SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR EDUCATION ON PROTECTION OF THE RIGHT TO WORK

Article 1 (Purpose) The purpose of this Ordinance is to guarantee the right of citizens to know about their labor rights, by prescribing matters necessary to systematically support education on the protection of labor rights, as well as to contribute to promoting welfare of the citizens by preventing various disputes that may arise from labor relations and minimizing related damage therefrom. <Amended by Ordinance No. 7044, Mar. 28, 2019>

Article 2 (Definition) The education on the protection of labor rights referred to in this Ordinance (hereinafter referred to as "education on labor rights") means education provided in relation to labor rights, of which any worker who provides labor within a business place needs to be aware, including how to draft an labor contract (referring to documents stating relations in a labor contract under subparagraph 4 of Article 2 of the Labor Standards Act), damage relief, etc., and various statutes related to labor relations. <Amended by Seoul Metropolitan Government Ordinance No. 6016, Oct. 8, 2015; Ordinance No. 7044, Mar. 28, 2019>

Article 3 (Scope of Application) This Ordinance shall apply to persons whose place of domicile or residence is in Seoul Metropolitan City (hereinafter referred to as the "Seoul Government") and workers who provide labor in a place of business located in the City. <Amended by Ordinance No. 7044, Mar. 28, 2019>

Article 4 (Relationship to Other Ordinances of Seoul Government) With respect to education on labor rights, this Ordinance shall prevail over other Ordinances of Seoul Government. <Amended by Ordinance No. 7044, Mar. 28, 2019>

Article 5 (Responsibilities of Mayor) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to develop education programs in order to guarantee and maximize the basic labor rights of citizens. <Amended by Ordinance No. 7044, Mar. 28, 2019>
(2) Where necessary for education on labor rights, the Mayor may conduct a fact-finding survey or request research services. <Amended by Ordinance No. 7044, Mar. 28, 2019>
(3) In developing education programs, the Mayor may seek cooperation with related similar organizations to explore cooperative measures.

Article 6 (Formulation of Basic Plans) (1) Every five years, the Mayor shall formulate a basic plan on the support for education on labor rights, etc. <Amended by Ordinance No. 7044, Mar. 28, 2019>
(2) A basic plan shall include the following matters: <Amended by Ordinance No. 7044, Mar. 28, 2019>
1. Matters related to direction-setting for the implementation and goals of education on labor rights;
2. Matters related to the research cases, surveys, etc. conducted in relation to education on labor rights;
3. Development and promotion of programs related to education on labor rights, etc.;
4. Other necessary matters concerning the policies for promoting education on labor rights.

Article 7 (Provision of Education on Labor Rights) Where the Mayor provides education on labor rights, he or she may entrust the provision of education to specialized education institutions, etc. <Amended by Ordinance No. 7044, Mar. 28, 2019>

Article 8 (Development and Promotion of Programs) The Mayor shall conduct the following program development and promotion activities in order to efficiently perform education on labor rights and support projects: <Amended by Ordinance No. 7044, Mar. 28, 2019>
1. Development of programs for education on labor rights;
2. Development of appropriate teaching materials and visual aids by field of education;
3. Other activities deemed necessary for the policies on education on labor rights, etc.

Article 9 (Enforcement Rule) Necessary matters concerning the enforcement of this Ordinance shall be prescribe by rule of the Seoul Government.

ADDENDUM
This Ordinance shall enter into force on the date of its promulgation.
