CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance shall be to establish a sustainable food system in Seoul Metropolitan City and guarantee food for citizens thereof by prescribing basic matters so that healthy and safe food can be secured for citizens thereof.

Article 2 (Basic Principles) (1) The Seoul Metropolitan City (hereinafter referred to as the "City") and citizens thereof (hereinafter referred to as "Citizens") shall recognize the fact that food is connected to a wide range of areas, such as society, economy, health, environment, culture, etc. and develop an integrated and comprehensive food system encompassing production, processing, distribution, consumption, disposal, etc. of food.
(2) A fair and just food system shall be developed through the food policy coupled with policies for health, welfare, employment, housing, urban planning, etc.
(3) A food system shall be developed in which all Citizens can easily access fresh and nutritious foods without discrimination.
(4) A food system shall be developed in which urban and rural communities can coexist and small and medium family farms are considered for future food security.
(5) A food system shall be developed which is environment friendly and considerate of the preservation of the ecosystem to be able to preserve biodiversity and cope with climate change.

Article 3 (Definitions) The terms used in this Ordinance are defined as follows: <Amended on Dec. 31, 2020>
1. The term "food" refers to food products and agricultural, fishery, and livestock products or all food processed with such products as raw materials. However, what is ingested as medicine are excluded;
2. The term "right to food" refers to a right with which everyone shall be able to secure healthy and safe food in a stable manner;
3. The term "food security" refers to a state in which everyone can obtain safe and nutritious food, sufficiently in physical, social, and economic terms, according to his/her liking in order to lead an active and healthy life at all times;
4. The term "coexistence of urban and rural communities" refers to a relationship that develops together through human exchange for mutual advancement among cities and farming and fishing villages and the exchange, trade, provision, etc. of products such as agricultural, fishery, livestock products, experience, services, etc.;
5. The term "small and medium family farms" refers to producers seeking to produce multiple items based on their labor or that of their family thereof, among those who are engaged in agriculture under subparagraph 1 of Article 3 of the Framework Act on Agriculture, Rural Community and Food Industry;
6. The term "food system" refers to a structure in which the whole process encompassing food production, processing, distribution, access, consumption, cooking, disposal of food waste, etc. is integrated and connected;
7. The term "sustainable food system" refers to a food system which is realized together with a civil society so that future generations can secure healthy food based on a value of coexistence in a stable manner.
8. The term "youth training facility" refers to a facility under subparagraph (1) of Article 10 of the Youth Activity Promotion Act;

Article 4 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall enforce a food policy that considers the health, society, environment, etc. of Citizens in an integrated manner.
(2) The Mayor shall endeavor to establish and enforce a comprehensive and systematic food policy, formulate a plan for administrative and financial support necessary for enforcement, and secure healthy and safe food.
(3) The Mayor shall provide Citizens with information on the food policy.
(4) The Mayor shall promote the relevant policy and project so that the City can reinforce its competitiveness in terms of food through active exchange and cooperation with foreign cities.

Article 5 (Rights, Roles, etc. of Citizens) (1) Citizens shall have the right to properly intake food necessary to keep themselves in good health.
(2) Citizens shall have the right to easily receive accurate food information.
(3) Citizens shall endeavor to recognize the fact that the intake of food is not just the act of consuming but an act to be interconnected in terms of society, environment and ecology and develop a sustainable food system through reasonable food selection. <Amended on Dec. 31, 2020>

Article 6 (Relation with Other Ordinances) The enforcement and promotion of food policy shall be governed by this Ordinance, unless stipulated otherwise by other ordinances.

CHAPTER II FORMULATION OF A FOOD POLICY MASTER PLAN Article 7 (Formulation of a Master Plan) (1) The Mayor shall formulate and implement a master plan for food policy (hereinafter referred to as the "Master Plan") every 5 years.
(2) The Master Plan under paragraph (1) above shall include the following:
1. Basic direction and promotion direction;
2. Core task, objective, and implementation plan by field and step;
3. Scale of required resources, financing method, and support system;
4. Matters concerning the organization and operation of a private-public cooperation system, such as the Seoul Metropolitan Government Citizens' Food Committee (hereinafter referred to as the "Committee") under Article 21;
5. Matters concerning the improvement of related systems; and
6. Other matters that the Mayor recognizes as necessary.
(3) When formulating the Master Plan or revising the main contents of the Master Plan so formulated, the Mayor shall go through the deliberation done by the Committee.
(4) The Mayor may collect opinions of Citizens through public hearing, debate, etc., when formulating the Master Plan.

Article 8 (Formulation of an Annual Implementation Plan) The Mayor shall formulate and enforce an implementation plan for food policy every year to promote the Master Plan.

Article 9 (Seoul Food Chart) The Mayor shall enact and declare the Food Chart to realize Citizens' right to food and make Seoul a sustainable food city.

Article 10 (Civilian Experts) Where it is determined that it is necessary to commission civilian experts, the Mayor may commission civilian experts under the Seoul Metropolitan Government Ordinance on the Participation and Support for Civilian Experts in Municipal Affairs.

CHAPTER III SUSTAINABLE FOOD POLICY Article 11 (Certification of Good Food Stores) (1) The Mayor may certify, as a good food store, the following stores, food vending machines, etc. to create a healthy food environment in the City:
1. Food stores, food vending machines, etc. that contribute to the expansion and creation of a space for the sale of fruits and vegetables;
2. Good children's favorite food stores in the youth training facilities designated by an autonomous Gu head under paragraph (1) of Article 7 of the Special Act on Safety Management of Children's Dietary Lifestyle; or
3. Other stores that the Mayor recognizes as necessary.
(2) Stores, food vending machines, etc. so certified may label the certification as determined by the Mayor.
(3) Detailed matters, such as labeling of the certification of good food stores, procedures for application, standards for evaluation, etc. shall be prescribed as rules.

Article 12 (Establishment of Standards, etc.) (1) The Mayor shall establish the food security standards of the City so that Citizens can easily understand and participate in the policy for food security.
(2) The Mayor shall enact the standards for provision of safe food and develop and disseminate a policy therefor.
(3) The Mayor shall have the City and organizations affiliated therewith sell and provide food that meets the standards for provision of safe food and may recommend other non-government organizations to practice the standards. <Amended on Dec. 31, 2019>
(4) Detailed matters, such as the standards for food security, the standards for provision of safe food, etc. shall be enacted as rules.

Article 13 (Establishment and Evaluation of Indexes) (1) The Mayor shall prepare and publicly announce the indexes for food policy after consulting with the Committee.
(2) The Mayor may evaluate the City's food policy by applying the indexes for food policy under paragraph (1) above.

Article 14 (Statistics and Information) (1) The Mayor shall collect and manage statistics and information regarding food security, health, nutrition, etc. so that they could be used for the policy, project, etc. for food.
(2) The Mayor shall collect the statistics and information under paragraph (1) above based on accurate facts, such as declarations and questionnaires, and basic data shall be accurately and detailedly collected.
(3) The Mayor may use the collected statistics and information to formulate the Master Plan under Article 7.

Article 15 (Survey) (1) The Mayor may conduct following surveys to develop a sustainable food system:
1. A survey of Citizens' food and nutrient consumption, dietary lifestyle, and nutritional status;
2. A survey of Citizens' food security;
3. A survey of Citizens' food distribution system and status, matters concerning food safety and health, generation, disposal, etc. of food waste; and
4. Other surveys that the Mayor recognizes as necessary.
(2) The Mayor shall conduct the survey of Citizens' food system on a regular basis.
(3) Where it is necessary for surveys under paragraph (1) above, the Mayor may consign research institutes and organizations specialized in food to conduct the surveys.

Article 16 (Participation of Citizens) The Mayor may provide support and take measures so that Citizens can participate in the establishment, enforcement, etc. of food policy.

Article 17 (Food Support) (1) Food support is for Citizens or persons in need thereof among Citizens.
(2) Citizens shall conduct, on a regular basis, an investigation of who needs food support.
(3) Citizens shall inspect, on a regular basis, the operation of a system that finds who needs food support and formulate a plan for improvement thereof.
(4) Other detailed matters necessary for food support shall be prescribed as rules.

Article 18 (Cooperation, Support, etc. for Related Agencies and Organizations) (1) The Mayor shall actively cooperate with central administrative agencies and their affiliate agencies, local governments, relevant agencies, other organizations, etc. for the implementation of the Master Plan for food policy.
(2) The Mayor may support the expenses necessary to promote food-related activities performed by civil society organizations.

Article 19 (Food Crisis Management) The Mayor shall do the following: prevent food crises caused by various disasters; establish crisis management countermeasures to be able to minimize damage caused to Citizens by promptly responding to the crisis, if any; and take necessary measures.

Article 20 (Education and Promotion) (1) The Mayor shall carry out food education to reinforce Citizens' capability to improve their health and select food and develop and supply programs and data necessary for the education.
(2) The Mayor may promote the food policy with various methods, such as mass media, City websites and related agencies, etc.

CHAPTER IV SEOUL METROPOLITAN GOVERNMENT CITIZENS' FOOD COMMITTEE Article 21 (Establishment of the Committee) The Mayor may establish and operate the Committee to continue promoting, expanding, and developing the food policy.

Article 22 (Functions of the Committee) The Committee shall deliberate and consult about the following:
1. Direction of food policy and integrated coordination thereof;
2. Formulation and change of the food policy Master Plan;
3. Establishment and public announcement of food policy indexes;
4. Cooperation with civil societies, industries, academia, central administrative agencies, local governments, etc.;
5. Development of a governance model for the Master Plan for food policy and promotion of projects;
6. Creation of an environment to realize a sustainable food system through the participation of Citizens; and
7. Other matters that a chairperson submits to a meeting.

Article 23 (Organization) (1) The Committee shall comprise not more than 105 members including 2 chairpersons (excluding ex-officio members) and members of a specific gender shall not exceed 6/10 of the number of commissioned members. <Amended on Jan. 9, 2020>
(2) Members are appointed or commissioned by the Mayor from among persons that fall under any of the following subparagraphs: <Amended on May 16, 2019>
1. Ex-officio members: Vice-Mayor I for administrative affairs, Director-General for policy planning, Director-General for women & family policy affairs, Director-General for welfare policy, Director-General for lifelong education, and Director-General for citizens' health
2. Commissioned members: People commissioned by the Mayor from among people with sufficient experience in the realization of a sustainable food system and food security and expertise and knowledge regarding food
(3) A term of office for commissioned members shall be 2 years and such members may serve consecutive terms only once; Provided, That a term of office of a supplementary member shall be his/her predecessor's remaining term of office. Where the remaining term of the predecessor is less than six months, no member shall be commissioned.
(4) The Committee may have 1 secretary and 1 clerk to manage its own affairs.
(5) A secretary of the Committee shall be a head of a food policy department and a clerk shall be a leader of the team in charge of the Committee. <Amended on Dec. 31, 2020>

Article 24 (Chairperson, etc.) (1) The Mayor and 1 person elected among commissioned members by mutual vote shall become joint chairpersons.
(2) The term of office of a chairperson elected by mutual vote of commissioned members shall be 2 years and such chairperson may serve consecutive terms only once. <Amended on Jan. 9, 2020>
(3) A chairperson shall supervise the affairs of the Committee and represent the Committee to the public.
(4) When a chairperson cannot perform his/her duties, a chairperson of the planning and coordination committee shall become an acting chairperson under Article 27.
(5) An auditor shall be elected by mutual vote of members. The auditor shall evaluate the activities of the Committee, audit its execution of public finance and submit the findings thereof to the Committee.

Article 25 (Advisor) A chairperson may commission an advisor with the consent of the Committee to obtain advice necessary to operate the Committee.

Article 26 (Meetings of the Committee, etc.) (1) A chairperson shall convene Committee meetings and be in the chair.
(2) Committee meetings shall be classified into regular meetings and special meetings. The regular meetings shall, in principle, be held once every six months and the special meetings shall be convened only in the following cases: <Amended on Dec. 31, 2019; Jan. 9, 2020>
1. When the Mayor requests to convene a meeting;
2. When 1/3 or more of registered members request to convene a meeting.
3. Where the chairperson recognizes as necessary.
(3) Where a chairperson convenes a meeting, the chairperson shall notify in writing members of the Committee of the date, time, place, and agenda of the meeting no later than 7 days before the date of the meeting; Provided, That the same shall not apply to urgent cases.
(4) Committee meetings shall be started when a majority of registered members are present and resolved by vote of a majority of members present.
(5) Meetings shall, in principle, be held in public and recorded in minutes; Provided, That the same shall not apply, where other statutes or ordinances stipulate to hold a meeting in private.
(6) A secretary of the Committee shall prepare and furnish the minutes and may have a stenographer prepare the minutes.

Article 27 (Planning and Coordination Committee) (1) The Committee shall install the Planning and Coordination Committee for efficient operation.
(2) Chairpersons of the Planning and Coordination Committee shall be the Vice-Mayor I for Administrative Affairs and 1 person who is designated by the chairperson of the Committee and is elected by mutual vote from among commissioned members recommended by the Committee. A term of office of the designated chairperson of the Planning and Coordination Committee shall be two years and he/she may serve consecutive terms only once. <Amended on Jan. 9, 2020>
(3) The Planning and Coordination Committee shall comprise around 25 members, such as 2 chairpersons, ex-officio members, chairpersons of subcommittees under Article 28; persons who are designated by a chairperson from among commissioned members recommended by the subcommittees, etc. <Amended on Jan. 9, 2020>
(4) The planning and coordination committee shall perform the following functions:
1. Consultation and coordination about main tasks, such as formulation of plans for the Committee, etc.;
2. Supervision and coordination about a budget for the Committee and settlement thereof; and
3. Matters delegated by the Committee and other urgent matters.
(5) Meetings of the Planning and Coordination Committee shall, in principle, be held once a month and may be held from time to time whenever a chairperson recognizes as necessary. <Amended on Jan. 9, 2020>

Article 28 (Subcommittees) (1) The Committee may have the following subcommittees deliberate and consult about the following matters to efficiently promote its tasks. Also, the Committee may coordinate its tasks after consulting the planning and coordination committee, if required. <Amended on Jan. 9, 2020>
1. Public food service subcommittee: Consultation and policy development for the spread of public food service through the coexistence of urban and rural communities, improvement of the quality and safety of public food service, nutritional improvement, establishment of a system to procure healthy food in public food service
2. Urban agriculture subcommittee: Revitalization of urban agriculture, project to revitalize education, public relation, etc. of urban agriculture
3. Food safety subcommittee: Provision of information and citizen education to prevent food safety accidents, consultation about early response to food safety accidents, projects to develop and revitalize policies
4. Food ecology and coexistence subcommittee: Revitalization of the coexistence of urban and rural communities in relation to food, urban resilience to cope with climate change, support activities, such as proposal of strategies, policies, etc. to resolve problems, such as food resource circulation (disposal, of food waste)
5. Food health security subcommittee: Development of guidelines for the improvement of sustainable healthy dietary life (noninfectious diseases, such as malnutrition, obesity, etc.), proposal of policy for the improvement of food accessibility of vulnerable social groups, support for proposal of strategies and policies for food security in preparation for disasters
6. Food community subcommittee: Vitalization of food-related social and economic organizations, proposal of strategies and policies for the reinforcement of cooperation among interested parties (food community, etc. of the City and autonomous Gus), support for finding of food resources with food community and development of strategies therefor
7. Food culture, education and public relation subcommittee: Education and public relation for the reinforcement of Citizens' capability to realize sustainable food in Seoul, activities to settle sustainable food culture and happy food culture, support for spread of the outcome of the 2030 Food Strategy

(2) Subcommittees may work in connection with other committees established and/or operated by the Mayor.
(3) Subcommittees shall comprise not more than 15 members including 1 chairperson and 1 manager. A chairperson of a subcommittee shall be elected by mutual vote from among members of the subcommittee. And a manager shall be appointed by the chairperson of the subcommittee with the consent of the subcommittee.
(4) Subcommittee meetings shall be held once every two months. And where a chairperson of the subcommittee recognizes as necessary or 1/3 or more members of the subcommittee demand, a meeting of the subcommittee may be held. <Amended on Jan. 9, 2020>

Article 29 (Holding of Public Hearings, etc.) Where it is recognized as necessary for performance of tasks, the Committee may request specialized agencies, organizations, etc. to investigate and research or hold public hearings, seminars, etc. to collect opinions of relevant experts and Citizens.

Article 30 (Request for Related Organizations, etc. to Cooperate) Where it is necessary in relation to performing of tasks, the Committee and subcommittees may have related public officials, experts, or members of other committees in relation to the agenda appear and state their opinions or submit materials and data.

Article 31 (Support for Activities) (1) The Mayor may provide the required expenses, such as subsidies, within a budgetary limit for organizations and individuals performing projects that the Committee implements.
(2) The Mayor may provide, within a budgetary limit, expenses required for investigation, research, public hearings, seminars, etc. under Article 29,

Article 32 (Grounds for Exclusion, Recusal, Abdication, and Dismissal of Members) (1) A member who has interests in agenda related to deliberation, advice, etc. shall be regarded as not qualified to deliberate or advise about the relevant agenda.
(2) Where it is difficult to expect that a member would advise, deliberate, and mediate the relevant agenda, a chairperson shall exclude such member from advice, deliberation, etc. of the relevant agenda.
(3) Where a member comes to know that he/she has interests in the relevant agenda, such member shall, for himself/herself, not participate in the deliberation, advice, etc. of the relevant agenda.
(4) Where a member falls under any of the following subparagraphs, the Mayor may cancel the commission even before the expiration of his/her term of office: <Amended on Dec. 31, 2019>
1. Where it is difficult for the member to perform his/her duties in good faith due to a disease which requires long-term medical care, other reasons, etc.;
2. Where it is determined that the member is not fit to perform his/her duties due to injury to dignity, long-term absence, revealing and abuse of secrets in connection with his/her duties; or
3. Where the member himself/herself opts for resignation.
(5) A person who falls under any of the following subparagraphs may not become a member:
1. A person who is sentenced to be a person under limited guardianship, or a person under adult guardianship or declared bankrupt but not yet reinstated;
2. A person in whose case 5 years have not passed since his or her imprisonment without labor or any heavier punishment as sentenced by a court was completely executed or exempted;
3. A person in whose case 2 years have not passed since he or she was sentenced to imprisonment without labor or any heavier punishment by a court and a term of suspension of execution expired; or
4. A person who is under suspension of sentence of his or her imprisonment without labor or any heavier punishment as sentenced by a court;

Article 33 (Allowance) The Mayor may provide, within a budgetary limit, allowances, travel expenses, etc. for members who attend meetings or participate in Committee activities as stipulated by Articles 26, Articles 27, and Articles 28 or people who attend meetings under Article 30; Provided, That the same shall not apply where public officials attend in relation to their duties.

Article 34 (Detailed Regulations) Matters necessary for the operation of the Committee in addition to what is prescribed by this Ordinance shall be determined by a chairperson with resolution of the Committee.

Article 35 (Term of the Committee) The Committee shall continue to exist until Sep. 21, 2022.

Article 36 (Enforcement Rules) Matters required to enforce this Ordinance shall be prescribed as rules.
