULE OF THE ORDINANCE ON MEASURES TO EASE TRAFFIC FLOW OF CONSTRUCTION SITES OCCUPYING ROADS

Article 1 (Purpose) The purpose of this Rule is to provide for matters necessary for the implementation of the Seoul Metropolitan Government Ordinance on Measures to Ease Traffic Flow of Construction Sites Occupying Roads. <Amended on Mar. 15, 2007>

Article 2 (Objects of Application) (1) The expression "occupation of one lane or more of the road" in Article 3 of the Seoul Metropolitan Government Ordinance on Measures to Ease Traffic Flow of Construction Sites Occupying Roads (hereinafter referred to as the "Ordinance") includes cases where the width of the part remaining after partially occupying one lane of the relevant road is less than the minimum width of a lane under Article 15 (2) of the Enforcement Rule of the Road Traffic Act. <Amended on Mar. 15, 2007; Aug. 6, 2009>
(2) The expression "period of occupation is more than 20 days (in the case of a driveway, ten days)" in Article 3 of the Ordinance means cases where the period of occupation of a lane of the relevant road during the period of construction implemented under the same project name is more than 20 days in total (in case of a driveway, ten days). In such cases, where a lane is occupied for not less than one hour a day, it shall be deemed one day. <Amended on Oct. 13, 2005; Mar. 15, 2007; Aug. 6, 2009>

Article 3 (Measures to Ease Traffic Flow) A person who intends to perform construction works shall include details of attached Table 1 in the measures to ease traffic flow that shall be submitted to the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") pursuant to Article 4 (1) of the Ordinance". <Amended on Aug. 6, 2009>

Article 4 (Installation, etc. of Construction Notice Signs) (1) A person who intends to perform construction works shall make, install and manage a construction notice sign, traffic direction sign, etc. pursuant to Article 4 (2) 2 and 4 of the Ordinance in accordance with attached Table 2. <Amended on Aug. 6, 2009>
(2) A person who intends to perform construction works shall place a construction notice placard at the construction site to give notice of the commencement of construction works pursuant to Article 4 (2) 5 of the Ordinance in accordance with attached Table 3. <Amended on Aug. 6, 2009>

Article 5 (Installation, etc. of CCTV) (1) Where the period of occupation of a road exceeds six months pursuant to Article 4 (2) 6 of the Ordinance, the person who intends to perform the construction works shall formulate and execute a plan for installation and operation of a close-circuit television camera (CCTV) for inspection of the construction site: Provided, That where the Advisory Council under Article 9 of the Ordinance deems it necessary, the Advisory Council may have such person install a CCTV even at a construction site of which period of occupation of a road is not more than six months. <Newly Inserted on Aug. 6, 2009>
(2) When a construction undertaker submits a report on matters changed pursuant to subparagraphs 2, 3 and 4 of Article 6 of the Ordinance, he/she shall include details on the following therein: <Amended on Aug. 6, 2009>
1. The purpose and place of installation; <Newly Inserted on Aug. 6, 2009>
2. The scope and time of shooting; <Newly Inserted on Aug. 6, 2009>
3. Matters concerning a management officer; <Newly Inserted on Aug. 6, 2009>
4. The time and methods of installation; <Newly Inserted on Aug. 6, 2009>
5. The period and methods of preservation of records; <Newly Inserted on Aug. 6, 2009>
6. Methods of collecting opinions, such as a public hearing, etc. <Newly Inserted on Aug. 6, 2009>
(3) A person who intends to perform construction works shall install a CCTV pursuant to paragraph (1) and submit the IP address of the CCTV at the time he/she commences the construction works. <Newly Inserted on Aug. 6, 2009>

Article 6 (Change of Measures to Ease Traffic Flow) (1) When a construction undertaker intends to change measures to ease traffic flow pursuant to Article 6 of the Ordinance, he/she shall present the reasons therefor. <Amended on Aug. 6, 2009>
(2) When a construction undertaker submits a report on matters changed pursuant to subparagraphs 2, 3 and 4 of Article 6 of the Ordinance, he/she shall include details on the following therein: <Amended on Aug. 6, 2009>
1. Traffic impact analysis;
2. A plan for improvement, and drawings related thereto;
3. A construction notice sign, traffic direction sign, etc.;
4. A notice of the performance of construction works.
(3) "Cases where it is impossible to implement measures to ease traffic flow" in subparagraph 4 of Article 6 of the Ordinance means any of the following: <Amended on Aug. 6, 2009>
1. Where the time of occupation of a lane is changed;
2. Where not less than one additional lane is occupied;
3. Where other matters related to the occupation of a lane are changed. <Amended on Aug. 6, 2009>

Article 7 (Sending, etc. of Report on Measures to Ease Traffic Flow) (1) The Mayor shall send a report on measures to ease traffic flow or any change thereto submitted by a person who intends to perform construction works or a construction undertaker to members of the Advisory Council at least ten days before a meeting of the Advisory Council under Article 9 of the Ordinance is held. <Amended on Aug. 6, 2009>
(2) The Mayor shall examine measures to ease traffic flow pursuant to Articles 3 and 5 and notify the person who has submitted the measures of the result of examination without delay. <Amended on Aug. 6, 2009>

Article 8 (Keeping of Report on Measures to Ease Traffic Flow) A construction undertaker shall keep the report on measures to ease traffic flow in the main office of the construction site so that a public official in the field of traffic administration may ascertain whether the measures to ease traffic flow of the construction site are implemented pursuant to Article 8 of the Ordinance. <Amended on Aug. 6, 2009>
