SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON OPERATION AND MANAGEMENT OF THE CITIZENS HALL

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for the efficient operation and management of the citizens hall and for the general public to use the citizens hall.

Article 2 (Definitions of Terms) The definitions of terms used in this Ordinance shall be as follows: <Amended by Ordinance No. 5841, Apr. 2, 2015; Ordinance No. 6106, Jan. 7, 2016>
1. The term "citizens hall" (hereinafter referred to as the "citizens hall") means a space for various exhibitions, performances, and events, which is established and operated in a place deemed necessary by the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”), including buildings and facilities owned by the Seoul Metropolitan Government, in order to promote citizens' participation and communication;
2. The name of the citizens hall may be separately determined in consideration of the location, etc. thereof;
3. The term "space rental" means obtaining permission for using a respective space within the citizens hall to engage in the activities of exhibitions, performances, events, etc.;
4. The term "lessee" means any person who has obtained permission for a space rental in accordance with Article 8.

Article 3 (Opening and Closing) The citizens hall shall be daily open except on the following dates of closure: <Amended by Ordinance No. 5841, Apr. 2, 2015; Ordinance No. 6106, Jan. 7, 2016>
1. January 1st;
2. Lunar New Year's Day;
3. Chuseok;
4. Any dates determined by the Mayor as necessary for the operation of the citizens hall.

Article 4 (Use Fees) (1) No fee shall be charged for using the citizens hall.
(2) Notwithstanding paragraph (1), a fee may be collected from users with respect to certain exhibitions, performances, events, etc. planned by the Mayor himself or herself or hosted by a lessee.
(3) A use fee provided for in paragraph (2) may be determined, based on the feature, content, or scale of exhibitions, performances, events, etc., after consultation with the advisory committee for operation of the citizens hall provided for in Article 13 (hereinafter referred to as the "committee").

Article 5 (Free Use) (1) Notwithstanding Article 4 (2), the Mayor may not collect any use fee with respect to the following persons: <Amended by Ordinance No. 5841, Apr. 2, 2015>
1. State guests, diplomatic delegates, and their entourages;
2. A person of distinguished service to the State and his or her bereaved family or his or her family to be benefited under the Act on the Honorable Treatment of and Support for Persons, etc. of Distinguished Service to the State;
3. A person of distinguished service to independence and his or her bereaved family or his or her family to be benefited under the Act on the Honorable Treatment of Persons of Distinguished Service to Independence;
4. A person with disabilities and one guardian accompanying him or her to be benefited under the Act on Welfare of Persons with Disabilities;
5. A person accessing the citizens hall to perform public duties;
6. Senior citizens at the age of 65 years or more;
7. Bearers of Dadungi Happy Children Cards issued to those who have at least three children (including their family members registered on the card);
8. A person who has received a certificate of honorary citizenship conferred by the Seoul Metropolitan Government;
9. A foreign resident or multi-cultural family to be benefited under the Seoul Metropolitan Government Ordinance on Support for Foreign Residents and Multi-Cultural Families;
10. A North Korean refugee and his or her family members to be benefited under the Seoul Metropolitan Government Ordinance on North Korean Refugees Settlement Support;
11. Other persons the Mayor deems necessary for the operation of the citizens hall.
(2) The Mayor may, where necessary, directly facilitate or authorize a lessee to allow free use of the citizens hall for a certain period.

Article 6 (Prohibition of Use) Any of the following persons shall be prohibited from using the citizens hall:
1. A person under the influence of alcohol;
2. A person possessing any article which is dangerous, nasty-smelling, or disgusting;
3. Other persons the Mayor deems necessary to be prohibited from using the citizens hall to protect facilities, works, etc., or to maintain order in the use.

Article 7 (Prohibited Acts) Where a user engages in the following acts in the citizens hall, the Mayor may order the user to leave the citizens hall:
1. Smoking cigarettes, drinking alcoholic beverages, or eating food;
2. Causing inconvenience to other users, such as making a loud voice.

Article 8 (Permission for Space Rental) (1) The Mayor may grant permission for space rental for exhibitions, performances, events, etc., which can contribute to citizens' participation and communication, if the rental does not interfere with the operation of the citizens hall.
(2) A lessee shall not transfer and sublease his or her right, without obtaining the Mayor's approval therefor.
(3) In any of the following cases, the Mayor may cancel permission for space rental or suspend the use of the space:
1. Where a lessee fails to fulfill the purpose of the permission or fails to pay a space rental fee by a specified payment deadline;
2. Other cases where the Mayor deems it necessary to restrict the use of the citizens hall, taking into account users' safety and maintenance of the facilities.

Article 9 (Space Rental Fees) (1) A lessee shall pay a space rental fee no later than 10 days prior to the first date of use of the citizens hall: Provided, That where any inevitable circumstance arises, he or she may pay the fee no later than the date immediately preceding the first date of use.
(2) Space rental fees include any fee for using the relevant facilities and other charges for using supplementary facilities, including heating and air conditioning. In such cases, a fee for using heating and air conditioning and other supplementary facilities shall be calculated in proportion to a fee for using gas or electricity.
(3) Except as provided in this Ordinance with respect to the collection and refund of space rental fees and other accounting procedures, the Seoul Metropolitan Government Rule on Financial Accounting shall apply mutatis mutandis thereto.

Article 10 (Reduction of and Exemption from Space Rental Fees) (1) Where the Seoul Metropolitan Government is a sponsor or it is deemed necessary for public interests, the Mayor may fully or partially reduce or exempt space rental fees of the citizens hall, after consultation with the committee. <Amended by Ordinance No. 7104, May 2, 2019>
(2) Space rental fees may be reduced or exempted by up to 30/100 for a person who pays such fees through the simple payment system for micro enterprises (referring to a payment system operated by an institution designated by the Minister of SMEs and Startups in order to reduce payment fees borne by micro enterprises), as determined by the Mayor: Provided, That where the space rental fees can be reduced or exempted pursuant to paragraph (1), the higher reduction and exemption rate shall be applied. <Newly Inserted by Ordinance No. 7104, May 2, 2019>

Article 11 (Matters to Be Observed by Lessee) With respect to the facilities and equipment of the citizens hall, a lessee of the citizens hall shall exercise due care and fulfill obligations as a good manager during the period of use of the citizens hall.

Article 12 (Compensation for Damage and Measures for Indemnification) (1) Where a user of the citizens hall destroys or damages the facilities or works of the citizens hall, he or she shall, without delay, compensate for any damage thereto; and in cases of space rental, the lessee shall be responsible for maintaining the facilities, works, etc., of the citizens hall.
(2) Where a lessee fails to fulfill his or her duty to manage the citizens hall during the period of space rental and damages the facilities or equipment thereof, he or she shall compensate for such damage or restore them to their original conditions.

Article 13 (Establishment and Function of Advisory Committee for Operation of Citizens Hall) The Mayor may establish and operate a committee to seek consultation on the following matters:
1. Matters on setting a direction of policy regarding the citizen hall and promoting such policy;
2. Matters on formulating and modifying major business plans for the citizens hall;
3. Other matters the Mayor deems necessary for the efficient management and operation of the citizens hall.

Article 14 (Composition of Committee) (1) The committee shall be composed of at least 10 and not more than 15 committee members including one chairperson and one vice chairperson.
(2) The committee members shall be appointed or commissioned by the Mayor from among the following persons:
1. A person who has abundant expertise and experience concerning exhibitions, performances, events, etc. to promote citizens' participation and communication;
2. A member of the Seoul Metropolitan Council who belongs to any competent standing committee under the Seoul Metropolitan Council;
3. A competent Director-General of the Seoul Metropolitan Government who is responsible for the citizens hall;
4. Other persons the Mayor deems necessary for the operation of the citizens hall.
(3) The chairperson and the vice chairperson shall be elected by the committee.
(4) The term of a member of the committee shall be two years and may be extended only once: Provided, That the term of a member newly appointed or commissioned due to the vacancy of his or her predecessor shall be the remaining term of the predecessor. <Amended by Ordinance No. 6386, Jan. 5, 2017>
(5) In any of the following cases, the Mayor may dismiss a committee member:
1. Where he or she voluntarily wishes resignation;
2. Where he or she is unable to perform his or her duties diligently due to disease, long-term absence, injury to dignity, etc.

Article 15 (Duties of Chairperson) (1) The chairperson shall represent the committee and exercise overall control of its affairs.
(2) The vice chairperson shall assist the chairperson and act on his or her behalf where the chairperson is unable to perform his or her duties due to inevitable grounds.

Article 16 (Meetings) (1) Meetings of the committee shall be convened by the chairperson where requested by the Mayor or at least 1/3 of the incumbent members of the committee.
(2) Where the chairperson intends to convene a meeting, he or she shall notify each member of the committee in writing of the date and time, venue, and agenda of the meeting no later than three days prior to the date of the meeting.
(3) A majority of the members of the committee shall constitute a quorum and any decision thereof shall require the concurring vote of a majority of those present.
(4) No member of the committee shall participate in any meeting where an agenda is related to his or her interest.

Article 17 (Allowances) Allowances, travel expenses, etc. may be paid to a member of the committee who attends its meetings within budgetary limits: Provided, That this shall not apply where a member of the committee who is a public official attends a committee meeting in direct connection with his or her duty.

Article 18 (Entrustment of Operation and Management) (1) The Mayor may entrust the affairs regarding the operation and management of the citizens hall to a corporation, an organization, or an individual.
(2) Each person who is entrusted with the operation and management of the citizens hall pursuant to paragraph (1) shall determine detailed provisions on the citizens hall, including the time of use, date of closing, space rental, use fees, the establishment and operation of amenities, etc. and shall obtain the Mayor's approval of the detailed provisions, and the same shall apply where such provisions are to be amended.
(3) Except as provided in this Ordinance, the procedures and methods for entrusting the operation and management of the citizens hall and other necessary matters shall be governed by the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector.

Article 19 (Establishment and Operation of Amenities) (1) For convenience of users of the citizens hall, the Mayor may establish and operate amenities inside the citizens hall.
(2) Where the Mayor deems it necessary to efficiently operate the facilities under paragraph (1), he or she may rent the facilities to or entrust the operation thereof to another person, applying mutatis mutandis the Seoul Metropolitan Government Ordinance on Public Property and Commodity Management.

Article 20 (Enforcement Rules) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Metropolitan Government.
