SEOUL METROPOLITAN GOVERNMENT ENFORCEMENT RULE OF THE ORDINANCE ON THE PROMOTION OF HUMAN RIGHTS OF PERSONS WITH DISABILITIES

SEOUL METROPOLITAN GOVERNMENT ENFORCEMENT RULE OF THE ORDINANCE ON THE PROMOTION OF HUMAN RIGHTS OF PERSONS WITH DISABILITIES

Article 1 (Purpose) The purpose of this Rule is to define matters necessary for implementation of enforcement of the Ordinance on the Promotion of Human Rights of Persons with Disabilities.

Article 2 (Establishment of Master Plans on Promotion of Human Right of Person with Disabilities) (1) The head of project department shall establish a project plan by field and stage before end of November of the year in which the master plan expires for establishment of a master plan concerning promotion of human rights of persons with disabilities (hereinafter referred to as “master plan”) under Article 5 (1) of the Seoul Metropolitan Government Ordinance on the Promotion of Human Rights of Persons with Disabilities (hereinafter referred to as the “Ordinance”). <Amended by Rule No. 3416, Mar. 12, 2015>
(2) The head of department related to welfare policies for persons with disabilities shall establish a next master plan before end of January of the first year in which the next plan begins based on the project plan and promotion results by field and stage under paragraph (1). In such cases he/she shall collect the opinion of citizens, etc. through public hearings and discussion forums. <Amended by Rule No. 3416, Mar. 12, 2015>

Article 3 (Functions of Center for Human Rights of Persons with Disabilities) (1) The affairs of the Seoul Metropolitan Government Center for Human Rights of Persons with Disabilities under Article 8 (1) of the Ordinance (hereinafter referred to as “center”) shall be as follows, and the gender of persons with disabilities shall be considered in implementation of the affairs:
1. Counselling and management of cases concerning infringement of human rights of person with disabilities;
2. Education and development of programs for promotion of human rights of persons with disabilities;
3. Matters concerning investigation on and remedy for discrimination of human rights of persons with disabilities;
4. Other matters necessary for protection and advancement of human rights of persons with disabilities.
(2) The center may jointly investigate the applicable matters with the department related to welfare policies for persons with disabilities of the Seoul Metropolitan Government (hereinafter referred to as the “Seoul Government”) if falling under any of the followings:
1. Where the counselling request is received concerning infringement of persons with disabilities;
2. Where the cases of discrimination of human rights of persons with disabilities occur in the center falling under any of the followings:
(a) The Seoul Government and its affiliated administrative agencies;
(b) Autonomous Gus (restricted to affairs entrusted by the Seoul Government);
(c) Institutions established with investment and contribution by the Seoul Government;
(d) Institutions for entrusted affairs of the Seoul Government (restricted to entrusted affairs from the Seoul Government);
(e) Various welfare facilities on which the Seoul Government support.
(3) The Mayor may entrust the operation of the center to a specialized institution.
(4) Other matters necessary for entrusted operation of the center shall be determined by the Seoul Metropolitan Government Ordinance of Establishment and Operation of Social Welfare Facilities.

Article 4 (Participation of Investigation of Relevant Experts, etc.) Applicants for counselling, directors and staff of citizens’ organizations, and relevant experts may participate if necessary for proceeding of investigation related to the operation of the center. In such cases, allowances, etc. may be paid within the budget to persons who participate in the investigation.

Article 5 (Financial Support on Center for Human Rights of Persons with Disabilities) (1) The Mayor may support on all or part of the expenses necessary for implementation of the each subparagraph of Article 3 (1) within the budget concerning the center.
(2) The Seoul Metropolitan Government Ordinance on Management of Subsidies shall apply to detailed matters concerning the financial support of the center under paragraph (1).

Article 6 (Provision, etc. of Subsidies for Information Provider) (1) Where a person contributes to identifying the truth of infringement of human rights or discrimination act in the residence facilities of persons with disabilities by reporting, subsidies may be paid within the budget after deliberation of Promotion Committee on Human Rights of Persons with Disabilities (hereinafter referred to as the “committee”) provided in Article 10 (1) of the Ordinance.
(2) The committee shall exclude the following cases from subjects to subsidies when it deliberates on whether to pay under Article 11 (2) of the Ordinance:
1. In cases an official or a worker of public institutions, implementing the affairs related to persons with disabilities, reports;
2. In cases the event is under investigation or is terminated because the report is received by another agency;
3. In cases the reporter has performed illegal act related to the report.
(3) Where a subject to payment of subsidies is determined under paragraph (2), the upper limit of subsidies shall be calculated as prescribed by the Attached table per event, and the subsidies shall be paid thereto in consideration of the followings:
1. Accuracy of evidences and materials submitted or discovered;
2. Merits directly contributed to identifying the applicable event;
3. Relative importance of infringement of human rights and discrimination act.
(4) Where there are more than two persons subject to subsidies to the same event, the subsidies shall be distributed and paid in deliberation of the committee in accordance with each person’s contribution and merits in the range of the upper limit.
(5) The subsidies shall be paid to the account of which name is that of a subject to payment, but the period of payment may be adjusted in accordance with needs.
