SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROMOTION OF FUTURE INNOVATIVE TECHNOLOGY

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROMOTION OF FUTURE INNOVATIVE TECHNOLOGY

Article 1 (Purpose) The purpose of this Ordinance is to effectively respond to the 4th industrial revolution and contribute to the activation of regional economy and the improvement of the citizens' life quality by supporting the promotion of future innovative technologies.

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows:
1. The term "industry-academia-research cooperation system" means a supporting system in which the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government"), autonomous Gus, enterprises, enterprises-supporting institution, universities, research institutes, etc. located in the Seoul Metropolitan City mutually link their activities or promote mutual cooperation to create enterprises environment for enhancing capability for regional innovation and developing industries;
2. The term "future innovative technology" means advanced technologies, including the following new technologies, that the Seoul Government intends to strategically foster to efficiently respond to the 4th industrial revolution, such as artificial intelligence, big data, and IoT (the Internet of Things):
(a) New technology designated and publicly announced pursuant to Article 14 of the Construction Technology Promotion Act;
(b) New technology certified pursuant to Article 7 of the Environmental Technology and Industry Support Act;
(c) New technology for disaster prevention designated and publicly announced pursuant to Article 61 of the Countermeasures against Natural Disasters Act;
(d) New technology certified pursuant to Article 15-2 of the Industrial Technology Innovation Promotion Act and a new product certified pursuant to Article 16 of that Act;
(e) Other new patent construction method or technology deemed by the Seoul Metropolitan Government Innovative Growth Committee to need the fosterage of the Seoul Government;
3. The term "public demonstration project for future innovative technology" means a project to support marketability check and market cultivation through the Seoul Government's policy by which the Seoul Government purchases a new product or service to which new technology is applied or provides demonstrating opportunities thereto for the fosterage of enterprises, such as technology-based small and venture enterprises.

Article 3 (Responsibility of Mayor) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to implement policies necessary for supporting the promotion and innovation of science and technology and expand investments therein.

Article 4 (Establishment of Seoul Metropolitan Government Innovative Growth Committee, and Matters Subject to Deliberation thereby) (1) The Mayor shall establish under his/her direct jurisdiction the Seoul Metropolitan Government Innovative Growth Committee (hereinafter referred to as the "Committee") to deliberate and advise on matters concerning major policies and plans for promoting future innovative technology.
(2) The Committee shall deliberate and advise on the following matters:
1. Matters concerning the formulation and coordination of major policies and plans for promoting future innovative technology;
2. Matters concerning science and technology innovation, human resource development, etc.;
3. Matters concerning an advancement plan for promoting the development of future innovative technology;4. Significant matters, including the planning, evaluation, and scale, concerning projects for supporting research and development for promoting future innovative technology and public demonstration projects for future innovative technology;
5. Matters concerning the activation of industry-academia-research, such as the establishment of a cooperation system therefor and the creation of infrastructure therefor;
6. Matters concerning the support of technology-based enterprises;
7. Matters concerning the formulation and implementation of a plan related to intellectual property;
8. Other matters deemed by the Mayor to be necessary for promoting future innovative technology.

Article 5 (Composition of Committee) (1) The Committee shall be comprised of not more than 20 members, including two chairpersons and two vice-chairpersons.
(2) The chairpersons shall be the Mayor and one person elected from among those falling under subparagraph 2, and the members shall be the following persons:
1. Ex officio members: The Mayor, the head of the Economic Development Headquarters, the CEO of the Seoul Business Agency, and the chairperson of the Seoul Digital Foundation;
2. Commissioned members: Persons commissioned by the Mayor from among the members of the Seoul Metropolitan Council; and the experts of the various fields of society, such as enterprisers, journalists, and professors.
(3) Vice-chairpersons shall be elected from among and by the members of the Committee.
(4) The term of office of the chairpersons and members of the Committee shall be three years and may be consecutively renewed only once.
(5) One secretary shall be assigned to handle the administrative affairs of the Committee, and the division chief in charge of future innovative technology promotion shall serve as the secretary.

Article 6 (Operation of Committee) (1) A meeting of the Committee shall be convoked if deemed necessary by one or more chairpersons.(2) A majority of the members of the Committee shall constitute a quorum; and any decision thereof shall require the concurring vote of a majority of those present.
(3) When the co-chairpersons are all unable to perform their duties for any unavoidable reason, the vice-chairpersons shall act on their behalf, and in case of any accident to all of the co-chairpersons and vice-chairpersons, the senior in age of the participating members shall act on their behalf. (4) The Mayor or the chairperson may, if necessary, request the head of the agency (department) having jurisdiction over the relevant agenda item to participate in the meeting, from among the Offices, Headquarters, Bureaus and affiliated institutions of the Seoul Metropolitan Government.
(5) In any of the following cases, a chairperson or member of the Committee shall be excluded from the deliberation and conciliation of any agenda item thereof
1. Where he/she has interest in such agenda item;
2. Where he/she belongs to the same agency with a person related to such agenda item;
3. Where he/she is blood related to a person related to such agenda item.
(6) In cases falling under paragraph (5), a chairperson or member of the Committee may voluntarily refrain from the deliberation or conciliation of such agenda item.
(7) The Mayor may pay allowances, travel expenses, etc. to members who have attended the meeting of the Committee within the budget pursuant to the Seoul Metropolitan Government Ordinance on the Payment of Committee Allowances and Travel Expenses : Provided, That this shall not apply to a member who is a public official attending such meeting in direct relation to his/her duties.
(8) Except as otherwise prescribed by this Ordinance, matters necessary for the operation of the Committee shall be determined by the chairpersons via a resolution of the Committee.

Article 7 (Subcommittees) (1) The Committee shall have a subcommittee for future strategy and a subcommittee for industry-academia-research policy to efficiently implement the business affairs of the Committee.
(2) The functions of subcommittees shall be as follows:
1. The subcommittee for future strategy: Advice and deliberation on matters concerning basic plans, major policies and internal and external cooperation related to the promotion of future innovative technology in response to the 4th industrial revolution;
2. The subcommittee for industry-academia-research policy: Advice and deliberation on matters concerning projects for supporting research and development, projects for publicly demonstrating future innovative technology, science and technology contests, etc. designed for the development, commercialization, etc. of future innovative technology.
(3) The chairperson of each subcommittee (hereinafter referred to as a "subcommittee chairperson") shall be commissioned by the chairperson of the Committee from among the members of the Committee, and each subcommittee shall be comprised of not more than 10 persons.
(4) Subcommittees may conduct advance review of agenda items of the Committee; render practical advice thereto; and also advise and deliberate on special matters delegated from the Committee.
(5) Article 6 shall apply mutatis mutandis to the operation of subcommittees.

Article 8 (Decommission of Member) In any of the following cases, the Mayor may decommission a member of the member, even if his/her term of office has not expired:
1. Where he/she him/herself desires to be decommissioned;
2. Where he/she becomes unable to perform his/her duties due to a disease requiring long-term medical treatment or an overseas travel of six or more months;
3. Where he/she divulges any confidential information which he/she becomes aware of in relation to the duties of the Committee or uses it for his/her individual purpose;
4. Where he/she engages in any misconduct in relation to his/her duties or there occurs his/her misconduct which is deemed unfit to hold the office of a member of the Committee;
5. Where he/she fails to voluntarily refrain from the deliberation or conciliation, even though he/she is required to refrain therefrom;
6. Where he/she is deemed unfit to serve as a member of the Committee on the ground of neglecting duty, losing dignity or similar.

Article 9 (Public Demonstration Projects for Future Innovative Technology) (1) The Mayer may implement public demonstration projects for future innovative technology (hereinafter referred to as a "demonstration project") to support and foster technology-based enterprises.
(2) The Mayer shall, via a deliberation by the Committee, formulate an operation plan necessary for implementing a demonstration project under paragraph (1) each year.

Article 10 (Projects Eligible to Be Selected as Public Demonstration Project, and Other Relevant Matters) (1) Standards for selecting demonstration projects under Article 9 (1) shall be as follows:
1. A product or service the development of which has been completed and which is on the brink of commercialization;
2. A product or service requiring sales performance immediately after its release in the market;
3. Other product or service deemed by the Committee requiring policy-based support in order to foster future innovative technology.
(2) The Mayor shall make it a principle to quarterly assess the proposals for projects submitted by domestic or overseas enterprises holding future innovative technology; and then select demonstration projects among such proposed projects.
(3) When the Mayor selects demonstration projects under paragraph (2), he/she may, if necessary, decide both the methods by which demonstration projects, such as joint purchase and the designation and creation of demonstration complexes, can be efficiently implemented, and the administrative organization (department) or affiliated agency of the Seoul Metropolitan Government which supports demonstration projects.
(4) Notwithstanding paragraph (2), the Mayor may, if necessary, first determine and publicly announce the targets of demonstration projects; and then select the appropriate implementers of such projects from among applicants who have submitted project plans.

Article 11 (Management and Utilization of Outcomes) (1) If necessary for utilizing the outcomes achieved while implementing demonstration projects, the Mayor may disclose and share the outcomes of such projects, via a deliberation of the Committee.
(2) The parties concerned who directly or indirectly participate in any demonstration project shall cooperate with respect to such disclosure and sharing under paragraph (1).

Article 12 (Innovative Technology Contest) (1) The Mayor may hold an innovative technology contest (hereinafter referred to as the "contest") to discover the ideas for science and technology innovation and promote both collaboration and convergence of technologies.
(2) In order to activate contests under paragraph (1), the Mayor may provide opportunities for participation not only to the residents, universities, and enterprises of other local governments, but also to the foreigners, universities and enterprises residing or located abroad. (3) If necessary for efficiently conducting contests, the Mayor may establish a cooperative system among domestic or foreign governments, public institutions, universities, research institutes, enterprises, etc. in Korea and overseas and wholly or partially subsidize their necessary budget.

Article 13 (Support of Excellent Ideas) The Mayor may provide necessary support, such as expenses for subsequent research and development, and market development, to a person who has proposed excellent ideas discovered in contests under Article 12.

Article 14 (Exemption from Responsibility for Proactive Public Administration) The Mayor shall not pursue responsibility of any person, such as disciplinary action for the result of active handling of the affairs concerning demonstration projects or contests pursuant to Article 23-2 of the Act on Public Sector Audits, unless he/she handles such affairs by deliberation or gross negligence.

Article 15 (Entrustment, etc. of Business Affairs) (1) If necessary for efficiently implementing demonstration projects, contests, etc., the Mayor may entrust them to specialized institutions, etc. pursuant to the Seoul Metropolitan Government Ordinance on Entrustment of the Administrative Work to the Private Sector.
(2) The Mayor may separately determine and execute detailed procedures and methods necessary for implementing the projects prescribed in this Ordinance.
