ENFORCEMENT RULES OF THE SEOUL METROPOLITAN GOVERNMENT FRAMEWORK ORDINANCE ON THE CONSERVATION AND USE OF HANGANG PARK

Article 1 (Purpose) The purpose of these Rules is to prescribe the matters delegated by the Framework Ordinance of the Seoul Metropolitan Government on the Conservation and Use of Hangang Park and the matters necessary for their enforcement. <Amended on Aug. 1, 2019>


Article 2 (Formulation of the Master Plan) (1) The following matters shall be included in the master plan under Article 8 (3) of the Seoul Metropolitan Government Framework Ordinance on the Conservation and Use of Hangang Park (hereinafter referred to as the “Ordinance”): <Amended on Aug. 1, 2019>
1. Basic goals and policy directions for Hangang Park;
2. Matters concerning the conservation and restoration of the Hangang River ecosystem;
3. Plans for the installation and use of major facilities in Hangang Park;
4. Matters concerning the estimation of expenses required for project implementation and means of securing financial resources;
5. Matters concerning cooperation with related central administrative agencies and local governments;
6. Other matters necessary for improving Hangang Park.
(2) The Seoul Metropolitan Government Future Hangang River Administrator (hereinafter referred to as the “Administrator”) may hear the opinions of the Seoul Metropolitan Government Hangang River Citizen Committee under Article 22 of the Ordinance when establishing or modifying the master plan. <Amended on Aug. 1, 2019; Jun. 8, 2023>


Article 3 (Publication of White Paper) (1) The Hangang Park White Paper under Article 10 (1) of the Ordinance shall be published by May of the year following its completion.
(2) The White Paper shall be published by posting it in the Seoul Metropolitan Government’s Gazette and on the Seoul Metropolitan Government’s website, etc.


Article 4 (Keeping the Facilities Management Ledger, Etc.) (1) The Administrator shall keep and manage a Facilities Management Ledger equivalent to attached Form 1 to ensure the safety and continued functioning of the facilities in use.
(2) The Administrator shall conduct periodic and occasional patrols of the facilities in use, and shall take necessary measures to replace, restore, remove or paint any facility that is soiled or damaged during its use.


Article 5 (Public Notice) When seeking to select an entrusted entity or an entity permitted to use and profit from a facility in use (hereinafter referred to as an “operator”) through the process of open competition under Article 13 of the Ordinance, the Administrator shall issue a public notice of such fact via information processing devices, etc. designated and publicly notified by the Minister of the Interior and Safety. <Amended on Jan. 18, 2018>


Article 6 (Entrustment Contract, Etc.) When entrusting the management and operation of a facility in use or permitting the use of and profit therefrom, the Administrator shall specify the following details in the contract or the use and profit permit:
1. Operator’s name, address, period of use;
2. Subject affairs and their substance;
3. Matters concerning revenues and operating costs;
4. The operator’s obligations and terms of compliance;
5. Matters concerning facility safety management;
6. Other matters deemed necessary by the Administrator.


Article 7 (Collection of Usage Fees, Etc.) (1) Park usage fees and hours of use for park facilities in use under Article 14 (1) of the Ordinance shall be as presented in Annex 1.
(2) The usage fees under paragraph (1) shall be collected when a person or entity applies to use a facility in use: Provided, however, that the same shall not apply where the use consists of hourly parking in parking facilities. <Amended on Jan. 13, 2022>
(3) When the management and operation of a park facility in use is entrusted, or when its use and profit are permitted, the operator shall issue admission tickets to collect usage fees for the facility in use.


Article 8 (Use Fee Discounts) The scope of usage fee discounts for facilities in use under Article 14 (3) of the Ordinance shall be as presented in Annex 2.


Article 9 (Evacuation of Facilities) When an entrusted or permitted facility, etc. is at risk of loss or damage by a disaster such as a flood, the operator shall evacuate the facility, etc. to a safe location.


Article 10 (Ways for Organizations to Participate; Support for Participation) (1) An organization under Article 16 of the Ordinance that seeks to conduct a project (activity) for the purpose of conservation or use of Hangang River shall obtain the Administrator’s approval by submitting the plan for such project.
(2) The Administrator may revoke approval for any of the following:
1. Where the approval is obtained by deceit or other improper means;
2. Where the requirements for approval no longer hold true;
3. Where the organization fails to engage in the activities presented under the plan.
(3) The Administrator may subsidize the necessary expenses of organizations falling under paragraph (1) within the scope of their projects (activities), and may cause all or a part of any subsidized funds that are used for purposes other than those specified in the plan to be returned. <Amended on Jan. 13, 2022>
(4) Matters concerning the subsidization process, follow-up management, etc. of the subsidization of costs necessary for activities under paragraph (3) shall be governed by the Assistance for Non-Profit, Non-Governmental Organizations Act.<Amended on Oct. 10, 2019>


Article 11 (Restrictions on Recreational Fishing) Recreational fishing restricted under Article 18 (1) of the Ordinance shall be as follows:<Amended on Jan. 13, 2022>
1. Gill net fishing, cast net fishing, longline fishing, and set-net fishing;
2. Fishing on water (including powered and unpowered vessels);
3. Fishing that pollutes streams and rivers using bait such as paste bait or fish meal;
4. Fishing using snagging hooks under Annex 3 or fishing with snagging motions;
5. Taking or collecting species of fish prescribed in Annex 1 of the Enforcement Decree of the Inland Water Fisheries Act;
6. Capturing or farming fish or shellfish;
7. Using four or more fishing rods per person;
8. Fishing in an area designated and publicly notified by the Administrator under Article 18 (2) of the Ordinance;
9. Other actions separately restricted by the Administrator for the conservation of the Hangang River.


Article 12 (Operation of Enforcement Teams) (1) An enforcement team under Article 19 (1) of the Ordinance may be formed and operated with the following personnel:<Amended on Oct. 10, 2019; Jul. 29, 2021; Jan. 13, 2022>
1. Public official in charge;
2. Registered security guard;
3. A person working at Hangang Park, or a contractor’s employee;
4. An organization under Article 16 of the Ordinance;
5. Other persons recognized by the Administrator as suitable members of a prohibition enforcement team.
(2) The Administrator shall separately appoint members of enforcement teams who are not public officials or registered security guards to serve for a designated period, and such members shall jointly enforce prohibitions jointly with public officials or registered security guards.
(3) The identification worn by an enforcement team under Article 19 (2) of the Ordinance shall be as presented in attached Form 2.


Article 13 (Appropriate Waste Disposal) An operator shall comply with the following for appropriate waste management and disposal under Article 21 (3):
1. General waste shall be disposed of in standard bags for general waste sold at sellers designated by the Administrator (hereinafter referred to as “bag vendors”) after separating out recyclable resources using the means determined by a Ministerial Decree of Environment.
2. As little food waste as possible should be generated, and any food waste shall be disposed of by the operator.

Article 14 (Specific Matters on the Enforcement of the Volume-based Waste Fee System, Etc.) (1) Hangang Park standard waste bags shall be either standard bags for volume-based general waste, or public bags for waste from joint cleaning work.
(2) The Administrator may use the necessary quantities of public bags for joint cleaning work.
(3) A person who disposes of volume-based wastes shall directly purchase standard waste bags for general waste from a bag vendor. The prices of the standard bags shall be presented as in Annex 4. <Amended on Oct. 10, 2019>
(4) Regarding standard bags, the Administrator shall supply standard bags for general waste to bag vendors, who may be granted a sales margin of 10%.
(5) A bag vendor shall comply with the following matters:
1. Secure ample supplies of standard bags by type and capacity;
2. Affix designation signs and prescribed price tags as determined by the Administrator;
3. Engage in no exhibition or sale of counterfeit or illegally released bags;
4. Report any discoveries of illegal acts, such as the distribution of counterfeit bags;
5. Pay within the specified period for standard bags;
6. Refund the purchase price if a buyer requests to return any unused standard bags;
7. Follow other administrative directions.
(6) The Administrator shall take appropriate measures regarding any bag vendor who violates the compliance terms under the subparagraphs of paragraph (5). <Amended on Jan. 13, 2022>


Article 15 (Operation of the Hangang River Citizens Committee, Etc.) (1) The Culture Administrator, Urban Spaces Administrator, Balanced Development Administrator, and Water Circulation Safety Administrator shall be ex officio members of the Seoul Metropolitan Government Hangang River Citizens Committee (hereinafter referred to as the “Committee”) under Article 22 (4) of the Ordinance. <Amended on Dec. 30, 2014; Jul. 1, 2015; Oct. 18, 2018; Aug. 1, 2019; Jul. 19, 2021, Dec. 29, 2023>
(2) The division committees under Article 22 (6) of the Ordinance shall be the Ecology and Environment Division Committee, Aquatic Leisure Division Committee, the History and Culture Division Committee, Urban Landscape Division Committee, and Citizen Patronage Division Committee. One chairperson shall be elected by and from among the members of each division committee, and each shall be a joint Vice-Chairperson of the Committee. <Amended on Oct. 18, 2018; Aug. 1, 2019; Apr. 13, 2023>
(3) If necessary to respond professionally and efficiently to requests for advice, the Committee may compose and operate subcommittees by resolutions of the Committee. <Added on Oct. 18, 2018>
(4) The Committee shall have a secretary and a clerk; the General Affairs Manager of the Future Hangang Headquarters who hosts the meetings shall serve as the secretary, while the chief in charge of the Committee’s duties shall serve as a clerk. <Amended on Oct. 18, 2018; Jun. 8, 2023>
(5) An institution or member who wishes to submit an agenda to the Commission shall in principle prepare an advice and reporting agenda for submission to the Committee no later than 10 days before the meeting. The same shall apply where an agenda is submitted to a division committee or subcommittee: Provided, however, that the same shall not apply where there is an unavoidable cause for not doing so, such as an urgent item of agenda. <Amended on Oct. 18, 2018>
(6) Upon a request to convene a meeting under Article 23 (2) of the Ordinance, the Chairperson shall notify the members no later than seven days before the meeting date. <Amended on Oct. 18, 2018; Jan. 13, 2022>
(7) Any matters necessary in connection with the operation of the Committee that are not prescribed in these Rules shall be determined by the detailed operational rules with the resolution of the Committee. <Amended on Oct. 18, 2018>


Article 16 (Detailed Guidelines) Other matters necessary in connection with these Rules shall be separately determined by the Administrator. <Amended on Jan. 13, 2022>

These Rules shall enter into force on the date of their promulgation.
