CHAPTER I GENERAL PROVISIONS
Article 1 (Purpose)
The purpose of this Ordinance is to prescribe the matters necessary for the efficient management and operation of Seoul Metropolitan City’s art galleries, thereby promoting culture and the arts and contributing to increased public enjoyment thereof.
Article 2 (Definitions)
The definitions of the terms used in this Ordinance shall be as follows: <Amended on Oct. 17, 2022>
1. "Art gallery materials" refers to the materials provided under subparagraph 4 of Article 2 of the Act on the Promotion of Museums and Art Galleries.
2. "Collection" refers to art “gallery materials” owned by Seoul Metropolitan City’s art galleries (hereinafter referred to as “Galleries”).
3. "Collected materials" refers to the materials owned by an art gallery.
4. "Rental" refers to the act of obtaining permission to use an exhibition room of an art gallery to exhibit works of art, etc.
5. "Loan" refers to the lending of an art gallery’s materials under according to specific terms and conditions.
6. To "collect" refers to an art gallery’s collecting of art gallery materials by such means as purchase, donation, gift, or management transfer.
Article 3 (Operated Facilities)
The facilities operated by Galleries under this Ordinance are as listed in the Annex. <Amended on Jul. 30, 2015; Oct. 17, 2022>
CHAPTER II OPERATION
Article 4 (Opening and Closure Dates)
The Galleries of Seoul Metropolitan City shall open every day, other than on the following holidays, and the exhibits shall be open to the general public.<Amended on Mar. 15, 2012; Oct. 17, 2022>
1. January 1;
2. Every Monday (Provided, however, that Seoul City’s Galleries shall not close on public holidays that fall on a Monday under Article 2 of the Regulations on Public Holidays of Government Offices or substitute public holidays under Article 3 of the same);
3. Days on which closure is deemed unavoidable by the Seoul Metropolitan City Mayor (hereinafter referred to as the “Mayor”) for operational reasons.
Article 5 (Visiting Hours)
The hours of Galleries shall be as follows: Provided, however, that the Mayor may extend the viewing hours under special circumstances. <Amended on Mar. 22, 2018>
1. Summer months (Mar.‒Oct.): 10:00 to 19:00;
2. Winter months (Nov.‒following Feb.): 10:00 to 18:00.
Article 6 (Admission Bars)
The following persons shall be barred from admission: <Amended on Oct. 5, 2020>

2. Any person who interferes with or may interfere with another person’s viewing of a Gallery’s exhibits;

4. Other persons whom the Mayor deems necessary to bar from admission in order to protect the exhibits of Galleries, etc.
Article 7 (Restricted Actions)
(1) Visitors may not engage in any of the following acts in the exhibition rooms of Galleries:
1. Smoking or drinking;
2. Lighting or filming without the Mayor’s permission;
3. Touching the exhibits;
4. Causing a nuisance to other visitors, such as loud speech or disorderly behavior;
5. Guiding a group without the Mayor’s permission.
(2) The Mayor may demand that a person engaging in any of the activities under the subparagraphs of paragraph (1) vacate the premises. <Amended on Jul. 30, 2015>
Article 8 (Admission Fees)
(1) The admission fees of Seoul City Galleries shall be as follows:<Amended on Jul. 30, 2015>
1. Permanent exhibitions and planned exhibitions of collections shall be free of charge;
2. The admission fees of planned exhibitions and special exhibitions shall be decided by the Seoul Metropolitan City Art Galleries Steering Advisory Committee (hereinafter referred to as the “Committee”) after deliberation, considering the size and importance of each exhibition: Provided, however, that free viewings shall be as determined in Article 9.
(2) An entity that rents an exhibition hall for an exhibition, etc. (hereinafter referred to as a “renter”) may collect admission fees. In such a case, the admission fees shall be determined by advance consultation with the Mayor.
(3) A planned exhibition that collects admission fees under paragraph (1) may discount the admission fees for any of the following persons:<Amended on Oct. 5, 2020; May 20, 2024>
1. A person who is visiting a Gallery within one month of patronizing a cultural or park facility operated (including operation by entrustment) by the Seoul Metropolitan Government or a Seoul Metropolitan City-funded institution designated by the Mayor;
2. A Climate Card user carrying a valid card.
(4) The discounted admission fees under paragraph (3) shall be determined by the deliberation of the Committee at up to 50% of the admission fees. <Added on May 20, 2024>
(5) A person who pays an admission fee and then cancels the visit shall be given a refund on the admission fee. <Added on Oct. 5, 2020; May 20, 2024>
Article 9 (Free Admission)
(1) In connection with the collection of admission fees under Article 8 (1) 2, the Mayor may waive the admission fee of any of the following persons:<Amended on Aug. 1, 2013; Jul. 30, 2015; Sep. 26, 2019; Oct. 5, 2020; May 20, 2021; Oct. 17, 2022; Mar. 26, 2024; May 20, 2024; Sep. 30, 2024; Jul. 14, 2025>
1. State guests, diplomatic delegations, and their retinue;
2. Children aged seven years or younger and seniors aged 65 years or older;
3. Persons with disabilities under the Act on the Welfare of Persons with Disabilities and one accompanying guardian each;
4. Persons falling under Article 86 (1) of the Enforcement Decree of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;
5. Persons prescribed in the subparagraphs of Article 17 (2) 1 of the Enforcement Decree of the Act on the Honorable Treatment of and Support for Persons Having Died or Been Injured for the Public Good;
6. Persons falling under Article 15 of the Enforcement Decree of the Act on the Honorable Treatment of Persons of Distinguished Service to Independence;
7. Persons falling under subparagraph 2 of Article 2 of the Act on the Honorable Treatment of War Veterans and Establishment of Related Associations;
8. Persons falling under any subparagraph of Article 8-3 of the Act on Assistance to Patients Suffering from Actual or Potential After Effects of Defoliants and Establishment of Related Organizations;
9. Persons falling under any subparagraph of Article 52 (1) of the Enforcement Decree of the Act on the Honorable Treatment of Persons of Distinguished Service to the May 18 Democratization Movement and Establishment of Related Organizations;
10. Persons falling under Article 58 of the Enforcement Decree of the Act on the Honorable Treatment of Persons of Distinguished Service during Special Missions and Establishment of Related Organizations;
11. Family members of prisoners of war from places of detention under subparagraph 3 of Article 2 of the Act on the Repatriation, Treatment of the Republic of Korea Armed Forces Prisoners of War, and registered ex-prisoners of war under subparagraph 5 of that Article;
12. Holders of the Dadungi Happiness Card (including family members registered on the card) under Article 2 of the Seoul Metropolitan City Ordinance on Support for Childbirth and Childrearing;
13. Persons seeking access for the purpose of academic research;
14. Persons seeking access to perform public official duties;
15. Persons awarded the “Seoul Metropolitan City Honorary Citizen” certificate;
16. Holders of the “Prestigious Military Service Family” certificate subject to the honorable treatment of prestigious military service families under Article 2 of the Seoul Metropolitan Government Ordinance on the Honorable Treatment of Prestigious Military Service Families;
17. Persons falling under any of the subparagraphs of Article 67-5 (1) of the Enforcement Decree of the Act on Support for Persons Eligible for Veterans’ Compensation;
18. Veterans under Article 2 (1) 2 and 3 of the Support for Veterans Act;
19. Pregnant women and new mothers under the Seoul Metropolitan Government Ordinance on the Honorable Treatment of and Support for Maternity;
20. Other persons deemed especially necessary by the Mayor for Gallery operations.
(2) If admission fees are collected notwithstanding paragraph (1), the Mayor may designate a certain period for free admission or cause the renter to designate such period. <Amended on Jul. 30, 2015>

Article 10 (Admission Tickets and Their Sales and Receipt)
(1) Ticket sales and receipts shall be handled entirely by the Galleries for their own exhibits; however, advance ticket sales may be entrusted to the private sector.
(2) The selling and taking of admission tickets shall be the renter’s responsibility in a rental exhibition: Provided, however, that the renter may consult on entrusting the sale and receipt of admission tickets to the Gallery. <Amended on Jul. 30, 2015>
Article 10-2 (Visitation Statistics)
The Mayor shall manage the current statistics on the number of gallery visitors, etc. (including those who visit free of charge) based on objective and fair criteria.

CHAPTER III RENTAL, ETC.
Article 11 (Rental Permit)
The Mayor may permit the rental of Gallery facilities for art exhibitions, cultural events, etc. that may contribute to the development of culture and the arts, to the extent that they do not interfere with Gallery operations. <Amended on May 20, 2024>
Article 12 (Rental Term)
(1) A renter may utilize Gallery facilities during the following hours: <Amended on Mar. 22, 2018; Jul. 14, 2025>
1. Summer months (Mar.‒Oct.): 09:00 to 20:00;
2. Winter months (Nov.‒ Feb.): 09:00 to 19:00.
(2) Notwithstanding paragraph (1), the renter may extend the rental hours with the Mayor’s approval under special circumstances. <Amended on Jul. 30, 2015>
(3) Utilization for part of the hours prescribed in paragraph (1) shall be deemed a day of use.
Article 13 (Application for Rental Permit)
An entity seeking an exhibition hall rental permit shall fill in an application for a gallery rental permit as follows, and submit it within the period designated by the Mayor: <Amended on Jul. 30, 2015; Mar. 22, 2018; Mar. 25, 2021; May 20, 2024>
1. Include the name and address of the rental applicant (if an organization, the group’s name, location, and the address and name of the representative);
2. Include the framework plan for the exhibition;
3. State the quantity of exhibited works and the number of participating artists;
4. State the rental period (including the exhibition period and the days on which exhibits are moved in, installed, and taken down), rental space, and area of rental;
5. State whether admission fees will be collected (if collected, state the amount sought clearly).
Article 14 (Rental Permit Review)
The Mayor, on receiving a rental permit application under Article 13, shall decide whether or not to permit the rental after submitting it for review by the Committee, and shall notify the applicant of the result.<Amended on Jul. 30, 2015>
Article 15 (Rental Permit Restrictions)
The Mayor may refuse to permit a rental where it is found to be unsuitable for the operation of the Gallery, or if the review of the Committee finds it inappropriate.

Article 16 (Rental Fees)
(1) An entity that obtains a rental permit under Article 13 shall pay the rental fee no later than 10 days before the permitted rental date: Provided, however, that the renter shall pay the rental fees by the day before the exhibition if the renter is compelled to do so due to an unavoidable cause. <Amended on Jul. 30, 2015>
(2) The rental fee shall include the rent for the exhibition hall and the rent for annexed facilities such as air conditioning and heating. <Amended on Jul. 30, 2015>
(3) The rental fee shall be collected pursuant to the Seoul Metropolitan Government Ordinance on the Management of Public Property and Goods. <Amended on Oct. 17, 2022; Mar. 26, 2024>
(4) The rent for annexed facilities such as air conditioning and heating shall be assessed and collected pursuant to urban gas or electricity billing. <Amended on Jul. 30, 2015>
(5) Paid rental fees shall not be returned: Provided, however, that the same shall not apply in cases where the renter is unable to use the exhibition hall due to a cause that is not attributable to the renter. <Amended on May 20, 2024>
Article 17 (Rental Fee Discount)
(1) On the advice of the Committee, the Mayor may discount all or a part of the rental fees for events held, administered, or sponsored by the City and a Gallery.
(2) The scope of the rental fee discount shall be determined by the relevant rules.
Article 18 (Cancellation of Rental Permit)
The Mayor may cancel the rental permit, or restrict or suspend the utilization of the rented exhibition hall, under any of the following circumstances:<Amended on Jan. 7, 2016>
1. If the renter violates this Ordinance or any rule under this Ordinance;
2. If the exhibition room cannot be utilized due to force majeure such as a disaster.
Article 19 (Renter Obligations)
(1) Renters shall uphold a fiduciary duty of care for a Gallery’s facilities or installations during the rental period. <Amended on May 20, 2024>
(2) An entity who receives a rental permit under Article 13 may not assign such rights to a third party without obtaining the Mayor’s prior approval.<Amended on Jul. 30, 2015; May 20, 2024>
Article 20 (Payment of Damages and Compensation)
(1) Where a visitor to a Gallery’s own exhibition destroys or damages an exhibited work, etc., the visitor shall pay damages without delay; whereas, regrading a rental exhibition, the renter shall be wholly liable for management of the exhibited works, etc.
(2) If any Gallery facility or installation is damaged due to the renter’s failure to uphold the duty of care under the foregoing Article 19 (1), the renter shall pay damages or have the damaged facility or installation restored to its original state. <Amended on May 20, 2024>
CHAPTER IV COLLECTION AND MANAGEMENT OF GALLERY MATERIALS, ETC. <Amended on Oct. 17, 2022>
Article 21 (Gallery Materials Collection Master Plan)
(1) The Mayor may formulate a master plan to secure and gain ownership of outstanding gallery materials.
(2) A gallery materials collection master plan under paragraph (1) shall include the following:
1. Goal and fundamental direction of the gallery’s policy on the collection of gallery materials;
2. Analysis of the current status of gallery materials collection;
3. Establishment of a strategy for collecting materials and measures to improve the collection system;
4. Other matters necessary for a gallery materials collection master plan.

Article 22 (Purchase of Gallery Materials)
(1) The Mayor, when purchasing works of art, etc. deemed to be sufficiently valuable for Gallery ownership, shall do so within the available budget after deliberation by the Art Gallery Materials Recommendation Council, the Price Assessment Deliberation Committee, and the Committee under Article 27. <Amended on Jul. 30, 2015; Oct. 17, 2022; May 20, 2024>
(2) The Art Gallery Materials Recommendation Council shall be composed of five or fewer external experts who are not members of the Committee under Article 27, the President of a Seoul Metropolitan City art gallery (hereinafter referred to as a “Gallery President”), and three or fewer internal experts including a curatorial research public official designated by the Gallery President. <Amended on Jul. 28, 2011; Oct. 17, 2022>
(3) There shall be no overlap of commissioned members among the committees involved in the purchase of gallery materials. <Amended on Oct. 17, 2022>
(4) The Art Gallery Materials Recommendation Council shall only determine matters concerning the recommendation of gallery materials, while the Price Assessment Deliberation Committee shall deliberate the appropriateness of the prices of recommended gallery materials, and the Committee under Article 27 shall make the final decision on the purchase of gallery materials.<Amended on Oct. 17, 2022>
(5) A member may not participate in the deliberations and resolutions of the Art Gallery Materials Recommendation Council or the Price Assessment Deliberation Committee regarding any items of agenda that fall under Article 28-2.<Added on Oct. 4, 2023>
(6) Matters concerning the composition and operation of the Price Assessment Deliberation Committee, other than those prescribed in paragraphs (3) to (5), shall be determined by the enforcement rules.<Added on Oct. 17, 2022; Oct. 4, 2023>

Article 23 (Designation, Etc., of Officers in Charge of Collected Art Gallery Materials Management)
(1) For the efficient management of collected art gallery materials, the Mayor may designate an officer to manage collected art gallery materials and a public official in charge of the issuance and receipt of such materials, and may also designate assistants where deemed necessary. Matters concerning the foregoing shall be prescribed by the relevant rules. <Amended on Oct. 17, 2022; Jul. 14, 2025>
(2) The officer responsible for managing collected art gallery materials shall handle affairs concerning the management, repair, restoration, reproduction, issuance and receipt, storage, etc. of the collected art gallery materials. <Amended on Oct. 17, 2022>
(3) The public official responsible for the issuance and receipt of collected art gallery materials shall assist the management officer with his or her duties under the latter’s directions and supervision. <Amended on Oct. 17, 2022>

Article 24 (Storage and Management of Collected Art Gallery Materials)
(1) The Mayor shall efficiently manage the collected art gallery materials to prevent the loss, damage, or theft thereof. <Amended on Oct. 17, 2022>
(2) The Mayor may subscribe to property insurance if necessary for the storage and management of the collected art gallery materials. <Amended on Oct. 17, 2022>
(3) The Mayor shall make efforts to obtain certificates of authenticity or acceptable substitute certificates for collected art gallery materials. <Added on Mar. 27, 2025>

Article 25 (Perusal, Etc. of Art Gallery Materials)
(1) The Mayor may permit the perusal or borrowing of art gallery materials upon submittal of an application for such. <Amended on Oct. 17, 2022>
(2) A person who peruses or borrows art gallery materials and subsequently loses or damages such materials shall be liable to pay immediate compensation. <Amended on Oct. 17, 2022>
(3) Matters concerning the terms, fees, etc. for the loan of art gallery materials shall be determined by the relevant rules. <Amended on Jul. 30, 2015; Oct. 17, 2022; May 20, 2024>

Article 26 (Donation of Art Gallery Materials)
(1) The Mayor shall decide whether to accept an application to donate art gallery materials from an artist or collector (collection) after deliberation by the Donation Acceptance Deliberation Committee. <Amended on Oct. 17, 2022>
(2) The Donation Acceptance Deliberation Committee shall be composed of at least three but no more than ten members, including a Gallery President, and the Gallery President shall serve as the Chairperson. <Added on Oct. 17, 2022>
(3) The members of the Donation Acceptance Deliberation Committee shall be commissioned by the Mayor from among persons with extensive academic knowledge and experience of art gallery materials, etc., and their terms of office shall run until the end of every evaluation in the relevant field. <Added on Oct. 17, 2022>
(4) There shall be no overlapping appointments of members among the committees engaged in handling donation of art gallery materials. <Added on Oct. 17, 2022; May 20, 2024>
(5) A meeting of a Donation Acceptance Deliberation Committee shall make resolutions by the affirmative vote of the majority of the members. <Added on Oct. 17, 2022; May 20, 2024>
(6) A member may not participate in the deliberations and resolutions of the Donation Acceptance Deliberation Committee regarding any item of agenda that falls under Article 28-2. <Added on Oct. 4, 2023>
(7) The Mayor shall present the donor with a donation certificate and pay a donation honorarium of 20% or less than the assessed value of the donated art gallery material within the available budget if the donor requests it, with the value to be assessed by the deliberation and resolution of the Gallery’s Price Assessment Deliberation Committee. <Amended on Oct. 17, 2022; Oct. 4, 2023; May 20, 2024>

CHAPTER V SEOUL METROPOLITAN CITY ART GALLERIES STEERING ADVISORY COMMITTEE, ETC.
Article 27 (Seoul Metropolitan City Art Galleries Steering Advisory Committee)
The Mayor shall establish a committee to obtain advice on the efficient operation of Seoul Metropolitan City’s Galleries.

Article 28 (Composition of the Committee)
(1) The Committee shall be composed of at least 10 but no more than 15 members, with external members accounting for 50% or more of all the members; they shall be commissioned by the Mayor from among any of the following persons: Provided, however, that the Gallery President shall be an ex officio member:<Amended on Jul. 30, 2015, Oct. 17, 2022>
1. A person who has extensive knowledge and experience in a field of expertise concerning the arts;
2. A member of the Seoul Metropolitan Council recommended by the Council;
3. Any other person whose deliberation and advice are deemed necessary by the Mayor for Gallery operations.
(2) A member’s term of office shall be two years, and it may be renewed once: Provided, however, that a substitute member’s term of office shall be the remainder of the predecessor’s term of office, while the terms of office of Seoul Metropolitan Council members recommended by the Council and ex officio members shall be the period they are in office. <Amended on Jul. 28, 2011; Jul. 30, 2015; Oct. 17, 2022>
(3) The Mayor may decommission members before their terms of office expire, under Article 8-2 of the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Various Committees. <Amended on Jul. 24, 2023>
Article 28-2 (Exclusion, Challenge, and Recusal of Members)
(1) A member who falls under any of the following shall be excluded from the Committee’s deliberations and resolutions under Article 27:
1. Where a member, a member’s spouse, or a former spouse is a party involved in an item of agenda, or is a holder of joint rights or joint obligor with a party involved in the item of agenda;
2. Where a member is or was a family member of a party involved in an item of agenda;
3. Where a member has testified, made a statement, consulted, researched, contracted, or appraised, in connection with an item of agenda;
4. Where a member, or a corporation with which a member is affiliated, is or was an agent of a party involved in an item of agenda;
5. Where a member’s duties are unlikely to be fairly discharged due to that member’s interest with a party involved in an item of agenda, such as school ties.
(2) A party involved in deliberating an item of agenda may apply to the Committee to challenge a member if there is cause for that member’s exclusion under paragraph (1), or if there is sufficient cause to doubt the fairness of a member’s deliberation and resolution, and the Committee shall decide by resolution whether to exclude that member. In such a case, the member subject to an “application to challenge a member” may not participate in the resolution.
(3) A member falling under any of the subparagraphs of paragraph (1) or paragraph (2) shall recuse himself or herself from the deliberation and resolution of the agenda.
(4) Detailed matters concerning the exclusion, challenge, and recusal of members shall be determined by the Gallery President.

Article 29 (Functions of the Committee)
The Committee shall deliberate and advise on the following matters: <Amended on Jul. 30, 2015; May 20, 2024>
1. Matters concerning the setting of the direction for arts policies and their promotion;
2. Matters concerning the formulation and planning of arts programs;
3. Matters concerning the deliberation of rental permits;
4. Matters concerning the collection of works, etc.;
5. Other matters concerning Gallery operations that are referred to a meeting by the Mayor.
Article 30 (Chairperson and Vice-Chairperson)
(1) The Committee shall have one Chairperson and one Vice-Chairperson. <Amended on Jul. 30, 2015>
(2) The Chairperson and the Vice-Chairperson shall be elected by and from among the members of the Committee, and their term of office shall be two years.
(3) The Chairperson shall represent the Committee, convene its meetings, and chair its meetings.
(4) The Vice-Chairperson shall assist the Chairperson and perform the Chairperson’s duties by proxy when the Chairperson is unable to do so. <Amended on May 20, 2024>
Article 31 (Meetings of the Committee)
(1) Meetings of the Committee shall be convened by the Chairperson at the request of the Mayor or that of at least 1/3 of the members on the register.
(2) The Chairperson or Gallery President, when seeking to convene a meeting, shall notify each member of the date and time, venue, and agenda of the meeting at least 15 days in advance of the scheduled date thereof. <Amended on Jul. 30, 2015; Jul. 24, 2023>
(3) The Committee shall make a resolution with the attendance of the majority of the members on the register and the affirmative vote of a majority of the attending members: Provided, however, that the purchase of artworks shall be resolved by the affirmative vote of at least 2/3 of the attending members. <Amended on Oct. 17, 2022; May 20, 2024>

Article 32 (Members’ Compensation)
Members participating in the Committee may be paid necessary expenses such as allowances and travel costs within the available budget. <Amended on May 20, 2024>
Article 33 (Operation of Advisory Organs for Major Projects)
(1) The Mayor may establish a separate advisory organ for each major project, and Articles 27 to 32 shall apply mutatis mutandis to the operations of such organs.
(2) The composition and operation of the advisory organs under paragraph (1) shall be determined by the relevant rules. <Amended on Jul. 30, 2015>
Article 34 (Delegation of Powers)
The powers of the Mayor under this Ordinance shall be delegated to the Gallery Presidents to enhance the efficiency and expertise of Gallery work and operations. <Amended on Jul. 28, 2011>
Article 35 (Enactment of Internal Regulations and Entrustment to the Private Sector)
(1) The Gallery Presidents may enact internal regulations prescribing the procedures, means, scope, etc. of the core work of the Galleries.
(2) If it is deemed necessary, the Gallery Presidents may entrust Gallery affairs to the private sector in order to promote public services and boost productivity. <Amended on May 20, 2024>
(3) The entrustment of Galleries’ affairs to the private sector shall be governed by the Seoul Metropolitan Government Ordinance on the Entrustment of Administrative Affairs to the Private Sector, except as otherwise provided. <Amended on May 20, 2024>
Article 36 (Support for Individuals, Organizations, Etc.)
The Gallery Presidents shall implement the following programs to broaden the foundations for arts and culture in Seoul Metropolitan City, and may offer administrative and financial support to pertinent individuals and organizations:
1. Operation of programs to support emerging artists.
