SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF SEOUL ENGLISH VILLAGE

Article 1 (Purpose) The purpose of this Ordinance is to provide for matters necessary for the establishment and operation of Seoul English and Creativity Village in order to provide citizens with opportunities to experience the culture of English-speaking areas and enhance creativity and opportunities for lifelong education. <Amended by Ordinance No. 4944, Mar. 2, 2010; Ordinance No. 6572, Jul. 13, 2017>

Article 2 (Definition) The terms used in this Ordinance shall be defined as follows:
1. The term "Seoul English Village" refers to facilities that the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") establishes and operates in order to provide opportunities to experience the culture of English-speaking areas;
2. The term "Seoul Creativity Village" refers to facilities that the Seoul Government establishes and operates in order to provide the youth, etc. with programs that help improve their creative thinking skills through participation and experience.

Article 3 (Name of Seoul English and Creativity Village) The name and location of the Seoul English Village that the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") establishes and operates pursuant to this Ordinance shall be as set out in attached Table 1. <Amended by Ordinance No. 4944, Mar. 2, 2010; Ordinance No. 6572, Jul. 13, 2017>

Article 4 (Eligible Users) Persons who are eligible for the use of the Seoul English and Creativity Village shall be as specified in the following subparagraphs: Provided, That the youth under subparagraph 1 of Article 3 of the Framework Act on Youth shall be given priority for the use: <Amended by Ordinance No. 4944, Mar. 2, 2010; Ordinance No. 6572, Jul. 13, 2017>
1. Persons registered as residents of the Seoul Government;
2. Persons enrolled in a school in the Seoul Government;
3. Persons who have a job in the Seoul Government;
4. Persons whom the Mayor considers necessary.

Article 5 (User Fees) (1) The Mayor shall impose user fees on persons who use the Seoul English and Creativity Village and collect user fees from such persons. <Amended by Ordinance No. 4944, Mar. 2, 2010; Ordinance No. 6572, Jul. 13, 2017>
(2) The Mayor shall determine the user fees for the Seoul English and Creativity Village within the limits set out in attached Table 2 and shall publicly notify the general public thereof through the Official Gazette of the Seoul Metropolitan Government. <Amended by Ordinance No. 4944, Mar. 2, 2010; Ordinance No. 6572, Jul. 13, 2017>

Article 6 (Exemption from User Fees) (1) The Mayor may exempt the following users from user fees under Article 5 within the budget: <Amended by Ordinance No. 4944, Mar. 2, 2010>
1. Beneficiaries under Article 3 of the Medical Care Assistance Act or the youth who are family members of such beneficiaries;
2. The youth registered as the disabled under the Act on Welfare of Persons with Disabilities;
3. The youth admitted to social welfare facilities under the Social Welfare Services Act;
4. The youth of persons entitled to the protection under Article 5 of the Single-Parent Family Support Act;
5. Other youth whom the Mayor considers necessary to exempt from user fees since they are eligible for social care.
(2) When the youth who hold a Dadungi Happy Children Card (referring to a card issued to a family with two or more children in the Seoul Government) intends to use the Seoul English and Creativity Village, the Mayor may reduce user fees by 50 percent for them. The foregoing shall apply only where the number of children registered in a Dadungi Happy Children Card is not less than three persons. <Newly Inserted by Ordinance No. 4944, Mar. 2, 2010; Ordinance No. 6572, Jul. 13, 2017; Ordinance No. 7116, May 2, 2019>
(3) Where the user fees referred to in Article 5 are paid by a simple payment system for micro enterprises (referring to a payment system operated by an agency that the Minister of SMEs and Startups designates to reduce payment fees borne by micro enterprises), such user fees may be reduced by up to 5/100 of the fees, as prescribed by the Mayor: Provided, That the same shall not apply where the user fees are reduced under paragraph (2). <Newly Inserted by Ordinance No. 7116, May 2, 2019>
[Paragraph 3 of this Article shall be effective until December 31, 2019 under Article 2 of the Addenda of Ordinance No. 7116 (May 2, 2019)]

Article 7 (Refund of User Fees) (1) The Mayor shall refund the user fees under Article 5 in any of the following cases: <Amended by Ordinance No. 4944, Mar. 2, 2010; Ordinance No. 6572, Jul. 13, 2017>
1. Where the Seoul Government or a person entrusted with the management and operation of the Seoul English and Creativity Village fails to provide an educational program or a place of education of the Seoul English and Creativity Village due to the circumstances of the Seoul Government or such a person;
2. Where a person who has already paid user fees is unable to use the Seoul English Village due to any unavoidable cause.
(2) If any of the causes of refunding user fees under paragraph (1) occurs, the Mayor shall refund the full amount of the user fees already paid, if the lesson has not begun yet, or the user fees for the remaining lesson days excluding the elapsed lesson days, if the lesson has already begun, within five days from the day on which a request for refund is filed. <Amended by Ordinance No. 4944, Mar. 2, 2010>

Article 8 (Entrustment of Management and Operation) (1) The Mayor may entrust a superintendent of eduction, legal entity, organization, or individual with the management and operation of the Seoul English and Creativity Village. <Amended by Ordinance No. 6572, Jul. 13, 2017>
(2) A person to whom the management and operation of the Seoul English and Creativity Village is entrusted shall establish and enforce rules necessary for the management and operation of the facilities. In such cases, the person shall obtain approval from the Mayor of the rules on the management and operation of the facilities and any intended amendment to the rules. <Amended by Ordinance No. 4944, Mar. 2, 2010; Ordinance No. 6572, Jul. 13, 2017>
(3) If the Mayor entrusts a person with the management and operation of the Seoul English and Creativity Village, he or she may require the person to apply the Rules on Finance and Accounting of Social Welfare Institutions and Social Welfare Facilities mutatis mutandis to budgeting and accounting. <Amended by Ordinance No. 6016, Oct. 8, 2015; Ordinance No. 6572, Jul. 13, 2017>

Article 9 (Application Mutatis Mutandis of Other Ordinances of the Seoul Government) Except as provided in this Ordinance, the Seoul Metropolitan Government Ordinance on Establishment and Operation of Youth Facilities and the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector shall apply mutatis mutandis to the management and operation of the Seoul English and Creativity Village. <Amended by Ordinance No. 6572, Jul. 13, 2017>
