SEOUL METROPOLITAN GOVERNMENT ENFORCEMENT RULE ON THE ORDINANCE ON USE AND MANAGEMENT OF SEOUL PLAZA

Article 1 (Purpose) The purpose of this Rule is to provide for matters delegated by the Seoul Metropolitan Government Ordinance on Use and Management of the Seoul Plaza and matters necessary for enforcing said Ordinance.

Article 2 (Reporting of Usage) (1) A person (hereinafter referred to as "reporting person") who intends to use the Seoul Plaza (hereinafter referred to as the "Plaza") pursuant to Article 5 (1) of the Seoul Metropolitan Government Ordinance on Use and Management of the Seoul Plaza (hereinafter referred to as the "Ordinance") shall file a report on use of the Plaza in the form attached to the Ordinance, in person or by post, facsimile, electronic mail, or similar means.
(2) Upon receipt of a report on use of the Plaza under paragraph (1), the division in charge of processing such report (hereinafter referred to as "responsible division") shall enter the details of the usage report in the Register of Reports on Use of the Plaza in attached Form 1; and shall issue a receipt to the reporting person in the form prescribed in the Enforcement Rule of the Civil Petitions Treatment Act: Provided, That the responsible division need not issue a receipt, if a report has been filed by post, facsimile, electronic mail, or similar means.

Article 3 (Disclosure of Status of Processing of Reports) The responsible division shall disclose the processing status of each report via the website of open plazas of the Seoul Metropolitan Government (hereinafter referred to as the "website") immediately after receiving each usage report: Provided, That facts related to personal information shall not be disclosed.

Article 4 (Amendment of Report Documents) (1) If any of the documents submitted by a reporting person has a defect, the responsible division shall request the reporting person to amend the document, without delay, within the period specified as reasonably necessary for amendment.
(2) A request to amend documents submitted by a reporting person shall be made to the person, in writing, orally, by telephone, facsimile, e-mail, or any means; however, such request shall be made in writing, if a reporting person expressly so requests.
(3) If a reporting person fails to amend a document within a period specified in paragraph (1), the report shall be processed in accordance with the Civil Petitions Treatment Act and other relevant statutes and regulations.

Article 5 (Acceptance of Usage Report for Following Year) (1) A person who intends to use the Plaza in the following year pursuant to Article 5 (2) of the Ordinance shall file a report on use of the Plaza in the form attached to the Ordinance within the period specified for filing a report on use of the Plaza in the following year.
(2) The dates to use the Plaza in the following year under paragraph (1) shall be certain dates between the 1st of January and the 31st of December each year, and the period for filing a usage report shall be from the first Monday to the third Monday of August annually.
(3) Where a report for use of the Plaza in the following year is filed pursuant to paragraph (1), Article 2 shall apply mutatis mutandis to the methods of submitting the usage report and matters relating to entries in the register of reports on use of the Plaza and issuance of receipts.
(4) In accepting usage reports pursuant to paragraph (1), the Mayor may preferentially accept reports for any of the following events:
1. A State or local government event in connection with a national holiday, public holiday, or memorial day specified by relevant statutes and regulations;
2. An event for which the Plaza has been used in connection with a national holiday, public holiday, or memorial day specified by relevant statutes and regulations, during recent three years immediately before the year in which a usage report is filed;
3. An event for which the Plaza has been used annually and for which it is expected to take a considerable period to prepare;
4. Other events held for public interest according to a resolution by the Seoul Metropolitan Government Ordinance on Establishment and Operation of Citizens Committee for Operation of Open Plaza.
(5) When the Mayor intends to receive usage reports pursuant to paragraph (1), he/she shall give public announcement of the events eligible for the reporting of usage, the period for filing reports, etc. via the website, etc. for at least ten days. <Amended by Rule No. 3543, Feb. 23, 2017>
(6) In determining whether to accept usage reports filed pursuant to paragraph (1), the Mayor shall disclose his/her determination immediately via the website, etc: Provided, That no personally identifiable information shall be disclosed.

Article 6 (Order of Priority of Usage Reports) The order of priority of usage reports under Article 6 (2) of the Ordinance shall be applicable only to the working hours from 9:00 to 18:00 (hereinafter referred to as "working hours") during normal working days; reports filed after 18:00, but before 9:00 a.m. on the following day, shall be deemed filed at 9:00 a.m. on the following working day; while reports filed on a Saturday or public holiday shall be deemed filed at 9:00 a.m. on the next working day.

Article 7 (Notice of Allowance) Notice of allowing use of the Plaza under Articles 5 (2) and (3) and 7 (1) of the Ordinance shall be given in attached Form 2 (Receipt of Report on Use of the Plaza) and shall be accompanied by conditions, etc. attached to such acceptance.

Article 8 (Rules to Be Observed) The rules that a user shall observe pursuant to subparagraph 2 of Article 9 of the Ordinance are as follows:
1. A user shall use the designated place only during the designated hours;
2. A user shall pre-consult on any change in reported equipment;
3. A user shall maintain public order and keep the Plaza clean;
4. No user shall engage in advertising or selling goods for profit;
5. A user shall take safety measures for preventing accidents;
6. The level of sound from audio equipment shall not exceed the reported range;
7. No user shall hinder free passage of citizens or engage in any offensive conduct;
8. No user shall hold any sports event likely to damage the lawn or any other facility in the Plaza.

Article 9 (Guidelines for Usage Fees) The guidelines for usage fees for the Plaza under Article 10 (1) of the Ordinance are as prescribed in the attached Table.
